Members present: Mayor, Wayne Neddermeyer; Councilmembers, Arthur Theis, Thomas Crosby; Clerk, Donna Roehl; Administrator, Robert Derus; police Chief Charles Director, Ron Duran; Attorney Richard Schieffer; Member absent: Nancy Laurent arrived at 8:00 p.M. November 9, 1978, 1? William Reiser, planning and Zoning Hoover; public Works Engineer, Lyle Swanson. Minutes of October 17, 1978: Thomas Crosby asked that an addition be made to Items 6 and 7, Page 118: "Written reports were filed with the city." Motion by Reiser, seconded by Theis to accept the minutes of October 17th, as corrected. Motion declared carried 1. Motion declared carried Newly Elected officials received the Oath of Office from Clerk, Donna Roehl. 2. PUBLIC WORKS Gayle Johnson, Caterpillar Tractor M. Johnson presented information on road graders: kinds, cost and financing; A 10% down payment is required. Crosby inquired as to the advantage or disadvantage of purchaing a used machine. Johnson reported tbat there would be no warranty and older models are not as streamlined. Nancy Laurent arrived at 8:00 P.M. Crosby stated that he would want to look into the economics of purchasing a 'used or new model, a rental program and what trade-in value the present grader would have. Northwestern Bell Telephone Co. Motion by Crosby, seconded by Reiser to adopt Resolution 78-40 allowing Northwestern Bell Telephone Co. to bury cable at Willow Dr. and Hwy. 55 to serve the Wright -Hennepin Electric building. Motion declared carried 3. HAMEL WELL 124Lyle Swanson reported that work is 95% complete and plans are to start pumping the week of November 13th. Ron Duran stated that they will be flushing hydrants afternew well is operating, perhaps after midnight for several nights. He inquired as to the possibility of notifying customers before flushing begins. 4. HUNTER FARMS ROADS Lyle Swanson reported that roads are blacktopped but there is finishing to be completed and it may be spring before the city can accept the roads as city streets. 5. POLICE DEPARTMENT Security Dogs Officer Jerome LaFond presented information regarding the cost of a security dog. Thomas Crosby asked that further discussion be held when Council discusses the disbursement side of the budget. 6. MINUTES OF OCTOBER 31st. Nancy Laurent agreed to content of minutes although she had not been notified as reported in the October 31st minutes. Motion by Theis, seconded by Crosby to accept minutes of October 31st as presented. Motion declared carried 7. COMMUNITY DEVELOPMENT BLOCK GRANT HhARING, 8:20.P.M. Mark Hendrickson of Hennepin County planning and Programming presented information regarding Year V of the program including a requirement that participants include plans for 3 years rather than just one year. Medina's apportionment will be approximately $90,000Efor the 3 year period. He listed areas in which funds could be applied. Wayne Neddermeyer asked if roads could be built Hendrickson stated that if roads were built in conjunction with housing rahabilitation or if an urgent need arises out of a situation not existing for longer than 18 months. Al Gongaware inquired as to the income level guidelines that are used for housing grants. Hendrickson stated that this is established by local city officials. Ron Duran asked if funds could be used for street lighting. Hendrickson stated that if a neighbozb od is being upgraded funds could be used. Motion by Theis, seconded by Reiser to close the public Hearing. Motion declared carried public Hearing closed at 8:45 P.M. Mark Hendrickson reminded Council that the 3 year program should be ready within 30 days for review by Hennepin County Advisory Committee of which Mrs. Lyman Wakefield is Medina's representative. 8. MINNESOTA DEPARTMENT OF TRANSPORTATION, AL PENT Mr. Pent presented information regarding upgrading and signalizing the area of Co. Rd. 116 and Hwy. 55. He stated the cost of the project would be $600,000. Seventy percent to be paid from Federal funds, remainder by the state and the city would pay from 6-7,000 for the signal plus a yearly maintenance charge. He asked that council set a public hearing for residents to express opinions and reported that the state would be responsible for notification of affected owners. Motion by Laurent, seconded by Theis to hold a public hearing on February 6, 1979, at 8:00 P.M. for discussion of the Hwy 55 and Co. Rd. 116 ugrading and signalizing. Motion declared carried 9. SPRINGER LAND DIVISION Robert Derus presented background of division and concerns of residents living on Bobolink Dr. in Medina Morningside regarding a road being located,on either side of their property. Douglas Wacek asked if city could become involved and relax requirements of the roadway agreement. Al Gongaware inquired as to health problems with regards to dust if road is never blacktopped. Thomas Crosby stated that this is a matter to be resolved by property owners and the city cannot become involved. Mr. Wacek inquired as to whether the city would have the right to condemn a road easement elsewhere if a determination were made that the present location is unfeasible. 125 Richard Schieffer explained that the city would have the power to condemn if a public need were shown. Cost would be borne either by those served or by the entire city. Mr. Wacek asked if requirements shuch as width and length could be relaxed. Mr. Gongaware asked if drainage from road will affect lots in Medina Morn.ingside. Ron Peterson reported that road as it is built has ditches full of water. Thomas Crosby stated that Jeff Chinn, the property owner who has built the road, has been notified that road is not to city specs. Richard Schieffer explained that when a road is built for public purposes by an owner or developer then the city becomes involved with regards to city specifications. Thomas crosby stated he would be willint to relax standards would need a well -thought-out plan. Mr. Gongaware stated t hat the city Council should have denied platting in the Medina Morning - side area. Schieffer explained that if a developer meets ordinances a city cannot deny a subdivision. Crosby adivsed that a meeting of all concerned propery owners should be held and a plan for change be brought to the city. Richard Marklund owner of an affected lot on the roadway stated that when he had appeared be - for the Council 3 weeks previous he was told that there could be no alterations to the road- way agreement so he had goneahead on that assumption and was ready to sign a road building contract very soon. A road that will be built to eity specifications. Thomas crosby stated that he did not know at that time that Medina Morningside residents were opposed but he would be willing to discuss some relaxing of the agreement such as a narrower road, perhaps 4 homes on a road before brought to city specifications and some cul-de-sac changes. Nancy Laurent stated that she would not consider condemnation of another area until a health hazard had been proven. Mr. Marklund stated that the property owners would need to meet with the Engineer and put together some changes agreeable to all. 10. NEIL ERSTAD Robert Derus explained that Mr. Erstad is using his present unattached garage for a workshop and is seeking a variance to construct a second garage on his property located at 1525 Co. Rd. 24. He stated that 2 such structures are not allowed under the Zoning ordinance. Motion by Reiser, seconded by Theis to grant Neil Erstad a variance to construct an agri- cultural outbuilding with the requirement that the approval of all neighboring property own- ers is secured. Motion declared carried 11. KEITH RAVENSCRAFT Mr. Ravenscraft presented a letter from Russ Bouley, Building Inspector prior to 1978, stating that Mr. Ravenscraft had been caught between building inspectors and should not be assessed a penalty for not having secured a building permit. Motion by Crosby, seconded by Laurent to assess Mr. Ravenscraft one-half of the penalty or $93.50. Motion declared carried 12. MARK PEi'EHS ON Robert Derus explained that Mr. Peterson had moved a caboose on to his property on Co. Rd. 24 without securing a moving or a building permit. be stated that such a building is not allowed as a building permit for a house has not been issued and accessory buildings cannot be allowed prior to securing a permit. Richard Schieffer explained tha permitting such an unusual use could lead to an owner asking that a mobile home be allowed as an ascessory building. George Wood inquired as to the intended use and stated approval should only be given if city standards are met. Paul Leuer inquired as to why a building permit had not been issued. Mr. Peterson stated that he had asked police Officer LaFond to find out for him if a caboose would be allowed and Mr. LaFond had reported that Jeanne Mabusth the Planning and Zoning 126 Administrator at that time had stated that it could be allowed. Mr. Peterson stated that he would be using for tools, etc. and some day would make a play- house out of it. He asked if a stipulation could be made that it would never be lived in. Thomas Crosby asked that the matter be tabled until December 5th for further study. Mr. Leuer stated that he would object to its remaining on the property no matter what use it would be put to. 13. SHORELINE TRAILERS Mr. Terrell presented plans for outside storage and landscaping for trailer assembling at the most westerly of the Medicine Lake Bus Co. buildings on Hamel Rd. Motion by Crosby, seconded by Theis to approve plans for Shoreline Trailers and instruct attorney to prepare a development contract covering landscaping to the north consisting of 3-4 ft. spree* trees and 6-8 ft. Maples; Outside stroage to be used for assembled trailers and materials ready for delivery to dealer; Highest point of stacked trailers will be a maximum of 12 ft. Bond amount to be determined by city engineer. Motion declared carried Discussion of load limits on Hamel Rd. and how trucks could deliver material to property. Clerk was asked to contact Bill Cavanaugh and ask that he supply written progress report on roads in the Industrial Park. 14. ROYAL HOMES Robert Derus reported that he had inspected the back variance. motion by Crosby, seconded by Reiser to grant a on Lots 19 and 20, Block 2, Independence Beach. yard variance to be 6 ft. Motion declared carried area and would recommend granting of a set - variance to Royal Homes to construct a house Front yard variance to be 30 ft and rear 15. MIDLAND NuiSERY Mr. Dabrowski presented a mound septic system plan designed by an engineer. Lyle Swanson advised that Council could approve. Motion by Crosby, seconded by Theis to enter into a development agreement with Midland Nursery to construct a building on Hwy. 55, bond amount to be $6950.00. Motion declared carried 16. JESSE THEIS Motion by Reiser, seconded by Crosby to grant a variance to Jesse Theis to build a garage 4 feet from the property line, noting that a letter from adjoining property owner, Father Ardolph for St. Anne Church had no objection. Motion declared carried 17. MEDINA MORNINGSIDE SEWERS Lyle Swanson reported that he would forward copies of their preliminary plan to Orono. 18. TOM WILE DIVISION Motion by Reiser, seconded by Crosby to adopt Resolution 78-41 allowing Tom Wile land division with an administration fee of $100. Motion declared carried. 19. Dabrowski COMBINATION/DIVISION mr. Dabrowski explained that he intends to add Lot 16 to lots as set forth in Resolution 78- 39 and will not be building on it. motion by Theis,seconded by Crosby to amend Resolution 78-39 by adding to item 6, page 2: after "174." the words "before a building permit is issued on Lot 16." Motion declared carried 20. CITY ASSESSOR Donna Roehl reported that she had received names of 3 certified assessors who would be 197 IL I-1 willing to discuss assessing for the city of Medina. Motion by Crosby, seconded by Reiser to hold a special meeting on Wednesday, November 15, 1978 at 8:00 P.M. to meet with applicants for assessing. Motion declared carried 21. MORRISON LAND DIVISION Motion by Crosby, seconded by Reiser to charge Truxton Morrison $695.00, administration, legal and engineering fees for recent land division, charges based on fees charged by the attorney, engineer and city staff. Motion declared. carried 22. BILLS Motion by Theis, seconded by Laurent to pay the bills: Order checks #7711-7772 in the amount of 8 35,864.33 and Pyaroll Checks # 5108-5162 in the amount of $8,945.07. Motion declared carried Motion by Crosby, seconded by Theis to authorize attendance of Robert Derus at a planning sem- inar, charges to be $3.00 and attendance of Donna Roehl at an accounting seminar, cost to be $8.00. Motion declared carried 23. BUILDING SITE SURVEY Robert Derus stated that he would prepare a resolution for the November 21st council meeting regarding a site survey requirement before a building permit is issued. 24. HAMEL WATER Motion by Crosby, seconded by Reiser to adopt Resolution 78-42 authorizing sale of water --°evenue bonds by the city to the Hamel Bond Fund. Motion d eclared carried 25. HOLY NAME CHURCH Motion by Cremby,seconded by Reiser to grant a non -intoxicating malt liquor license to Father Mathias Spier and Holy Name Church for November 12th from 12:00 noon until 6:00 P.M. Motion declared carried 26.NORTHWESTERN BELL TELEPHONE CO. Motion by Crosby, seconded by Reiser to release bond of Northwestern Bell Telephone Co., bond having been posted for completion of landscaping work at 3695 pinto Dr., as per engin- eers advice. Motion declared carried 27. PLANNING COMMISSION/Council MEETING Robert Derus Stated that the Planning Commission requests a meeting with the Council to discuss comprehensive planning. Council agreed that a meeting should be arranged for the Wednesday, November 15th special meeting date. 28. - PAUL WINTER Motion by Laurent, seconded by Crosby to authorize Bill Cleland to attend the hearing for unemployment compensation for Paul Winter on November 14th.
