F.S.S. 286.0105 MINUTES OF THE REGULAR MEETING AND PUBLIC HEARING HELD BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM ON FRIDAY, JUNE 6, 2003 AT 9:00 A.M., IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Mayor Koch called the meeting to order at 9 A.M. II. Pledge of Allegiance. The Pledge of Allegiance was led by Mayor Koch. III. Roll Call. Present and William F. Koch, Jr. Mayor Participating: Joan K. Orthwein Vice Mayor Fred B. Devitt III Commissioner Robert W. Hopkins II Commissioner William A. Lynch Commissioner Also Present and William Thrasher Town Manager Participating: Rita Taylor Town Clerk Garrett Ward Police Chief IV. Minutes of the Regular Meeting of May 9, 2003. Commissioner Lynch moved and Commissioner Hopkins seconded that the minutes be approved as circulated and all voted AYE. V. Additions, withdrawals, deferrals, arrangement of agenda items. Town Manager Thrasher requested to add Item IX.C. Request for a Construction Trailer at 2435 N. Ocean Blvd.- Walter. There were no objections. VI. Announcements. A. Regular Meetings and Public Hearings 1. July 11, 2003 @ 9 A.M. 2. August 8, 2003 @ 9 A.M. 3. September 12, 2003 @ 9 A.M. 4. October 10, 2003 @ 9 A.M. 5. November 14, 2003 @ 9 A.M. 6. December 12, 2003 @ 9 A.M. Mayor Koch announced these dates. Town Clerk Taylor advised that due to lack of a quorum, the July 11th meeting should be changed to July 10th. There were no objections to this change. A. Recognition of Sgt. John Haseley -10 Years Service Chief Ward presented Sergeant Haseley with a silver key chain and commended him on the exceptional job he is doing for the Department and the Town. As an example, the Chief cited a recent multi - jurisdictional case involving thefts from construction sites wherein Sgt. Haseley was instrumental in apprehending the thieves. VII. Easement request from FP &L- Continued from May 9, 2003. �- Mayor Koch requested to hear this item later in the meeting as Commissioner McCarty, who has an interest in this matter, had not yet arrived. There were no objections. Town Commission Regular Meeting & Public Hearing Page 2 June 6, 2003 VIII. Reports. A. Town Manager 1. Feral Cat Program Update Town Manager Thrasher reported that there were 16 kittens caught and put up for adoption under a special program with the next cycle of trapping starting on the regular date. Mr. Thrasher informed the Commission that Othe Florida Fish and Wildlife Conservation Commission adopted a policy discouraging the TNR program when there is a threat to native wildlife. The Commissioners discussed several methods to eliminate the feral cats. Commissioner Hopkins believed that the Town has exhausted all areas related to eliminating the feral cats, to no avail. The Commissioner is very concerned with the threat of disease and rabies that the feral cats carry. He added that there are residents who have taken action to protect their property, which seem to be effective. The Commission directed Staff to obtain information on darting the feral cats. Commissioner Devitt recommended obtaining approval from property owners to go on their property to dart the cats. 2. Invitation to Florida League of Cities Conference Town Manager Thrasher advised the Commission that the Florida League of Cities Conference is August 14 -16, 2003. The League is encouraging participation from municipalities that have not participated and has offered $1000 stipends to ten elected officials to attend the annual conference. 3. Budget 2003/2004 Discussion Town Manager Thrasher advised that the tentative budget assumes a rolled back millage rate and the CPI at 3.5 %. A fund balance of nearly $1,000,000 by the end of the fiscal year is expected. The Town Manager is proposing to add one more Police Officer, due to the added administrative duties from Homeland Security. Mr. Thrasher explained that the line item budget for the police department and the town hall have been separated, giving an incorrect appearance of a large police budget increase. overall, the total budget remains relatively unchanged because the administration line items have been reduced. The Town Manager asked that the Commission consider annexing the properties west of AlA, from County Road to Sea Road. Mr. Thrasher asked for authorization from the Commission to increase in the water billing rate by 13% and also to request a voluntary increase in the contribution to the Town from the Gulf Stream School to help defray the cost for the CJadditional police officer. In Homeland Security, the school is considered high risk and additional police presence is in order, even to the extent of designating a school resource officer. Town Manager Thrasher ask that the Commission consider the development of a modular master plan for a new building and an optional future fire substation, that would be located north of the maintenance building. He added that the existing maintenance building would remain with minor improvements �\ and architectural enhancements to match the architectural style of the town hall and police station. Town Commission Regular Meeting & Public Hearing Page 3 June 6, 2003 OMayor Koch and Commissioner Orthwein were opposed to annexing properties west of AlA. Commissioner Hopkins asked for more clarification. Mayor Koch directed the staff to prepare an analysis of the properties that would be involved with such annexation. Town Manager Thrasher explained that if the City of Boynton annexes this Oarea, the Gulf Stream Police Department would not have a defined boundary. The Commission discussed the proposed budget items and agreed to include an additional police officer. The Commission authorized the Town Manager increase the water billing rate by 13% and also request additional contribution to the Town from the school. VII. Easement request from FP &L- Continued from May 9 2003. 9:45 A.M. Commissioner McCarty was not in attendance for the meeting. Commissioner Hopkins stated that Commissioner McCarty did not address any of the Town's concerns in her reply to the questions from the Commission, and he believed that the Town should be compensated for granting the easement to FP &L. Commissioner Devitt moved and Commissioner Hopkins seconded to deny the easement request from FP& L. Roll Call: Comm. Devitt; AYE, Comm. Lynch; ' NAY, Comm. Hopkins; AYE, Comm. Orthwein; AYE, and Mayor Koch; NAY. 10:00 A.M. Commissioner Hopkins left the meeting at this time. 4. FDOT Meeting of June 5, 2003 The Town Manager reported that Mayor Koch, Town Clerk Taylor and himself attended a meeting with officials from FDOT regarding the widening of AlA. FDOT is proposing to reduce each lane by 1 ft. and add a 2 ft. shoulder to each side. Mr. Thrasher reported that he expressed to FDOT the Town's position of no change at all to AIA. Mr. George Elmore, a member in the audience stated that widening the road would not affect the drainage but the milling and resurfacing would affect the Australian pine trees. Mr. Elmore added that the 2ft. shoulder that is proposed is sloped and would not be safe for bikers. Mayor Koch added that the meeting was preliminary and there would be further information from FDOT. B. Architectural Review & Planning Board 1. Meeting Dates a. June 9, 2003 @ 8:30 A.M. b. Activity for May 2003 Chief Ward asked that his report be accepted as submitted. IX. Items for Commission Action. A. Appointment of an Alternate Member for ARPB Town Clerk Taylor advised that Rustem Kupi, a potential candidate as an alternate member, was present at a previous ARPB meeting and he was advised by Attorney Randolph that it might be a conflict of interest for him to serve on the ARPB Board as long as he was having development applications reviewed by the Board. She further advised that Attorney Randolph had said he would forward materials to Mr. Kupi for review. The Commission agreed to table this item to the next meeting. B. Items by Mayor and Commissioners. Commissioner Orthwein informed that she has been receiving a numerous calls from Delray residents regarding the widening of AlA. The �) Commissioner added that some Delray residents are soliciting funds from Gulf Stream residents to oppose FDOT widening the road. Commissioner Orthwein requested to put a statement in the Town's newsletter regarding the Town's position on the widening of the road. 11:00 A.M. Commissioner Lynch left the meeting at this time C. Request for Construction Trailer at 2435 N. Ocean Blvd.- Walter Town Clerk Taylor explained that the trailer would be placed at the west end of the property, ten feet from the property line, which meets the requirement. Commissioner Orthwein moved and Commissioner Devitt seconded the approval of the construction trailer. Roll Call: Comm. Devitt; AYE, Comm. Lynch; AYE, Comm. Hopkins; AYE, Comm. Orthwein; AYE, and Mayor Koch; AYE. Mayor Koch referred to a letter from a resident regarding insufficient notification of application for development. Town Clerk Taylor advised that notices for the application were sent out in time and the resident has the option of attending the ARPB hearing via telephone or in person at July 10th Town Commission meeting.
