Work Session 2-2-16
A. Roll Call
The City Council of the City of Tiffin Johnson County, Iowa, met in a work session
February 2, 2016 at 6:08 p.m. Mayor Berner called the meeting to order. Upon roll being
called the following named council members were present: Jim Bartels, Al Havens, Jo
Kahler, Mike Ryan. Absent: Peggy Upton (Arrived at 6:1 1pm). Also present: City
Administrator/Clerk Doug Boldt, City Engineer Ben Carhoff, Deputy City Clerk Ashley
Platz, other visitors.
B. Agenda Additions/Agenda Approval
Motion to approve work session agenda by Havens.
Second by Bartels
All ayes, work session agenda approved.
C. Discussion of FY 2016-2017 Budget
Peggy Upton arrived at 6:1 1pm.
Doug Boldt, City Administrator- presented FY 2016-2017 Budget to City Council.
Discussed the Liability, property & self-insurance costs and debt service levies. Currently
on this preliminary budget the current levy is 11. 803 04 which is slightly lower than last
year's levy at 11.80309. Doug reiterated that this is still a preliminary budget and there
might still be small adjustments.
Group items needed for next years budget:
Parks- New mower — would trade in 2 older mowers to get one mower for park & ballfields
Building Official- Pickup truck for his Inspections.

Public Works- Soil pulverizer and a valve turner. Gas powered pole installer. Water loading
station.
City Hall- Furniture — Desks with drawers, cabinets, files, more storage.
Christmas Decoration lights for Ireland Avenue.
General Inventory for any park equipment that is needed or needs updated.
Mayor requested more extensive road patching.
Upton- Electronic Sign at City Hall?
Ryan- Trees along Ireland Ave? Doug advised there will be bushes along the fencing.
Upton- Warning Siren is needed. Doug requested that we use the Emergency fund for that
purchase.
D. Discussion/Questions from Council Members regarding items on the Regular City
Council Agenda
Upton advised would like to update Minutes: G-1 public hearing should reflect that nothing
was received at city hall and also no public comment. I-4 to reflect Upton's motion to add
"process of council approval" gets added to the document"
Discussion on Resolution 2016-011 about the setting the public hearing amending C2-13
business list.

The City Council of the City of Tiffin, Johnson County, Iowa, met in regular session
February 2, 2016 at 7:04 p.m. Mayor Berner called the meeting to order. Upon roll being
called the following named council members were present: Peggy Upton, Jim Bartels, Al
Havens, Jo Kahler, Mike Ryan. Absent: None. Also present: City Administrator/Clerk
Doug Boldt, City Attorney Raiber, City Engineer Ben Carhoff, Public Works Director Brett
Mehmen, Deputy City Clerk Ashley Platz, Building Official Brian Shay, and other visitors.

Upton advised would like to update Minutes: G-1 public hearing should reflect that nothing
was received at city hall and also no public comment. I-4 to reflect Upton's motion to add

Council Minutes by Upton.

Motion to open Public Hearing on an Ordinance Reaffirming the Minimum Wage
Requirements set forth in Iowa Code Chapter 9 1 D and Declining the Johnson County, Iowa
Ordinance Deviating from the Provisions of Chapter 91D of the 2015 Code of Iowa for
Persons under the Age of 18- by Bartels.

Public Comments:
Melissa Arey- 730 Timber Ridge Ct- Wanted to talk about the amount of students on free
and reduced lunch.
Lisa Green -Douglass- 3117 230th St North Liberty- Justice of the Tiered wage.
Discrimination of age with younger individuals, can it be done on older people, what about
your race? Religion? GPA? Questions the legality of this ordinance.
Kate Fitzgerald- 718 Blue Jay Ct- Lets not have Tiffin become a town that discriminates.
Jill York- 609 Redbird Run- Kids under 18 shouldn't be paid less, equal work with equal
pay.
Beverly Marshall -Goodell- 239 W 2°a St- Proud to live in a community that is growing and
encouraging young people to work. Encourages that they get an equal wage.

Miriam Agular- 460 Roberts Ferry Rd- Speaking behalf of her kids who are great students
with a 4.0 GPA. Her kids are in high school are wanting to work to save their college.
This ordinance is allowing and showing those under 18 that they are not valuable nor do
Misty Rebik - Director of Center for Working Justice- Knocked on doors throughout Tiffin.
Worked at age 14 as a server and worked until she went to college. Ch 91-D 90 days of
employers of a probationary period of a lessor wage.
Ben Upchurch- 230 W 2nd St- confused as to why this was brought up again. Equal wage
for their work.
Nicole Upchurch- 230 W 2nd St- Civil Rights issue and it is a way to keep people down.
Listen to the residents and their concerns
Rory San Porter- Iowa City Residents- It is hard to pay rent in Johnson County and in Iowa
City. Spoke about all the types of people she works with. Families living together because
they cannot afford rent to live in Iowa City. Wanted to represent the African American
community- People come here to do better and live better. We don't need any more
discrimination in this County.
Marcel Hurtado- Lives in Iowa City- I think that isn't right to pass the ordinance to lower
the minimum wage. According to the constitution of this country, everyone should be
treated fairly. I believe we all have the right to work and receive a fair wage.
Nathan Keso- When he was younger he had a single mom, so he had to work a lot to pay
for his lunches at school and pay the bus fees to get educated. Point of minimum is to set
the floor to stand on not to go below.
Discussion:
Faron VanNostrand- email received from 729 Timber Ridge Ct-
DeeDee Madden- Mike Ryan spoke to her and relaying her comments- This send the wrong
message and we are a progressive community and this ordinance send the wrong signal that
the image of the Community would falter.

2. Ordinance No. 2016-381 — Ordinance Reaffirming the Minimum Wage
Requirements set forth in Iowa Code Chapter 91 D and Declining the Johnson
County, Iowa Ordinance Deviating from the Provisions of Chapter 91D of the
2015 Code of Iowa for Persons under the Age of 18
a. Motion to Approve First Reading and Proceed to Second Reading
Discussion: Al Havens quoted State of Iowa Department of Labor Chapters 2015 Ch 92
about 16 years old and under and the limitation of the duties and hours they are able to
work. His concern is with attracting businesses that would need a high number of
employees due to the $10.10/hr. His point is that if workers are under the age of 17, they
are not able to do certain work than 17 & older can do.

Mike Ryan- Spoke about tiered minimum wage. Suppressing wages for kids and everyone
is wrong. Mike advised that this ordinance is child exploitation and discrimination.
Businesses will not absorb this cost, only consumers, and all these residents here tonight
requesting to obey the Jo Co minimum wage are aware of this and like him are willing to
pay a little more to allow people to make a living wage.
Doug Boldt wanted to clarify that the Department of Labor is what Al Havens & Mike
Ryan have referenced.
Jo Kahler- Spoke about her position on the wage.
Mayor Berner- advised he has a friend that is a Manager of a retail business, and the fact is
that minors are being paid more but their hours are getting cut to offset the cost.
Peggy Upton- She is torn on this issue, and appreciates the arguments from both sides. She
agrees that the minimum wage should be increased and she doesn't believe $10.10 is a
livable wage. She feels that in this community the impact of this ordinance is minimal and
will not impact many people. She advised she represents everyone in the community, not
just the low income; she also represents the business owners and all residents of Tiffin. She
wanted to point out that working a first job gives you more than just money in your pocket.
It provides real life experience, operate cash register/equipment, learn how to work, how to
be a valuable employee; you gain a lot from your first job and they are not always on your
paycheck. Money isn't the only thing.

Ordinance Deviating from the Provisions of Chapter 91D of the 2015 Code of Iowa for
