ORDINANCE NO: 560 AN ORDINANCE CONCERNING THE AMENDMENT OF CHAPTER 5' ARTICLE 2, SECTION 5.2.2 oF THE CITY CODE oFBEL AIRE' KANSAS, IN CONNECTION WITH ASSESSMENT OFCOURT COSTS, ALL WITHIN THE CITY OF BEL AIRE,SEDGWICK COUNTY. KANSAS. WHEREAS, Charter Ordinance 6 of the City of Bel Aire exempts itself from, and makes inapplicable to itself, the provisions of K.S.A. l2-4I12, regarding municipal coun cosrs, and provides that substitute and additional provisions may be made by r"grl- Ordinance; WHEREAS, Additionally, K.S.A. 12-4117 specifically mandates that a sum of $20.00 be remitted to the State for every municipal court case, other than a nonmovins traffic violation, resulting in a conviction; and WHEREAS, The City of Bel provides for the assessment of municipal court assessments within Bel Aire Municipal Code, as adopted by Ordinance. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BELAIRE, KANSAS: SECTION 1: Amending Section 5.2.2 of the Ber Aire Municipal code. Section 5.2.2 of the Municipal Code of Bel Aire, Kansas is amended to read as follows: Pursuant to the authority granted by and through Charter Ordinance No. 6, whenever any person is convicted of a violation of any provision(s) of the Municipal Code of theCity of Bel Aire, other than a nonmoving traffic violation, the offinder shall be assessed costs for the administration of their case in Municipal Court. The GoverningBody shall establish such cost within the City of Bel Aire Schedule of Service. License and Permit Fees. This cost shall include a $ 3.00 assessment for the purposeof paying for the fees of court appointed attorneys in those cases in which the defendant is found not guilty or deemed indigent; a $ 5.00 assessment for City police training; and a $ 3.00 assessment for court system enhancements. Additionutty, ttr"Municipal Court Judge shall assess to such cases, the costs assessed against the Cltyby Sedgwick County for each day or portion of a day such person r"ru"d injail at the same rate that the City was charged for such jail time by Sedgwick County. Thecurrent rate charged the City for jail time shall be included as an entry in theMunicipal Court's fine schedule. In addition thereto, the Judge of the Municipal Court shall assess all State imposed fees as required by statute. SECTION 2. This Ordinance shall take effect and be in force from and after itspublication in the Ark Valley News, an official city newspaper. Passed by the City Council this 3rd day of February, 2015.
