1. Call to Order and Introduction of Members, Ex-Officio Members and Staff
Chairman Hake called the meeting to order at 7:30 a.m. and introduced Board members and
asked staff to introduce themselves. A quorum was present to hear the items on the agenda. The
following members were designated to vote: Hake, Crabtree, Lacy, and Keating. Mr. Michael and
Mr. Cartwright were not designated as eligible to vote due to not being connected to the virtual
meeting through video.
Those wishing to speak to the Board were sworn in.
2. Procedures Explained
Chairman Hake explained the procedures of the meeting. Mr. Barron entered the following
documents as exhibits for all items under consideration at the meeting:
1. The City Code of the City of Jefferson, as amended
2. The Comprehensive Plan and Land Use Map
3. Copies of applications under consideration
4. A list of Property owners to whom notice of the hearing was sent
5. The affidavits of publication of notice of the public hearing
6. Copies of drawings and plans under consideration
7. Letters and memoranda from City staff
8. Staff reports and minutes of proceedings
9. Materials submitted by the public or the applicant
10. Rules of Procedure for the Board of Adjustment
3. Adoption of Agenda
Mr. Crabtree moved and Ms. Lacy seconded to adopt the agenda as printed. The motion passed
4-0 with the following votes:
Aye: Hake, Crabtree, Lacy, and Keating.
Nay: None.
4. Approval of Minutes from the Regular Meeting of the December 8, 2020
Ms. Crabtree moved and Ms. Keating seconded to approve the minutes as printed. The motion
passed 4-0 with the following votes:
Aye: Hake, Crabtree, Lacy, and Keating.

5. Communications Received

6. New Business – Public Hearing
Case No. B21001 – 4024 Catalina Drive; Side Setback Variance. Application filed by MRA
Construction LLC, applicant, Aaron and Lisa Washburn, property owners, requesting a 3.25 foot
variance to the 10 foot side yard setback of the RS-2 district to permit a 6.75 foot side yard
setback to permit a garage and pool house addition. The property is located on the north side of
Catalina Drive 300 feet east of Welling Green Court and described as Lot 83 of the Emerald
Ridge Subdivision, Section 2.
Ms. Lewis explained that the property consists of a single family residential home located within
an established residential neighborhood. The property owners desire to construct an addition to
the house on the side of the structure. In order to accommodate the proposed addition, the
property owner has applied for a variance to the side setback requirement..
Mr. Randy Allen- 1805 Greenberry Rd, stated that drew up plans for MRA Construction, and then
MRA Construction submitted the application on the homeowners behalf.
Ms. Lewis stated the home was constructed in 2001. The setbacks for the RS-2 zoning district
are 25’ in the front 30’ to the rear and 10’ on each side. The proposed building addition is 14 feet
wide by 57 feet deep, and would function as both a garage and pool house additio n. The building
addition would intrude 3.25 feet into the side setback area. She stated that a building permit for
the construction was issued on 11/18/20. A subsequent survey revealed that the building addition
failed to meet the side setback requirement.
The Chair opened the public hearing and asked for anyone wishing to speak in favor, opposed, or
give any comments on the request. With no one coming forward to speak on the request, the
chair closed the public hearing.
Ms. Lewis told the committee the required findings appear to be met. The setback variance is
requested in order to permit a garage and pool house addition, which is a common feature in the
neighborhood. Given the large separation from the adjacent house, the setback variance should
not create any obvious safety concerns or major impacts on the use of adjacent property.
Mr. Crabtree moved and Ms. Keating seconded to approve the requested variance of 3.25 feet to
the 10 foot setback to permit a side setback of 6.75 feet. The motion passed 4-0 with the
following roll call vote:
Aye: Hake, Crabtree, Lacy, and Keating.
Nay: None.
