MINUTES OF THE REGULAR MEETING HELD BY THE TOWN COMMISSION OF THE TOWN
OF GULF STREAM ON FRIDAY, JANUARY 11, 2002 AT 9:00 A.M., IN THE
COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM,
FLORIDA.
I. Call to Order. Mayor Koch called the meeting to order at 9 A.M.
II. Pledge of Allegiance. The Pledge of Allegiance was led by the
Mayor.
III. Roll Call.

IV. Minutes of the Regular Meeting of December 14, 2001.
Commissioner Lynch called attention to an error in the first
paragraph of Item VIII wherein the date was shown as 1978 as opposed to
the correct date of 1998. Commissioner Devitt moved that the minutes be
approved as corrected and Commissioner Lynch seconded the motion. Roll
Call: Comm. Orthwein; AYE, Comm. Devitt; AYE, Comm. Lynch; AYE, Comm.
Hopkins; AYE and Mayor Koch; AYE.
V. Additions, withdrawals, deferrals, arrangement of agenda items.
Town Manager Thrasher requested to add Item VII.A.3., Code
Revisions. There were no objections.

Mayor Koch called attention to the above dates.
B. Mayor's Proclamation for Election on March 12, 2002
The Town Clerk read the Mayor's Proclamation for an election to be held
on March 12, 2002 for the purpose of electing 5 Town Commissioners for a
term of 3 years each. The Proclamation stated the election would be
held at 100 Sea Road from 7 A.M. to 7 P.M. Eastern Standard Time and
that candidates may qualify to have their names placed on the ballot
from noon on January 29, 2002 until noon on February 12, 2002.

VII. Reports.
A. Town Manager
1. Old School Road & Polo Drive Project Update
Town Manager Thrasher reported that the project has not yet been turned
over to the Town due to the fact the system did not hold a 10# pressure
during the 2 hour test, which is provided in the contract. He advised
that two small leaks have been discovered and are in the process of
C) being repaired. The Town Manager further advised that the contractor
has been paid $349,000 and that $74,000 is being held until such time as
the project is turned over to the Town.
2. Utility maintenance /construction rates
Mr. Thrasher advised that he has received a rate schedule from two more
companies with another promising to submit next week. He recommended
that this item be considered at the next meeting and the Commissioners
were in agreement.
3. Code Revisions
Town Manager Thrasher noted that it has been two years since the Code
had been reviewed and amendments made. He recommended that there be no
review at this time due to the reduced volume of construction and the
fact that none of the items listed for consideration would have a major
impact on the Town. He reminded that Code Amendments are costly and
require a considerable commitment from the ARPB members and the Town
Commissioners. In addition, the Chairman of the ARPB agrees that a
review is not necessary at this time. Mr. Thrasher recommend that the
matter of a Code review be addressed in January 2003.
The Commissioners unanimously agreed with the Town Managers
recommendation.

C. Finance Director
1. Financial Report for December 2001
There were no questions regarding the Financial Report and Commissioner
Lynch moved and Commissioner Orthwein seconded that the report be
approved as circulated and all voted AYE at Roll Call.
D. Police Chief
1. Activity for December 2001
Chief Ward asked if there were any questions in relation to the December
Activity Report and there were none.
2. Compliance with Construction Damage Prevention Policy
The Chief advised that at the direction from the Commission at the last
meeting, he had surveyed the various installations of PVC pipes in the
public rights -of -way in the area of construction sites for compliance
with the Construction Damage Prevention Policy. He reported there are
11 areas and that 6 of them are in compliance. Representatives of the

other 5 have been contacted and some of them have since complied, and
the others have agreed to comply. He further reported they were all
cooperative.
VIII. Items for Commission Action.
A. Items by Mayor & Commissioners
oCommissioner Orthwein asked for a report on the Feral Cat problem.
Chief Ward advised that they are following the advise of the trapper
which was to discontinue the trapping for one month and then to re-
evaluate the situation.
IX. Public. There was no comment from the public.
X. Adjournment. Mayor Koch adjourned the meeting at 9:37 A.M.

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
NOTICE IS HEREBY GIVEN that the Architectural Review and Planning Board
of the Town of Gulf Stream will hold a Public Hearing on February 21, 2002
at 8:30 A.M., and the Town Commission will hold a Public Hearing on March 8,
2002 at 9:00 A.M., both in the Commission Chambers of the Town Hall, 100 Sea
Road, Gulf Stream, Florida, at which the following will be considered:
OAn application submitted by Sally Gingras, as agent for John T. Fogarty
owner of the property located at 2918 N. Ocean Blvd., Gulf Stream,
Florida, which is legally described as Lot 42 and the south 45' of Lot
41, Gulf Stream Properties for the following:
LEVEL III ARCHITECTRRAL SITE PLAN REVIEW to permit a two story
addition to the existing one and two story Gulf Stream Bermuda style
dwelling consisting of 2,200 square feet, with the first floor to be
a garage and workshop and living accommodations on the second floor.
The demolition of a small utility shed is also a part of this
application.
The Architectural Review and Planning Board shall make a recommendation to
the Town Commission, and the Town Commission shall make a final decision
regarding the subject application at the meetings noticed above. These
meetings may be adjourned from time to time and place to place as may be
necessary to hear all parties and evidence.
The complete application materials are on file in the Office of the Town
Clerk located at 100 Sea Road, Gulf Stream, Florida 33483, and may be
reviewed during regular business hours, which generally include non - holiday
weekdays from 9:00 A.M. to 4:00 P.M.

Planning Board of the Town of Gulf Stream will hold a Public

Associates, agents for Harry and Deborah Sargeant, owners of the
property located at 1420 North Ocean Blvd., Gulf Stream, Florida,
legally described as Lots 11, 11A and 12, McLouth Subdivision,
Plat Book 25, Page 67 of the Public Records of Palm Beach County
for the following:
VARIANCE from the provision in Section 66 -1, Definition of
a Guesthouse, to permit construction of a guesthouse that
would exceed the maximum permitted land coverage of 700
square feet, by 900 square feet.
LEVEL 3 ARCHITECTURAL SITE PLAN REVIEW as follows:
1. To permit the construction of a Gulf Stream Bermuda
(Anglo Caribbean) style guesthouse consisting of 1,600
square feet adjacent to a Gulf Stream Bermuda (Anglo

The Architectural Review and Planning Board shall make a
