I. Call to Order. Mayor Koch called the meeting to order at 9 A.M. II. Pledge of Allegiance. The Pledge of Allegiance was led by the Mayor. III. Roll Call. Tr-e- ent and William F. Minutes of the Regular Meeting of April 8, 2005. Commissioner Orthwein moved and Commissioner Devitt seconded that the minutes be approved as circulated and all voted AYE. V. Additions, withdrawals, deferrals, arrangement of agenda items. Town Clerk Taylor requested that Items VII.A.4., FDOT Meeting Update and VIII.E., Generator for Police Department be added. There were no objections. VI. Announcements. A. Regular Meetings and Public Hearings 1. June 10, 2005 @ 9 A.M. 3. July 8, 2005 @ 9 A.M. 4. August 12, 2005 @ 9 A.M. 5. September 9, 2005 @ 9 A.M. 6. October 14, 2005 @ 9 A.M. Mayor Koch announced these dates. Commissioner Lynch advised that he would not be present for the next four meetings but he would be available by phone. Town Clerk Taylor requested that all the Commissioners advise her of their availability as soon as possible. GVII. Reports. A. Town Manager 1. Permit Application Fees The Town Manager explained that Gulf Stream permit application fees have not been adjusted since 1998. He recommended increasing the permit fees and added that the impact on staff wages with regard to handling the permits is forty percent more than the revenue from the permits. He reminded that the fees charged by other towns include building fees and inspections while ours are only for zoning. Regular Meeting & Public Hearing Town Commission Page 2 May 13,2005 The Commission discussed the permit fees and they could not see a justification for the increase. They directed staff to obtain more information from the County regarding their fees to add to Gulf Stream fees in order to make the comparison with other towns. Mr. Randolph explained that whatever costs for review are not covered by fees, have to be met with ad valorem tax proceeds. This adds to property taxes of everyone to benefit only those making improvements. Town Clerk Taylor advised that it is difficult to compare the County's permit fees in that there are different programs where by the contractors pay an annual fee do not have to go to the County for each permit. There are also flat fees for various services that are not based on cost of work. 2. Preliminary Budget Discussions Mr. Thrasher stated that for budget preparation, he is seeking direction on the addition of two more officers for the police department. He added that this would greatly increase the level of service to the town residents. Mayor Koch stated that he was not in favor of hiring two more officers, he believes the police department is doing a fine job. Commissioner Lynch commented that due to the amount of burglaries in Place Au Soleil, the increased visibility of police officers in the area is reassuring and he is in favor of hiring two additional officers. Chief Ward commented that this is the only small municipality on the barrier island that has a school and a portion of the town on the west side of the intracoastal. He advised that having more officer visibility on the west side takes away coverage on the barrier island. Town Manager Thrasher thanked the Commission for their input. 3. Bird Sanctuary Project Update Town Manager Thrasher reported that the seawall at the bird sanctuary has been completed to satisfaction. He stated that the free fill that he was promised from the Town of Ocean Ridge project is no longer available. The Town Manager requested $25,000 to be taken from unappropriated funds for additional fill, a new fence, new trees to replace those destroyed by the hurricane and exotic plant removal and cleanup. The Town Manager added that some residents living close to the sanctuary have offered to contribute funds for trees in the area. Mr. Thrasher suggested in the future, maintenance should be budgeted for the sanctuary. Additionally, the Town Manager stated that historically the access road was considered private. But, through research, it was discovered that 30 feet of right of way was deeded to the town as public road. Mayor Koch suggested that the fence be repaired rather than replaced. Regular Meeting & Public Hearing Town Commission Page 3 May 13,2005 Commissioner Devitt was not in favor of removing the exotic plants and adding new ones. He would prefer the area be left in its natural state. Commissioner Orthwein moved and Commissioner Lynch seconded to approve $25,000 to be taken from unappropriated funds for fill, fence repair and general cleanup at the bird sanctuary. Roll Call: Comm. Florida Department of Transportation Meeting Update The Town Manager reported that he attended a meeting with representatives from FDOT and they are planning to clear and grubb six to nine feet of right -of -way and install a six inch swale beyond the proposed shoulder in Gulf Stream. The proposed work is scheduled for July 2006. He added that the meeting was only for Gulf Stream and he is not aware of what the plans are for the other towns. B. October 27, 2005 @ 8:30 A.M. f. November to be decided Mayor Koch announced these dates. C. Finance Director 1. Financial Report for April 2005 Mr. Thrasher asked that the report be accepted as submitted, if there were no questions. He added that the expenditures are higher due to the purchase of two new police cars but there is nothing unusual. The Town Manager stated that in the past 3 billing cycles, the water loss is down to three percent and the Palm Beach County Health Department has notified the town that the chlorine residual test from Delray is acceptable. Commissioner Orthwein moved and Commissioner Lynch seconded to approve the financial report. Roll Call: Comm. Orthwein; AYE, Comm. Devitt; AYE, Comm. Lynch; AYE, Comm. Hopkins; AYE and Mayor Koch; AYE. D. Police Chief 1. Activity for April 2005 Chief Ward asked that the report be accepted as submitted, if there were no questions, and there were none. VIII. Items for Commission Action. A. Resolution No. 005 -04; A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, REQUESTING A PORTION OF THE COUNTY EMERGENCY MEDICAL SERVICE GRANT AWARD PROGRAM FUNDS FOR 2005 -2006 FOR THE CITY OF DELRAY BEACH, FLORIDA. Town Clerk Taylor explained that this an annual resolution that allows the City of Delray Beach to use the Town's portion of the County Emergency Medical Service Grant Award Program. The funds would be used Regular Meeting & Public Hearing Town Commission Page 4 May 13,2005 to upgrade eight defibrillator monitors and two AED units for the Town of Highland Beach. Commissioner Devitt moved and Commissioner Lynch seconded to approve Resolution No. 005 -04. Roll Call: Comm. Orthwein; AYE, Comm. Devitt; AYE, Comm. Lynch; AYE, Comm. Proposed Resolution: A RESOLUTION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, SUPPORTING AMENDMENTS TO THE FLORIDA CONSTITUTION REQUIRING THE PERIODIC REVIEW AND APPROVAL OF ALL SALES TAX EXEMPTIONS AND EXCLUSIONS IN THE STATE OF FLORIDA. Town Clerk Taylor explained that Florida League of Cities is requesting support to amendments to the Florida constitution that would require periodic review of all sales tax exemptions and exclusions in the state of Florida. The Clerk added that if the Commission supports this proposed resolution it would be numbered 005 -05. Commissioner Orthwein moved and Commissioner Lynch seconded to approve Resolution 005 -05. Road Reduction Interlocal Agreement with Palm Beach County, the Metropolitan Planning Organization and Municipalities. Town Manager Thrasher explained that this agreement provides for 120 day notice if the County or any municipality with jurisdiction over the listed roads desires to reduce the capacity on the roadway or remove the road from the County's thoroughfare plan. He added that only those entities that adopt the interlocal agreement will be provided notice and he recommended entering the agreement. Commissioner Lynch moved and Commissioner Orthwein seconded to approve Road Reduction Interlocal Agreement with Palm Beach County, the Metropolitan Planning Organization and Municipalities. Generator for Police Department Town Manager Thrasher requested funds not to exceed $20,000 for the purchase of a permanent mounted propane generator and that the monies be taken from unappropriated funds. OCommissioner Lynch moved and Commissioner Hopkins seconded to approve $20,000 to be taken from unappropriated funds for the purchase of a propane generator. Roll Call: Comm. Orthwein; AYE, Comm.
