AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, TO ENTER INTO A
CONTRACT WITH COMMAND FIRE APPARATUS.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The City of Jefferson hereby enters into a contract with Command Fire
Apparatus to trade 4 units (2 each 2004 International Pierce 300/1800 tankers, a 2000
International/Pierce Air/Light unit, and a 1994 Freightliner rescue vehicle which are hereby
declared to be surplus) for the 2005 Pierce Heavy Duty Rescue Vehicle.
Section 2. There is hereby a budget amendment as indicated on Exhibit A.
Section 3. The contract shall be substantially the same in form and content as the
document attached hereto as Exhibit B.
Section 4. Pursuant to City Code Sec. 26A -42(A), the procurement of the services
set forth in this Resolution and the attached contract are hereby declared to be exempt
from the regular procurement procedures of Chapter 26A and may be procured directly by
this ordinance.
Section 5. This Ordinance shall be in full force and effect from and after the date of
its passage and approval.

Contract of Sale
All parties set forth the following agreement and enter into this contract
as follows:
Command Fire Apparatus with corporate offices located at 77 Lanco
Square, Landisville, PA 17538 (hereafter referred to as the Seller) a
licensed Pennsylvania vehicle dealer, offers for sale a used 2005 Pierce
Heavy Duty Rescue vehicle, VIN # 4P1CL01H85A005464 and,
Jefferson City Fire Department (Hereafter referred to as the Buyer), with
offices located in Jefferson City, MO,
Buyer agrees to enter into contract to TRADE 4 units, 2 each 2004
International Pierce 300/1800 Tankers, a 2000 International/Pierce
Air/Light unit, and a 1994 Freightliner rescue vehicle for the 2005
Pierce vehicle and Seller agrees to the following terms and conditions of
sale.
Upon delivery to the Seller of the trade-in units and transfer of the
vehicle and receipt by the buyer of the 2005 Pierce Rescue, the Seller
shall transfer full and clear title and all rights of ownership to the Buyer.
Seller agrees to the following items:
Seller will deliver the 2005 Pierce to the buyer and remove one of the
trade-in units.
Buyer will deliver the remaining 3 trade-in units to the seller, or be
invoiced for ½ the cost of shipping the other units to the seller.
Seller will supply a new DOT inspection sticker on the vehicle.
Seller will remove all existing lettering and decals on the vehicle.
Seller will change all filters and fluids and service all systems on the
unit.
The trade-in units shall be roadworthy and fully operational, shall be
equipped with the basic and fixed equipment as described to us, and
shall have never been involved in a major accident or collision, provided
that the representation regarding major accidents or collision shall not
apply to the 1994 Freightliner rescue vehicle. Seller warrants that the
specifications provided to the buyer are true and accurate.
Specifications of the 2005 Pierce vehicle: 2005 Pierce Heavy Rescue,
Lance 22″ raised roof custom cab with A/C and seating for 6 (5 SCBA),
additional seating for 4 in walk-in rear seating command area, powered
by a 60 Series Detroit Diesel 515HP diesel engine with transmission
retarder, Allison 4000EVS automatic transmission, TAK-4 suspension,
21’5″ Pierce HDR aluminum rescue body with roll-up doors, lots of roll
out trays and adjustable shelves, airbag rack, large coffin style storage
compartments on roof, walk in has separate heat and A/C, 30 KW Onan
PTO driven generator, (2) 200′ electric cord reels, 200′ low pressure air
reel, 26″ extended front bumper with 15,000lb warn winch, 15,000lb
warn winch on rear, 250lb oil dry hopper, 2 Will-Burt Light Towers, 20′
and 10′ aluminum ground ladders mounted inside body with access
through rear, (6) underbody storage boxes, FRC 750W brow light, (3)
FRC 1500W lights each side and (2) FRC 1500W lights on rear, LED
emergency lighting package, electronic siren, dual Grover air horns,
Federal Q2B siren, 49,800 LB. GVWR, Aluminum Wheels, rear vision
camera, ONLY 13,000 MILES, ONLY 1800 engine hours
This contract constitutes the full and complete agreement of sale and is
executed by both parties as set forth below on July 2022:
