IV. Suggestions Related to Controlling the Mass of Structures.
Town Manager Thrasher introduced Mr. Moore, the planning and zoning
director of the Town of Palm Beach who would be addressing the following
subject matters.
A. Points of reference
B. Cubic Content
Mr. Moore distributed an excerpt from the Town of Palm Beach Code with
regard to points of reference and cubic content. He explained that the
cubic content concept is not used as a rule; it is an extension of the
floor area ratio. The cubic content ratio is determined by the volume
of the house to establish the size or mass of the house as it relates to
the size of the property. The cubic content ratio affects the older
homes in the low- density single- family zoning district in which a
minimum lot of 10,000 square feet is required to build.
With regard to the point of reference, the measurement is generally
taken from the crown of the road and the FEEMA regulation of 7 M feet to
measure the height to the top of the tie beam. An additional allowance
is given for the type of roof that would be used, depending on the
zoning districts.

Mr. Frankel expressed that he is concerned about the roof mass of the
newer homes.
Mr. Moore said that they the have the same issue in Palm Beach and
stated that 30 feet to the top of the tie beam is allowed with an
Oadditional 10 feet for a pitched roof.
Commissioner Orthwein asked what the average lot size is in the single
family and the estate districts.
Mr. Moore stated that for simple calculation, 10,000 square feet is used
for the average size lot and for the estate district 20,000 square feet
minimum is used.
Mayor Koch asked if a smaller house is torn down and the foundation not
removed, can they build up on the foundation.
Mr. Moore stated that if more than 50 percent of the volume is removed,
it is considered a new structure and must conform to latest codes.
Mr. Kent stated that Gulf Stream has a maximum roof and eave height but
the newer homes have a cookie cutter look.
Mr. Marsh stated that the Town's Design Manual covers general criteria;
it does not address scale, mass, proportion and the cookie cutter look.
He recommended that the Commission and ARPB provide the architects and
developers a clearer interpretation of what is required, which would be
establishing a clearer point of reference from the top of the tie beam.
Town Manager Thrasher stated that to date, the point of reference has
not been an issue. Mr. Thrasher asked Mr. Moore for clarification on the
cubic content and the illustrated square footage.
Mr. Moore stated the lower the cubic volume of the ceiling height, the
more square footage could be gained. He added that if there are
concerns about the massing, a point of measurement is helpful.
Town Manager Thrasher stated it would appear the one could build a
structure with more square footage than what one could build under the
Gulf Stream code provision
The Commission and ARPB agreed that there need to be variation in the
structures. Mayor Koch added that some variation to the roof style
should be allowed to avoid the cookie cutter look.
In closing Mr. Moore stated that homeowners want the maximum square
footage that is allowed on the property, which is in conflict with the
original structure that was built. Thus the guideline that the Town set
stifles the creativity of the new structure.

Mayor Koch thanked Mr. Moore for attending the meeting and sharing his
knowledge.

Commissioner Orthwein introduced Mr. Moreno who was in the audience and
who submitted a letter to the Commission offering to serve as an
alternate on the ARPB.

A. Town Manager
1. Sea Wall Repairs - Conservation Area (Hidden Harbour)
Town Manager Thrasher distributed an aerial photograph of the seawall
that is in the bird sanctuary conservation area off Hidden Harbour
Drive. He reported that the sea wall is in major disrepair and advised
that it is in the Town's best interest to have it repaired. Mr. Thrasher
advised that the cost of the repair would be roughly $175,000.
Mayor Koch suggested that the conservation area be donated to a non-
profit organization so they can maintain it as a bird sanctuary. He
added that it would still be available to the public.
Town Manager Thrasher advised that giving away the sanctuary could
affect the FEEMA classification for reduction in insurance rates. He
added that residents who are in the flood plane get a 10% discount on
their insurance. The Town Manager advised that the monies could be taken
from the unappropriated surplus fund.

The Commission directed staff to obtain bids and investigate grants for
funding the repair.

Mr. Thrasher asked that the report be accepted as submitted, if there
were no questions.
Mayor Koch asked what the Center for Family Service did for the Town.
The Town Manager explained that it is an employee assistance program
that provides employees with family, financial and legal counseling.
Commissioner Lynch moved and Commissioner Hopkins seconded to approve the
Financial Report. Roll Call: Comm. Devitt; AYE, Comm. Lynch; AYE, Comm.

Commissioner Devitt asked if there were any complaints due to the water
rate increase.
The Town Manager said he had not heard any comments.
Town Clerk Taylor said there were a few inquiries but they were due to
high bills caused by increased irrigation or leaks.

Chief Ward asked that the report be accepted as submitted if there were

VIII. Items for Commission Action.
A. Appointment of ARPB Alternate Member (Continued from 11- 14 -03)
The Commissioners discussed the letter Mr. Moreno submitted offering to
serve as an alternate on the ARPB.
Commissioners Hopkins and Orthwein stated that they would prefer to have
an architect on the ARPB.
Town Manager Thrasher stated that it would be a conflict of interest and
the code does not allow it.
Town Clerk Taylor advised that it is possible to have an architect on the
ARPB if the code was changed.

Anthony Moreno as an alternate member for the ARPB.

of the Town of Gulf Stream will hold a Public Hearing on December 18, 2003,
at 8:30 A.M., and the Town Commission will hold a Public Hearing on January
