COMMISSION WITH RESPECT TO ANY MATTER CONSIDERED AT THIS MEETING, SAID
PARTY WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE, MAY
NEED TO INSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH
RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO

MINUTES OF THE SPECIAL MEETING HELD AT THE CALL OF THE MAYOR BY THE TOWN
COMMISSION OF THE TOWN OF GULF STREAM ON MONDAY, OCTOBER 25, 2004, AT
9:00 A.M. IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD,
GULF STREAM, FLORIDA.
I. Call to Order. Mayor Koch called the meeting to order at 9 A.M.
II. Pledge of Allegiance. The Pledge of Allegiance was led by the

Participating: Joan K. Orthwein Vice Mayor
Fred B. Devitt III Commissioner
William A. Lynch Commissioner
Absent with Notice: Robert W. Hopkins II Commissioner

IV. Proposed "Exclusive Method of Voluntary Annexation in Palm Beach
County ".
A. Village of Wellington Law Suite
Mayor Koch explained that the Village of Wellington filed a law suite
opposing the method of voluntary annexation amendment in Palm Beach
County. The Mayor added that the City of Delray Beach and West Palm
Beach have joined Wellington's suite as intervenors.
Town Clerk Taylor stated that she had spoken to the attorney re-
presenting Wellington in the suite. The attorney advised that the
Wellington Council voted to invite any and all municipalities to
intervene in their action. They further voted that there would be no
monetary assessment associated with this except if the municipalities
were so inclined.
Commissioner Orthwein moved and Commissioner Lynch seconded to authorize
Attorney Randolph to file the necessary papers for intervention based on
the information provided by Wellington's Attorney that provisions for the
losing party to reimburse attorney's fees are not present for this type
of action, and the Village of Wellington's word that no monetary
assessment would be made except the intervenors would be responsible for
their own Town Attorneys fees. Roll Call: Comm. Devitt; AYE, Comm. Lynch;
AYE, Comm. Orthwein; AYE, and Mayor Koch; AYE.
Town Clerk Taylor reported that two days after the Commission directed
staff to prepare a resolution urging Palm Beach County Commissioners to
select a site in Palm Beach County for the Scripps project, the County
Commissioners selected a site. The Town Clerk asked for direction
regarding the resolution.
Commissioner Lynch moved and Commissioner Orthwein seconded that, given
that a site has been selected, the resolution was not necessary.

Mayor Koch; AYE.
Commissioner Orthwein commented that she is concerned about the safety
of small children playing in the street. The Commissioners agreed that
Chief Ward should contact parents and warn them of the dangers of small
children playing unsupervised in the streets. Mayor Koch added that a
statement could be added to the Town's newsletter cautioning parents.
V. Adjournment. Mayor Koch adjourned the meeting at 9:25 A.M.
