I. Call to Order. Mayor Koch called the meeting to order at 9 A.M. II. Pledge of Allegiance. The Pledge of Allegiance was led by Mayor Koch. OIII. Roll Call. Present and William F. Minutes of the Regular Meeting of March 14, 2003. Commissioner Lynch moved and Commissioner Orthwein seconded that the minutes be approved as circulated and all voted AYE. V. Mayor Koch announced these dates. items. Driveway O VII. Reports. A. Town Manager 1. Feral Cat Program Update Town Manager Thrasher reported that to date 130 cats have been caught through the TNR program. He stated that the total expenditure from the Town thus far is $9,807, which is $76.62 per cat. Mr. Thrasher added that 20 cats were sent to the vet at a total cost of $1000, the financing coming from donations. 2. Easement Request from FP &L Mr. Thrasher explained that he has gotten a request from FP &L requesting a 10 -foot easement, to place the three transformers that are on a pole Regular Meeting & Public Hearing Town Commission -April 11, 2003 Page 2 on the east side of County Road, on the ground in the southeast corner fenced area behind the maintenance building. Mayor Koch asked who would be financing this project. Mr. Thrasher said the County would be responsible. OMayor Koch believes that the Town should be neighborly and approve the easement request. The Mayor passed the gavel to Vice Mayor Orthwein in order to vote on this item. Commissioner Lynch moved and Mayor Koch seconded to approve the ten -foot easement request from FP &L. Roll Call: Comm. Devitt; NAY, Comm. Lynch; AYE, Comm. Orthwein; NAY, and Mayor Koch; AYE. The Commission did not reach an agreement and concurred that more information was needed before a decision could be reached. This item was tabled for the next meeting. 3. Request for Letter of Intent to accept County Road- P.B.Co. Town Manager Thrasher informed the Board that Commissioner Mary McCarty requested of the town, a letter of intent to accept County Road. Commissioner Devitt asked how would this benefit the Town. Mayor Koch said that the Town had told the County the Town would accept County Road when it was repaved. The Mayor believes it would be beneficial to the Town in the future to have jurisdiction over County Road. He added that the City of Boynton would be annexing the surrounding area in a couple years. Attorney Randolph advised that if County Road is in Gulf Stream, the Town would have jurisdiction over the traffic and signage. Mr. Randolph added that the basis for getting the road from the County is primarily for maintenance. The Attorney asked which part of the road is Gulf Stream and which part is unincorporated. Town Clerk Taylor stated that the municipal limits runs to the east side of the highway, the part that is in doubt is the part that comes off AlA. Mayor Koch said the map shows County Road in the municipal limits but he Cj could not decipher which part is Gulf Stream and which part is the County. The Commission directed Attorney Randolph to draft a letter to Commissioner McCarty advising of the Town's intent to accept transfer of County Road from the County to the Town with the confirmation that the entire road is located within the corporate limits of the Town of Gulf Stream, and the entire paved portion of the road, as existing and in use, does not encroach upon any private properties. Commissioner Orthwein moved and Commissioner Devitt seconded to approve a letter if intent to be drafted by the Attorney Randolph and signed by Regular Meeting & Public Hearing Town Commission -April 11, 2003 Page 3 Mayor Koch. Town Hall Driveway Repaving Town Manager Thrasher reported that he has received four proposals to repave the town hall, police department and maintenance area parking lots. He advised that the most favorable quote was $13,600 plus field O adjustments. The Town Manager requested the funds for this project be taken from underutilized other capital improvements. Mayor Koch believes the underutilized funds should go back into lowering the millage rate. Town Manager Thrasher explained that the town hall repaving is included in the budget but the scope of the work elongated the paving project. Commissioner Devitt asked if the quote is for resurfacing only. Mr. Thrasher said it is for resurfacing only with one inch of asphalt. Commissioner Orthwein moved and Commissioner Lynch seconded to approve the repaving of the town hall, police department and maintenance department parking lots with the funds coming from underutilized other capital improvements. (first reading) Town Clerk Taylor read Ordinance No. 03/ by title. Commissioner Devitt asked for a review on this item. Town Clerk Taylor reminded that this item was presented to the Board several months ago and it was approved with zoning in progress declared. Attorney Randolph added that this ordinance applies to reroof on existing structures only, it does not apply to new homes. Commissioner Orthwein moved and Commissioner Devitt seconded to approve first reading of Ordinance No.03 /3. There was no comment from the public. Roll Call: Comm. Devitt; AYE, Comm. Police & Fire Communications Agreement -City of Delray Beach Town Manager Thrasher explained that Attorney Randolph, the Town Clerk, Chief Ward and himself, had reviewed the communications agreement with the City of Delray Beach and believes it to be a favorable contract. Mr. Thrasher said presently the Town is paying $33,000 annually for the service; the new contract is for five years with a base rate of $42,970 plus CPI. He added that the Town had been working under the old contract for two years and the 30% increase is in line with budgeted items. Commissioner Orthwein asked how Delray arrived at the new figure. Chief Ward said the contract is based on the amount of calls for Gulf Stream, a new radio system that Delray installed and the Gulf Stream Police Department laptops were hooked in to their system. Town Manager Thrasher reminded that the new contract is a 30% increase in the line item budget, he projected that there will be other increases in costs associated with the new contract other than CPI. Regular Meeting & Public Hearing Town Commission -April 11, 2003 Page 3 Commissioner Orthwein moved and Commissioner Devitt seconded to approve the Police & Fire Communications Agreement with the City of Delray Beach and authorized Mayor Koch and the Town Clerk to execute the same. Proposed Historical Markers -AlA O Town Clerk Taylor reported that she has been working with Commissioner Orthwein and they have been in contact with the state historical society. She reported that the standard Florida historical marker is cast aluminum; the text area is 30" high by 42" wide with a dark blue background and costs approximately $1,440, including the posts. The estimated delivery is three months or longer due to the lengthy review process. The Town Clerk added that another alternative in getting the signs earlier is by ordering them locally, but it would be very costly. She informed the Commission that Mrs. Neeves, President of the Civic Association offered to help with the cost of the signs. O Mayor Koch believes that by ordering from the state, the Town would have the state historical seal on the signs. The Commission agreed to order the signs from the state historical society with the language "AlA Historic Scenic Highway" and the financing taken from unappropriated funds. Commissioner Orthwein moved and Commissioner Lynch seconded to approve the proposed historical markers with the language "AlA Historic Scenic Highway ", and the financing taken from unappropriated funds. Mayor Koch informed the Commission that Anne Strawn, an alternate on the Architectural Review and Planning Board has given her notice of resignation. The Mayor suggested that some thought be given for another alternate member at the next Commission meeting and the Board agreed. IX. Public. There was no comment from the public. X. Adjournment.
