AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
THE VILLAGE OF KEY BISCAYNE, FLORIDA; AMENDING
ARTICLE IV "FINANCE" OF CHAPTER 2 "ADMINISTRATION"
BY CREATING SECTION 2-75 "FIRE RESCUE TRANSPORT FEE",
TO PROVIDE FOR FEES TO BE IMPOSED FOR FIRE RESCUE
TRANSPORT SERVICES PROVIDED BY THE VILLAGE OF KEY
BISCAYNE FIRE RESCUE DEPARTMENT; PROVIDING FOR
INCLUSION IN CODE; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Village of Key Biscayne Fire Rescue Department ("Fire Rescue") provides
medical rescue transportation service to sick, injured or incapacitated persons; and
WHEREAS, it is necessary to implement a service fee for Fire Rescue transport services to
help offset the costs of the provision of such services.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the above stated recitals is hereby adopted and
confirmed.
Section 2. Code Amended. That the Village Code of the Village of Key Biscayne is hereby
amended by amending Chapter 2 "Administration", at Article IV "Finance", by creating Section 2-75
"Fire Rescue Transport Fee," to read as follows:
Section 2-75. Fire Rescue Transport Fee.
(a) Fee,
The below listed service fees shall be charged when Village Fire Rescue
provides Fire Rescue transport services to any person, by which such person is
transported to a medical facility by Village Fire Rescue.
(b) Schedule of Fees.
(i) The Schedule of Fees is that which is set forth on Exhibit "A", a copy of
which is attached hereto and incorporated herein, subject to any regulatory
approval required from Miami -Dade County pursuant to Chapter 4 of the
Miami -Dade County Code.
(ii) The service fees described above shall constitute the initial Schedule of Fees
which may be amended from time to time by resolution of the Village
Council, subject to any further regulatory approval required from Miami -
Dade County pursuant to Chapter 4 of the Miami -Dade County Code.
(c) Billing and Collection of Fees.
The Village Manager is authorized to establish billing and collection
procedures to provide for the collection of the service fees from the patient,
responsible person, and health insurance carrier of each person receiving
basic or advanced life support transportation service, and is authorized to use
the services of billing, account management, and/or collection companies in
order to accomplish billings, account management, and collections in
accordance with applicable law.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and
if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion In The Code. It is the intention of the Village Council, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the Code of Key
Biscayne, Florida; that the sections of this Ordinance may be renumbered or relettered to accomplish
such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate
word.
Section 5. Effective Date. This Ordinance shall be effective immediately upon passage by
the Village Council on second reading.

certificate holder and Miami -Dade County or to transportation pursuant to direction by the fire chief having territorial
jurisdiction."
NOTE: The Village Clerk may insert date of B.C.C. approval.

The proposed Ordinances may be inspected by the public at the Office
of the Village Clerk. Interested parties may appear at the Public Hearing
