NEED TO INSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH

MINUTES OF THE CERTIFICATION OF ELECTION RETURNS MEETING HELD BY THE
TOWN COMMISSION OF THE TOWN OF GULF STREAM ON FRIDAY, MARCH 15, 2002 AT
NOON, IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF
STREAM, FLORIDA.
I. Call to Order. Mayor Koch called the meeting to order at
12:05 P.M.
II. Roll Call.

III. Certification of Election Results. The Town Clerk announced that
only the incumbent Commissioners had qualified for candidacy,
resulting in no election being held and the incumbents being re- elected
for a 3 year term each.
Commissioner Lynch moved and Commissioner Hopkins seconded to certify
the results as presented by the Clerk. Roll Call: Comm. Devitt; AYE,
Comm. Lynch; AYE, Commissioner Hopkins; AYE and Mayor Koch; AYE.
IV. Seating of 5 Commissioners. Commissioner Devitt moved that
William F. Koch, Jr., Joan K. Orthwein, Fred B. Devitt III,
Robert Hopkins II, and William A. Lynch be seated and the motion was
seconded by Commissioner Lynch. Roll Call: Comm. Devitt; AYE, Comm.
Lynch; AYE, Comm. Hopkins; AYE and Mayor Koch; AYE.
V. Swearing in of the Commissioners. The Town Clerk administered
the Oath of Office to William F. Koch, Jr., Fred B. Devitt III,
Robert W. Hopkins II and William A. Lynch.
VI. Adjournment. Mayor Koch adjourned the meeting at 12:05 P.M. on a
motion to do so made by Commissioner Hopkins that was seconded by
Commissioner Lynch with all voting in the affirmative.

IV. Request for Funds for Drainage Structure Maintenance
from the Little Club. Town Manager Thrasher explained that
he had spoken with Chuck Woodward from the Little Club and the
contractor for this work, Thomas Brown. They explained that they will
be placing a GEO- FILTER TUBE EROSION BARRIER on the bank around the lake
and filling it with material that is being pumped from the bottom of the
pond. Sod will then be placed over the tube. Mr. Thrasher had
questioned the contractor as to how much material it would take to fill
this tube and the contractor was unable to answer this. They are
estimating there is 4' of silt accumulated on the bottom. The Town
Manager advised that in the past, an engineer had estimated there to be
2' of silt. He pointed out that they will pump as much as necessary to
fill the tube and it appears that it will not be just silt but a portion
of the lake bottom. This will result in smaller lake but it will be
deeper. Mr. Thrasher believed that the scope of this project, showing
the Gulf Stream share to be $12,418.00, goes beyond maintenance work and
added that the Little Club has already signed a contract with work to
commence in April. He explained that under the current agreement with
the Club, the Town pays 45% of the cost of maintenance of the drainage
^ facility that in this instance would only be dredging the silt, not
J rebuilding the banks.
The Town Manager also called attention to the current contract which
expires in October 2002, pointing out that both parties are directed to
advise the other when at any time changes are being made that would
change the drainage requirements substantially. He pointed out that
with the installation of the new pumps at Polo & Old School Road, Gulf
Stream's reliance on the Little Club Drainage System is much less and
should be addressed through a percentage adjustment.

Mayor Koch added that the Town also pays 45% of all the electricity to
run the pumps at the Little Club. He pointed out that the only times
the Town should be sharing in this cost is when there is a storm event
as the Club frequently uses the pumps to control the ground water level
which has nothing to do with the Town.
The Commissioners agreed that it appears the scope of work is greater
than maintenance and felt that the Club should be advised at once, since
they have already contracted the work, that the Town has issues with
this project.
Commissioner Lynch moved and Commissioner Devitt seconded that the
letter drafted by Town Manager Thrasher with no changes be delivered at
once to the Little Club. All voted AYE at Roll Call.
Mayor Koch stated that if representatives of the Club wanted to discuss
the matter with the Commission, he would call a Special Meeting for that
purpose.
V. Adjournment. Mayor Koch adjourned the meeting at 12:37 P.M.
following a motion to do so made by Commissioner Devitt which
was seconded by Commissioner Lynch with all voting in the affirmative.
