Allen Sent: Monday, October 13, 2008 8:28 AM To: Chuck Bargeron Subject: Burke permit - Salt Pines Chuck — I have been asked about the permit situation with the Burkes at Salt Pines. Following is what I understand to be where we stand — please let me know if this is correct: On September 29 Hodad visited the site after a complaint was called in regarding work being done without a permit. He visited the site and sent a brief email /report to you and Dianne. According to his email, he saw substantial work underway and delivered a permit application to the contractor. Knowing that he was leaving for a class in Athens, he left the situation with you. Two days later you returned from vacation and Hodad was at a class in Athens. You visited the site, did not see what you felt was enough work to warrant a permit, and decided to hold off of further action until you could talk with Hodad when he returned on October 7th As I understand things from our conversation on October 8 you visited the site after talking with Hodad and told Mr. Burke that the work did not appear to be more than $500 but just to be safe, he needed to get a permit. A permit application was completed stating that the estimated cost of construction is $499.00. When Jay Burke came to pick up the permit and Dianne charged him a double permit fee (as is customary when a contractor /homeowner has been caught working without a permit) some confusion arose because you told Jay that the permit would be $40. There was some confusion and disagreement about whether a double permit fee — or a permit fee at all - should be assessed because the estimated cost of construction is below the dollar amount which requires a permit. They are replacing deck boards, a handrail, and a partition wall. I took them a building permit application and explained the procedure. The contractor called Jay and will bring in the completed application to settle up in the morning. Wrecking, or Renovation The undersigned hereby acknowledges that the issuance of this permit does not in any way grant permission to the owner, owner's representative, or permit holder to proceed with demolition, wrecking, or renovation of a structure prior to the filing of any required ten (10) day "Project Notification for Asbestos Renovation Encapsulation or Demolition" form in accordance with the Georgia Asbestos Rules. The Georgia Environmental Protection Division administers the rules. In most cases, the rules require both the owner and the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the building.
