A CHARTER ORDINANCE AMENDING CHARTER ORDINANCE 7 OF THE CITY
OF BEL AIRE, KANSAS, EXEMPTING THE CITY OF BEL AIRE, KANSAS, FROM
ALL PROVISIONS OF K.S.A. 14-204, AND PROVIDING SUBSTITUTE AND
ADDITIONAL PROVISIONS FOR THE SAME.
Be it ordained by the Governing Body of the City of Bel Aire, Kansas,
Section 1: Exemption. Pursuant to the power vested in it by Article 12, Section 5, of the
Constitution of the State of Kansas, the City of Bel Aire, Kansas does hereby elect to
exempt itself from and make inapplicable to this city all remaining portions of K.S.A. 14-
204, not previously exempted under Charter Ordinance 7, such statute being an Act of the
Kansas Legislature that is non-uniform in application, by amending Sections 2 and 3 of
that Charter Ordinance as follows:
Section 2. Council Positions Established
There are hereby established five council member, positions which shall be
elected at large from the City of Bel Aire, Kansas. Two council member
positions shall be filled by election on the first Tuesday in April in 1999. The
remaining three council member positions shall be filled by election on the first
Tuesday in April of 2001. The positions shall be elected for four(4) year terms.
Section 3:Existing Council Positions and Vacancies.
The existing members of the Bel Aire City Council shall hold office for their
existing terms and until their successors have been elected and qualified as
provided for above.
If a vacancy occurs on the City Council by death, resignation, removal from the
city, removal from office, refusal to qualify, or otherwise, the vacancy shall be
filled by appointment of the governing body of the City in conformance with
City Council policy and procedures as established and adopted by the Bel Aire
City Council. Such appointment shall be for the period from and after the date of
appointment and until the date of the next April city election. On such date, the
unexpired term shall be filled by election. In any April election that includes a
position for an unexpired term, the top vote recipients will fill the open full term
positions, and the next highest vote recipient will fill the position with the
unexpired term.
The council shall elect from its membership a president of the council. The
president of the council shall preside in the absence of the mayor. If a vacancy
occurs in the office of the mayor by death, resignation, removal from the city,
removal from office, refusal to qualify, or otherwise, the president of the council
shall become mayor until the next regular city election and the vacancy created
in the office of the council member becoming mayor shall be filled by the
governing body of the city. Thereupon the council shall elect from its
membership a new president of the council.
Section 2. Those sections of Charter Ordinance 7, not amended by action of this
Charter Ordinance shall remain in force and effect.
Section 3. Effective Date. This Charter Ordinance shall be published once each
week for two consecutive weeks in the official city newspaper, and shall take effect sixty-
one days after its final publication.
Passed by tw -thirds vote of the members elect of the Bel Aire City Council this
day of 1 2012.
