Wheeler November 22, 2005 SPECIAL MEETING BEING HELD BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, AT THE CALL OF THE MAYOR, ON MONDAY, NOVEMBER 28, 2005 AT 8:00 A.M., IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. Consideration of intervening in lawsuit - Delray & Boca vs Palm Beach County. B. DOT Final Engineering Plan Review. VI. Adjournment. SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE TOWN COMMISSION WITH RESPECT TO ANY MATTER CONSIDERED AT THIS MEETING, SAID PARTY WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE, MAY NEED TO INSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED. F.S.S. 286.0105 IN MINUTES OF THE SPECIAL MEETING HELD BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, AT THE CALL OF THE MAYOR ON MONDAY, NOVEMBER 28, 2005 AT 8:00 A.M., IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Mayor Koch called the meeting to order at 8 A.M. II. Pledge of Allegiance. The Pledge of Allegiance was led by the Mayor. III. Roll Call. Present and William F. Koch, Jr. Mayor Participating: Joan K. Orthwein Vice Mayor Fred B. Devitt III Commissioner Chris Wheeler Commissioner Also Present and Participating: William Thrasher Rita Taylor Garrett Ward Town Manager (Late) Town Clerk Police Chief IV. Appointment of a Town Commissioner. Mayor Koch announced that this special meeting is to fill an open position on the Commission with the resignation of Commissioner Lynch. The Mayor suggested Mert Anderson, a member of the Architectural Review and Planning Boardf would be a good candidate in that she is active in the town and the Place Au Soleil Home Owners Association. Commissioner Wheeler commented that he had worked with Mrs. Anderson on the ARPB and believe she would be an asset to the Commission. Commissioner Orthwein moved and Commissioner Wheeler seconded to appoint Mert Anderson as Commissioner. Roll Call: Comm. Orthwein; AYE, Comm. Devitt; AYE, Comm. Wheeler; AYE and Mayor Koch; AYE. Mayor Koch recommended that Commissioners Hopkins and Lynch be recognized for their years of service to the town. He directed Commissioner Orthwein to be responsible for the arrangements. V. Items for Commission Action. A. Consideration of intervening in lawsuit - Delray & Boca vs. Palm Beach County. Town Clerk Taylor explained that the Cities of Boca Raton and Delray are currently co- plaintiffs in a lawsuit against Palm Beach County regarding funding countywide fire - rescue dispatch functions from the general revenue budget instead of the MSTU, designated to pay for services rendered to the benefiting recipients. The Palm Beach County Municipal League is suggesting that municipalities join the lawsuit to reverse this assault on Home Rule. The League advised that this would not cost the town any monies other than nominal filing fees. Commissioner Wheeler moved and Commissioner Orthwein seconded to join the motion to intervene. Roll Call: Comm. Orthwein; AYE, Comm. Devitt; AYE, Comm. Wheeler; AYE and Mayor Koch; AYE. Special Meeting Town Commission Page 2 November 28, 2005 B. DOT Final Engineering Plan Review. Town Clerk Taylor reported that DOT has sent final engineering plans for the milling /resurfacing in Gulf Stream. The plans show the 3 ft. addition on each side from George Bush Blvd. to the Gulf Stream Golf Club and commencing again on the west side from about half way between Lakeview and Banyan to Sea Road, and only a small amount on the east �jside in the area of the Gulf Stream Shores Apartment. There is a project meeting scheduled for December 7, 2005, at 9:00 A.M. in the Town of Ocean Ridge's parking lot. The Town Clerk stated that she had spoken with Bing Wang, Project Manager, and she was under the impression that all the plans were finalized and accepted by the town. Commissioner Wheeler asked if there is anything the town could do to stop the project. Commissioners Orthwein and Devitt agreed that it seems that DOT is proceeding with their plans without the consent of the town. Mayor Koch stated that DOT could be taken to court to try getting an injunction to stop the project. He added there has not been any response from DOT regarding the town's letter requesting that DOT relinquish jurisdiction of AlA in Gulf Stream to the town. The Mayor suggested that the Town Manager unofficially attend the December 7th meeting. It was noted that recommendations are needed to appoint two regular and one alternate ARPB member at a future meeting. Mayor Koch asked the status of the Jamaica Square Parking situation. Town Clerk Taylor advised that she had spoken Mr. Sherer, of Jamaica Square and DOT has agreed to allow residents to park in front at a lesser angle and park the larger cars at the northern end which has more width. DOT requested that the bushes in front of the wall be replaced with vines. X. Adjournment.
