HomeMy Public PortalAbout2009.076 (05-06-09)RESOLUTION NO. 2009.076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING AMENDMENTS TO THE HOUSING REHABILITATION PROGRAM GUIDELINES WHEREAS, the City of Lynwood is a participating jurisdiction of the HOME Program and receives an allocation of federal funds to provide affordable housing for low income households; and WHEREAS, the Lynwood City Council has adopted a Housing Rehabilitation Program to address the housing needs and enhance the overall housing conditions and increase affordable housing opportunities to principally benefit low income households: and WHEREAS, the HOME funded housing programs are administered by the City of Lynwood in compliance with the federal regulations established by the Department of Housing and Urban Development (HUD); and WHEREAS, the federal regulations provide'.opportunities 1or,_the City of Lynwood to establish programs and develop program guidelines according to the local housing needs; and WHEREAS, it is advantageous to the City and its general housing stock to enable the City Manager to make exceptions to the program guidelines so long as HOME requirements are met; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS: Section 1. That the City of Lynwood's Housing Rehabilitation Guidelines are hereby amended to read as follows: 1. The City Manager has the authority to grant or deny an appeal of the City of Lynwood's Housing Rehabilitation program guidelines as applied to an appellant so long as said decision is compliant with Federal and State laws governing the use of HOME funds. 2. The City Managers authority has authority to make decisions on a case by case basis to potentially assist homeowners who may have difficulty meeting the programs requirements and /or may have rehabilitation costs that exceed the maximum loan and /or grant amount that has been established in the rehabilitation program guidelines. Approval of additional rehabilitation costs must be in accordance with HUD's guidelines and regulations; whereas the value of the HOME assisted property after rehabilitation must not exceed 95 percent of the median purchase price for the area, as published by HUD. Section 2. That the City Manager or designee is authorized to prepare and execute any such documents related to the amendment to the guidelines. Section 3. This resolution takes effect immediately upon its adoption. PASSED, APPROVED, AND ADOPTED this 6th day of May 2009. 4 Ma is T.
