Be it ordained by the council of the Town of Wellsburg, Iowa- r lThat be considered owS owner of a dogwhoshall own, or have in charge or harbor l ,the same or allow it to remain in, on, or about his premises to exceed three' clays. SECTION 2. No dog over three Imonths old shall run at large, unless a license to run at large has been pro cured and the license paid, which I license shall be Two Dollars for all male dog, or spayed bitch, and Five Dollars for a female dog, nor unless such dog shall wear a metallic or leather dog collar bearing the license I { tar. Such license shall not be issued' i for a dog known to be vicious or dan- gerous, and no vicious dog whether lic ensed or not, shall be allowed to run at large. SECTION 3. The owner shall annually, before the first day of March, pay the License for that year' and secure a license tag from the Clerk for each dog owned. I SECTION 4. The owner of any dog, after paying such license, shall place upon every animal a collar, with a tag supplied by the Clerk, attached; I stating the number and year given by the Clerk, and such collar and tag shall be kept on such dog during the i 5•ear for which the license is paid, and! no person shall place any such collar on any dog for which the license has not been paid. SECTION 5. The Marshal from and after the first day of May in each' Year, shall make or cause to be made, personal demand of the owner of any l dog for which the license has not been paid, for the license for that year, and, notify the owner to put and keep a collar with the license tag around the l neck of each dog owned. The Mar- shal or person collecting the license'I shall receive Fifty Cents for each dog on which he collects thelicense after May first of each year, which fifty, cents shall be in addition to the license 1 above provided for, and lvhich shall be I I paid by the owner of the dog. I SECTION 6. The ➢larshal or any lother, person appointed by the Mayor in writing, shall kill any dog running 'at large on and after July first of each year, for which the owner has not paid the license, or which dog does not have the collar on, as above required. Any person appointed by the Marshall shall receive a fee to be paid by the city, of Fifty Cents for each dog kill- e( under the provisions of this or other sections of this Ordinance. SECTION 7. It shall be unlawful for any person owing a female dog to permit or suffer her to run at large; when she is in heat, with or without a muzzle, or with or without a license, and every such female dog found run- ning at large, shall be killed by the Marshal or other person designated in writing by the Mayor to kill the 11 .same. SECTION 8. It shall be lawful for .any person to kill any dcvz caught in' the act of worryhiz, maiming, or kill- ing* any domestic animal or domestic! fuwl, or attempting to bite or attack any person, outside the enclosure of the owner of such dog. SECTION 1). Upon the written complaint of one or more persons, i l filed with the Mayor, that any dog; owned by the person named in the complaint is committing injury to per- sons or property, or is an annoyance, dangerous, offensive or unhealthy,; the Mayor shall notify the owner to i restrain such dog from running at large, and keep such dog upon thel promises of the owner, even though the license has been paid. SECTION 10. Whenever the Mayor deems it expedient, or whenever in-! structed to do so by the council, he shall issue his proclamation requiring all persons owning clogs to confine same from running at large, without l being securely muzzled, for a specified, stated, not exceeding ninety days, and it shall be the duty of every person' upon publication of such proclamation, owning a dog, to confine the same by:. ,Good =,efficient means, or cause the j same to be properly muzzled so as to prevent the same from biting any; person or animal. SECTION 11. This Ordinance shall not apply to clogs of farmers and I others coming into, or passing through the Town, but only to such dogs as are owned or harbored or remain within the limits. SECTION 13. Anyone violating; any of the provisions of this Ord- inance, shall, upon conviction, be sub- ject to imprisonment, not to exceed thirty days, or to a fine not exceed- ing One Hundred Dollars. Whenever a fine and costs imposed for the viola- tion of this Ordinance are not paid, the person may be committed to jail until the fine and costs are paid, not to exceed thirty days. SECTION 14.
