Members present were: Roberts Present Fogg rr Ruark Burnside Fortin Absent The Chairman declared the purpose of the meeting, was for the consideration of the issuance of the whiskey license of the Green Lantern Par, following the arrest due to a violation of the law. Rhodes reported to the Board on the Green Lantern operating without a whiskey license following expiration of the 1960 license on December 31, 1960. He also reported that the County license was not received until January 4, 1961, at 2:30 p.m. He reported an arrest had been made and a trial set for the following Saturday night at 8:00 p.m. and recommended that the license be held until the matter was settled. Following discussion of the Board it was the opinion the license be held until the trial date or upon advice of attorney be license be released. No further business coming befcre the Board the meeting was declare recessed until the call of the Chair. P'airman Clerk : ATTCST January 9, 1961 A regular meeting of the Board of Trustees of the Village of McCall, Valley County, Idaho, was held on the above date and the following business transacted. Members present were : A'oberts Present Fortin 01 Fogg rr Ruark Excused Eurnside Fogg moved the meeting of December 5, 1960, be adjourned, which motion was seconded by Fortin and declared carried unanimously. The minutes of the previous meeting were read and approved as read, and the reading of the minutes of the special meeting were delayed until the next regular meeting. Ackaret reported that nothing had been accomplished with the rural fire department truck as yet, however, a future meeting with the Board was advised. Roberts reported he had been contacted about the water on Floyd Street and Fogg reported that he had contacted hchesons and other residents involved in the question, however, he had made no definite commitment as to what action the city would take. No. 50 RECORD OF PROCEEDINGS The leasing of the hangers at the McCall Airport was discussed and Fogg reported he would have the leases drawn after conferring with Remaklus. Roberts reported that several of the Christmas tree lights were burned out and should he replaced. Rhodes was instructed to contact the Idaho Power Company and have them replaced so the lights would be availabe to be turned on for special occasions. The question of the Chief of Police issuing driver's permits was briefly discussed and it was felt the matter should be tabled until a full Board was present Roberts reported he was wcrkincx with Remaklus on the spraying program and possibly some type of assessment plan might be worked out in the future. The question of water and sewer charges were briefly discussed and Fogg stated he would have a recommendation at the next meeting on sewer charges. Fortin moved that the lease on the McCall Municipal Airport by Johnson Flying Service by renewed for the 1961 year, a check having been received for same, which motion was seconded by Fogg and declared carried unanim usly. %roberts reported that two members of the Hospital Board's terms had expired and it was the opinion of the Hospital Board that Marge Ulmer and Corey Engen be nominated to serve another term. Should they not accept, Arnold Souders was suggested as one of the replacements. The future lighting of the airport was briefly discussed and Fogg stated he would have a plan for the lighting of the airport in the near future. Roberts reported that the 250 watt police base station would be in operation in the next few days; the antenna and other necessary apparatus had been received. N° 5 2 RECORD OF PROCEEDINGS The minutes of the previous meeting were read and approved with the correction being noted that the police radio was a 50 watt -station in lieu of 250 watts. Following discussion of ti;e revenues in the water revenue fund and the sewer revenue fund, Fogg moved the transfer of '=5000 from the sewer revenue fund and 5000 from the water revenue fund to the general fund be approved. The motion was seconded by Ruark end declared carried unanimous ly. Bob Vi L l iamson, who was present, discussed the hard-topping; of gather Road and also the outflow of sewage into the river below the fish hatchery. Roberts stated the request for the hard-topping of the road would be considered in the new budget which would be compiled in the near future. 1-egardinci the sewer outflow, Roberts stated the i'oard had conducted surveys and was aware that the sewage should be disposed of through a treatment or disposal plant. Present moneys from the sewer system are p led, ed to the bondholders so the funds cannot now be spent for any type of treatment plant . The possibility of changing the outflow is not feasible at this time, althcurh in view of the developments regarding the sanitation of streams and etc. , it is very probable something will be done in the future. Pi l l iamson stated that as the water is contaminated the stream should be posted so people would not fish nor use the water n that area. Regarding the paving. of the rood, it was also reported that the road should be widened prior to any ailing project and also engineered so it would bold the oil . dillia.mson discussed the need for the oil and the amount of travel on the road. 'lemakius stated he would have an airport report in the near future. Remaklus stated he 'read contacted Nestcctt regarding the changes of the met' od of purchase of the '.''e`esicott Gil property to provide relief on the county taxes and that Ike Vestcott was going to contact him. A possible deed hack arrangement was proposed. Remaklus also reported on the golf course proceedings and stated he would file an amended complaint following the letter from Judge Norris. Remaklus also reported that he had found nothing in the law to set up a dump taxing district which would be applicable to the village. On the mosquito spray program a petition could be presented to the commision to see if a district could be created and a tax levy made to cover this expense. the commissioner's authority to establish dump zones was discussedbut there were not taxing authorities for the zones. 'he administration of the dump, the employee for the dump, and the sanitary land fill aareerr..ent are problems yet to be worked out. Remaklus stated hewould make another check on the county powers to tax for a dump district. 0urnside briefly reported on the fire truck for use outside the Village limits and stated a meeting; should be held with all interested parties. Roberts reported on a meeting with the Forest 3rrvice on the proposed lighting of the airport and stated that an Idaho Power engineer had requested plans to proceed with the wiring and lighting. Remaklus briefly reported on proposed bills in the legislature which would affect municipalities. There followed a short discussion on Village elections to be held in April. The issuance of driver's licenses by the Chief of Police for the N0 53 RECORD OF PROCEEDINGS county was briefly discussed and Ruark stated it 'would Le convenient for the people of McCall to h- ve this service, but not as a prelude for the functions which should he performed by the county sheriff 's office. Foga stated he had contacted all members of the old zoning committee. Henry Allen, Sob Williamson, and Warren Brown were not serving, however, Frank Brown, Crid nowles, and Lon Burdett had agreed to serve. Jim Green stated he would serve until transferred. he Zone Commission now numbers six members and suggestions were made to name another member to the Board. Cecil Stowell was tentatively selected and Fogg stated a zoning meeting would Le called next week. The recently constructed wino at the McCall Memorial Hospital was discussed and following receipt of the final payment by the architect, Fogg moved the new wing be accepted by the Village of McCall. Burnside reported an inquiry by a golf pro on the operation of the i`cCall Municipal Golf Course and the possibility of a change was briefly discussed. Ackaret reported that fluorine was being added to the Village water. Rhodes was instructed to check the Christmas tree lights for burned- out bulbs. The several bills were read for payment. February 14, 1961 A continuation of the regular meeting of the Board of Trustees of the Village of McCall was held on the above date and the following business transacted. I''embers present were : Roberts Present Ruark Fortin burnside " Fogg Excused Roberts stated the special meeting was called at the request of the police commissioner and Ruark was appointed acting Chairman. Ruark stated the special meeting was called for the purpose of considering F. E. Petrie as relief officer for the Village of McCall . Ruark briefly reviewed the history of employment of Petrie by the Village and recommended that he not be employed as the present arrangement is satisfactory as far as relief is concerned. The several Board members discussed the resignation as Chief of Police by Petrie and his actions following the resignation. Rhodes briefly reviewed Petrie 's application for cork as the relief officer and his reasons for the request for employement. Following discussion on the application it was the unanimous opinion of the board that present arrangements were satisfactory and he not be employed by the Village of McCall . Burnside reported the police car parking in areas which had been marked no parking at any time, which did not look good for the enforcement of the law. Ruark reported that he and noberts had met with the commissioners and the sheriff, and it was agreed to have a lady in town from 1 to 5 every Monday to issue driver's licenses. Also the sheriff or a deputy would try to be here. The Valley County would pay the Village of McCall ;j25.00 per month for this service. Members present were : Roberts Present Fogg rr Ruark Burnside 'r Fortin Absent tuark moved the February meeting be adjourned, which motion was seconded :::y Fogg and declared carried unanimously. The minutes of the previous meetings were read and the correction was noted reaardinc the issuance of drivers ' licenses by the county, that the county was paying the individual for the licenses, not the Village. The minutes were approved with this correction. Regarding the purchase of the 'estcctt Gil dompany and the proposed change in the method of deeding same, Remaklus stated that as yet Nes tco t t had not contacted him. Remaklus briefly reported on the golf course condemnation r:roceedings and stated he had written Judge iLbert Norris on the arrangement between Allen Shepherd and himself and the filing of the amended cc.m La ins a9brief. An airport lease agreement to be used by the Village of '''cCaL l wit,= the owners and lesees of the hangers recently constructed at the airport was presented by A emaklus. "e stated the lease agreements were not complete as he had several questions wiirh should be further discussed by the •oard. The lease was read in full, following which several points were discussed, such as recourse by the Village when rent was not paid. A lien foreclosure clause was discussed and also a reversion clause to the Village of McCall . Following discussion, Remaklus stated he would draw up a lease incorporatina these points. Regarding the airport lighting, Roberts stated that the surplus wire which was to be used by the Village for the lighting project had been acquired by Bill Bacon of the Forest Service, although it was necessary for him to have clearance from the Federal Aviation Agency before it could be used. 'roberts read a letter from the FAA to Bill Bacon stating that they could not give their approval to this surplus use of the wire because of a prior agreement the Village of McCall had with the Federal Aviation Agency which had been cancelled by the Village and there were still yet items such as the knoll at the south end of the field which had not been cleared. There followed a discussion on the requirements which would be done by the Village of McCall to have the FAA give a clearance for the use of the wire for the lighting project. Following discussion of the points made by the FAA, Fogg stated he would discuss the matter further with Chet / oulten. A letter from the Sanitary Refuse Company was read, regarding a franchise for the dump operation in the Village of McCall . Roberts reviewed the N? 56 RECORD OF PROCEEDINGS County Commissioner's view of appropriations for garbage collections, dump zones, and the various taxing powers. Forg reported on a meeting in Poise with the State Health Department, Department of Reclamation, and the county, and stated that House Bill 71 was passed, which was attempting to prevent or curb stream polution. The polution of Payette 'ake and Cascade reservoir were discussed at length and the best method of taking care of the polution appeared to ,be on a county level . Fogg stated that the recommendation of the Poise meeting appeared to be for the county to appoint a sanitation officer to sell permits and enforce the state laws regarding the installation of cesspools and polution. There followed a discussion on the possible solution for lake-stream polution due to sewage. In view of the circumstances regarding the possible participation of the county on the operation of the village dump, no action was taken on the request of the sanitary Landfill Company regarding a franchise. Durnside reported that Charles May had r,sianed as the operator of the Golf Course and he had one local application for the position. He stated Tod Close had applied and wanted to give golf instructions in addition to taking care and maintaining the course. Burnside stated he had a letter from another man who wanted to just give instructions here this summer. There followed a discussion •en the possible replacements to run and maintain the golf course and Burnside stated he would meet with his advisory board for an comments they might have and report to the Board at a later meeting. Burnside also reported on a fire distr ,t mee7tna with approximately eighteen to twenty peo^ le present. Bi Ll Mel on ✓✓as working on the drawing up of the fire district and the men were circulating petitions in different areas as far south as Donnelly. Following the signing of the petitions they would be token to the County Commissioner for an election to be held for the creation of fire district. The area of the district would e::clude McColl . Additional meetings would be held concerning the use, storage, etc. of the fire truck. Fogg stated the f'oninc C; mmission had had three meetings since the last Board meeting and now consisted of Fogg, 'oberts, Frank Brown, Lon Burdett, Grid Row/es, von Beaus, and Jim Hockaday. Fo_r,.c stated the zoning maps from the Idaho Municipal League do not include all the Village and were too small to adequately determine all locations in the Village. Fogg stated he had contacted Grid Fiowles for a map which had been made at the time the Telephone Company installed its new telephone lines, although the map appeared to be on too large a scale and would have to be redrawn. "e stated he had contacted Toothman and Company Architects in Poise and the estimate to redraw the maps • gas approximately :`:-250. 00. Foga stated he had contacted Byron `-ochrane who had estimated approximately 960.00. "e discussed the possibility of using the maps drawn for the sewer extensions, which could be added to from other information available. Following further discussion it appeared to be the opinion of the Board that the larger maps of the Telephone Company could be used and placed en the wall to make one map of the Village. A letter from the Idaho Credit Union League regarding a congratulatory letter for the 25th anniversary for a convention to be held in McColl was read to the Board. Also a letter from the raise Chamber of Commerce regarding a TV show honoring each town in Idaho was read to the Board. The date McCall was to be honored was November 15, 1961. It was noted that Village elections would be held on April 25, 1961. Regarding the Green Lantern, Rhodes reported the possibility of the state requesting a voluntary thirty-day suspension of license of the operator, and recommended that the Village suspend their license for the same period. The actions of the state net being definite regarding the suspension, no action was taken by the Village. N° 59 RECORD OF PROCEEDINGS : emaklus stated he had nothing to report on the airport leases at this time. Regarding the proposed lighting of the airport, Foco stated he had contacted Chet Iqoulten and he had requested a copy of the letter from the Federal Aviation :agency and he seemed to he of the opinion that we could proceed with the lighting project either with other materials, or we could possibly clear the wire which is new being held the Forest :Service. There followed a discussion on the lake and water pollution and the Fayette liver and Fayette Lake and a meeting held to hove the County draw an ordinance to set up inspection for cesspools and se tic tanks. The possibility of having some one tear down the building for the salvage value was discusood and Burnside stated he would talk to some one interested in the salvage value or cet an estimate to tear the buildinc down. The recommendation by the committee was to complete the demolition on the building. 4. P. Stanley, who was present . regarding the payment of the balance of the gravel purchased by the Village of !McCall, offered a discount in the amount of S300. 00 if full payment in the amount of :4629. 30 could be made in the near future. The matter was to be considered by the Board in the light of budget li.mitotions. A meeting with the county commissioners on the pollution of the river and lake and the dump was tc be made as soon as possible. There followed a discussion on the dump operation in connection with the request of the Sanitary Land-Fill Company and until such time as any assistance from the county mirht be determined the Village was not in a position to make any commitment to the Sanitary Lan. -Fill Company at this time. Lurnside stated he had no report on the fire district at this time. Burnside briefly reported on the golf course, the condition of the greens, fairways, and the progress Elmer Allen appeared to be making on the course. He reported on fertilizer purchases and the proposed power sa',' to be used in fencing and clearing. He stated a young man wanted to rive lessons and install a junior golf program in the Village and out- line the program which the Village would pay far. He also stated the applicant would do the starting and police the course, working six days a week. He also would set up handicaps for members and work with the greenskeeper for 300.00 per month or ` 600.00 per scason. Ladies would also receive free instruction as well as private lessons if they so desired. Following discussion of the program, no objection was had by the Board. Fogg stated he hada report from one of the lessors of the Village airport and the ease agreement as proposed appeared to be in correct form with no objections. Fogg reported a communication with Chet ioulton on the lichtina of the airport and it appears the Forest Service may be able to release the wire for our use with a tentative dote to start construction of June 20, 1961. Fogg reported on the zoning commission meeting and stated another one would be held this week. additional zoning maps and pomphlets should be available for any hearings. The minutes of the previous meetings were read and approved as read with the clarification on the Golf Course instruction, that the free instruction for women be on Mondays only. Ray Beseker who was present requested he not be sprayed this year when the Village sprayed for mosquitos because of damage to his rasberry crop. Bob Williamson was present regarding the proposed road budget for the Village of McCall and stated he could raise approximately $500 for work on the road adjacent to the river. Fortin suggested that the road be straightened oat prior boiling and the possibility of doing some improvement on the road this fall. Bill Deinhard who was present discussed the vandelism and window breakage in the old school building. He read estimates to replace the broken windows in the amount of $90 if he takes the windows out and they are replaced by May Hardware. Police Chief Rhodes stated the guilty parties are known and an investigation is being made. Alsuch time as the Police feel they have thep?L . guilty parties the parents and children will be made to pay for the damages. The Clerk briefly reported on monies received from the County on the airport reimbursement. Burnside reported on the trailer parking area adjacent to Hardy's Boat Dock and stated that old log booms would be used for a sea wall to fill against. He stated the County would assist with the gravel hauling and also with boat license monies. Fortin briefly reported on the dump operation and stated it appeared to be operating satisfactorily. The dump master was to get the information from the users of the dump as to the location of the people dumping that is inside the Village Limits or from other areas. Regarding the Golf Course operation, Burnside reported that all but three greens will be open this week-end. He reported on severalcomplaints received because of the temporary greens. The greens keeper seems to be working out satisfactorily. He reported a request of the Lions Club to assist or operate the Golf Course. Burnside reviewed the progress of the Golf Course on the greens, spraying and fertilizing. A letter from Ronald J. Hamilton regarding the use of his property by the Village of McCall and the request for the Village to setze use of his property was read to the Board. Remaklus stated he had called Allen Shepard, Hamilton 's attorney and stated we would hold Hamilton responsible for any money damages suffered shaAd he attempt to fence off or interfere with the operation of the Golf Course in any manner. Shepard should be in McCaLL for the Idaho Municipal League and a discussion could be held at that time. There followed a brief discussion on the history of the Golf Course ownership. T? 67 RECORD OF PROCEEDINGS continued minutes of June 5, 1961-- As far as was known the lighting project for the Airport was still scheduled for approximately June 20, 1961. The Airport leases were briefly discussed and the matter was referred to Fogg. The Westcott property was to be completely down by June 15, 1961. It was reported that following a telephone poll of the Board it was unanimously agreed that the building be completely torn down and the salvage be given to Mr. Hoffman the contractor. The hiring of the mowing and watering for the Village of McCall was briefly discussed and the possibility of age limitation which might be applicable. Regarding Jereld Donica and Robert Jones on the tearing down of the old portion of the Westcott property and their failure to return to clear up the grounds, Blair moved to take legal action to complete the contrgct. The motion was seconded by Burnside and upon vote declared unanimously. A zoning report would be make by Fogg at the next meeting. Fortin briefly reported on the County Commissioners meeting and stated the Villgge had gone ahead with the dump operation on the expectation of;'receiving some assistance from the County. Fortin also reported a repair in the amount of approximately $750 on the Village tract loader. Burnside moved the Board express its appreciation to the Rotary Club for cleaning up the Public Beach and the Lions Club for cleaning up the streets. The motion was seconded by Blair and upon vote was declared carried unanimously. There followed a brief discussion on the placing of boom poles around the Public Beach area to protect the swimmers. Police report was read by Blair on the last fiscal year regarding classification of accidents, arrests and the general operation of the Police Department. Rhodes reported on the parking problem and stated the streets were to be repainted and the parking should be clahified. Help from the State is necessary to have parralleL parrcing throughout the Village of MCCaLI. The angle parking in front of the Yatch Club and the entry into the street was discussed. A loading zone was to be established in fromt of Goodman 's for the three business houses in that area. The beer application of Charles Hill was read and the notation that he had not been a resident of the Village of McCall for one year was made. Following discussion Blair moved the license be granted which motion was seconded by Burnside and upon vote declared carried unanimously. Regarding the operation of the Village Library, the Clerk reported the Library's Boards recommendations to asses $1. 50 per year per family for users outside the Village limits, a fine of 20 per day after two weeks until one month past due and that users that have not returned books that were past due be not dllowed to check out books. Ray Mende who was present stated his position on the angle parking and the reduced area which would deprive him of several parking places. Members present were : Roberts Present Blair " Fortin Burnside Fogg Burnside moved the meeting of June 5, 1961, be adjourned, which motion was seconded by Fortin and upon vote declared carried unanimously. 'he minutes of the previous meeting were read and the notation was made that the June 5 meeting regarding the Hamilton land should be corrected to read land claimed by Hamilton, regarding the disagreement on the land being used at the golf course. The minutes were approved with this correction. Burnside briefly reported on the golf course operation and stated in his opinion the condemnation proceedings were not the correct manner in settling the disputed ownership of the golf course grounds. /here followed a discussion with the attorney on the action of quieting title and a further discussion of the condemnation proceedings. Remaklus reported on the legal steps which should be taken to properly determine the ownership. Burnside reported the greens were in a satisfactory condition and Newt Carter would again run the tournament. Regarding the window breakage in the old school building owned by William Deinhart, Rhodes reported the names of the parties involved in the window breakage had been turned over to the Prosecuting Attorney for action in Probate Court. The operation of boat houses on the lake in response to complaints received by the Board were discussed and the boat houses being hooked up to the sewer system and a permit from the State Health Department to operate same were noted. The regulatory and sanitary restrictions on the lake were discussed and the need for police power and jurisdiction in the north end of the county was noted. The dump operation and burning of trash at the dump were discussed and it appears to be satisfactory although a fence seems necessary to keep the papers from blowing around the area. Regarding the proposed airport lighting program, Fogg reported that Chet Moulten was to have men in June 25, but as yet no action had been taken. It was noted the Westcott Oil Company station building had been completely demolished and there was now a need for fill dirt and leveling which could be done in conjunction with the hospital fill and the boat parking area fill this fall. Fogg reported on the progress of the Zoning Commission to date and distributed copies of a proposed zoning ordinance to be studied by the Board members prior to the next meeting. The property lines and the street ownership in front of the Yacht Club had not yet been decided as the survey had not yet been completed. Fogg reported on the subdivision of the property of Brown Tie & Lumber Company located south of the Brundage Subdivision consisting of the old football field and adjacent property and the proposed relocation of Mather Road. The problems of sewer lines, manholes, and the vacating of the street were briefly discussed. No objection was had by the Board other than the N? 71 RECORD OF PROCEEDINGS obstacles of the sewer line and the ownership of areas adjacent to the street, to the proposed subdivision. The water extension on the Dewey-Davis Subdivision was discussed and to run the existing six inch main 290 feet would cost approximately $1180.00: The Village share and the four inch mains to be financed by the land owners. There followed discussion on the amount available in the water budget and the proposed construction. It was suggested that the plan be taken back to the land owners to finance the balance of the Village share and tentatively set up water credit for the cost of the lines. Ackaret stated he would contact the owners on the proposed plan. The Clerk reported receipt of moneys in the amount of $721. 63 from the State of Idaho under the Hillburton Act in final payment of the amount due on the hospital construction. Following discussion Blair moved to transfer the balance in the Hospital Construction Fund in the amount of $894.07 to the General Fund. The motion was seconded by Fogg and upon vote declared carried unanimously. The request to paint the City Hall by the D & L Painting Company for $180.00 was read to the Board. Following discussion on the type of paint and work to be performed by the painters, Blair moved to accept the bid on Ackaret 's recommendation, following investigation. The motion was seconded by Fortin and upon vote declared carried unanimously. Proposed Ordinance #218, the annual appropriation bill, was read in full and discussed in detail proposing a mill Levy of 49. 5 mills. Following the reading of the ordinance, +iurnside introduced and moved the adoption of proposed ordinance $218. Fogg moved the rules be suspended for the passage of proposed ordinance #218, Ahich motion was seconded by Blair and upon vote declared carried unanimously. 'he motion seconding the adoption of proposed ordinance #218, the annual appropriation bill, was seconded by Blair and the vote was declared as follows. In favor of the proposed ordinance #218 Roberts, Blair, Burnside, rortin, and Fogg; against, none. The Chairman declared the motion to adopt Proposed Ordinance #218 was carried unanimously. Burnside reported that boom poles had been installed on the Public Beach to make the area safe for swimmers and stated that Brown had donated the poles and weights and other items had been donated by Rowland Bros. and other firms. Roberts reported several compliments had been received on the action of the Police Force during the Fourth of July period. Members present were: Roberts Present Fortin Fogg ►► Blair ►► Burnside Absent Roberts reported to the Board complaints received on the operation of the houseboats on Payette Lakes and read a file of letters from the State Health Department regarding the correspondence between T. F. Thompson and the State on the permission to use the houseboats on the lake. 'here followed a discussion on the extension of the Village limits one quarter of a mile into the lake along the area continuous to the limits of the Village of McCall. Following discussion Fogg moved to instruct Remaklus to draw an ordinance to take in one-quarter mile of Payette Lakes into the limits of the Village of McCall from the Shore Lodge to Ponderosa Point or that area of the lake which is adjacent to the present village limits. The motion was seconded by Fortin and upon vote declared carried unanimously. A resolution from the Idaho Municipal League thanking the officials of the Village of McCall for their courtesies during the Idaho Municipal League convention was read to the Board. The Mather Road and relocation of same which had been previously discussed was found to be deeded to the State of Idaho. kemaklus was instructed to contact the State Fish and Game Commission to quit claim the streets consisting of the Mather Road and crossroads to the Village of McCall . Regarding the proposed zoning ordinance which had been distributed at the regular meeting, several suggestions were given on the proposed ordinance to Fogg by Roberts. Glair reported on the Police Department operation regarding the use of the police car outside the Village limits and several other matters which had been brought to the Board's attention. Fogg reported the State of Idaho was now apparently ready to proceed on the proposed airport lighting project. 'here appeared to be some conflict between the State of Idaho and Pearson of the FAA on the method of installation of the lights. The taking off of the small hill on the south end of the run- way also briefly discussed. Blair briefly reported on the possibility of the establishment of a public park in the u'rundage Subdivision which could be sponsored by the Village in conjunction with the several service clubs in the Village. Regarding the water extensions, Ackaret reported enough money was available to extend the water to Peterson's although not to Nordling 's. The funds available were slightly over $1000.00. There followed a discussion on the financing of the balance of the line. The possibility of budgeting the cost for the extension on the new budget which could be / in May was reviewed. It was suggested to the Board that six inch lines be purchased with the funds and then the balance be completed in the spring. Following a review of the facts Fogg would make a recommendation to the Board. Ray Mende, who was present, presented the Board with a written complaint regarding the noise at the Sinclair Station due to the repair of power saws and requested the noise be declared a public nuisance for disturbing the peace. Following discussion, Burnside moved the complaint be investigated, which motion was seconded by Blair and declared carried unanimously. A request was made to the Board for the continuance of a swimming area adjacent to the Village dock where the Red Cross swimming lessons had been held. Burnside was to check on the boat use prior to any decision. Ackaret reported the airport lighting project was well under way and should be completed in the near future. The repair of damage to the runway was briefly discussed and Ackaret stated the Village had furnished the oil and repaired the holes with some volunteer labor. The agreement with the U. S. Forest Service on the lighting project which had been discussed in a prior meeting was reviewed and Roberts reported he had signed the agreement with the Forest Service dated August 1, 1961, regarding the borate mixing installation and the lighting. Burnside moved to approve the execution of the agreement, which motion was seconded by Blair and upon vote declared carried unanimously. Burnside reported the Golf Tournament appeared to be proceeding satisfactorily and a large number of juniors and women were entered. Regarding the dispute on the ownership of the ground at the golf course, Remaklus briefly reported on the contact with Hamilton 's attorney. No report was available on the Zonging Commission. Remaklus reported on a meeting with the State of Idaho Fish and Game Commission on the ownership of Mather Road. Remaklus stated he would meet with the Fish and Game Commission again and clarify the request of the Village. Regarding the proposed D & L painting contract, Rhodes reported he had received warrants for the arrest of the contractor. Rhodes, chief of police. blair stated that he had requested the resignation of W. L. Rhodes as Chief of Police, and enumerated the reasons for his request. The several NO 77 RECORD OF PROCEEDINGS complaints were discussed in detail, following which Rhodes discussed the items of his personal conduct, keeping of records in the Police Department, training of officers, maintenance of equipment, and etc. Several members of the ooard expressed comments and opinions on the several complaints and discussed the past operation of the department. Following the discussion of the circumstances leading to the request for resignation Blair stated that he had considered all lf'e factors involved and felt the Chief of Police should be replaced and recommended that the Board request the resignation. Following further discussion the question was called: in favor of the motion glair, opposed to the motion Fogg and Fortin, abstaining Roberts and Burnside. The Chairman declared the motion failed, two to one. There followed a discussion on Proposed Ordinance 219, an ordinance extending the corporate limits of the Village of McCall one-fourth of a mile over the waters of Big Payette Lake; describing the annexed area; and providing for the filing of a dually 'certified copy of this ordinance with the recorder of Valley county, Idaho. The Village dump was briefly discussed and the various plans were proposed to better control the hauling, burning, and policing of the dump. Burnside reported on the City Dock and the proposal to extend the dock facilities. Roberts reminded the Board of the January budget requirements due to the change of fiscal year by the last Legislature. Roberts reported the Progressive Club had appointed a new Library Board to work with the Village Board on the operation of the library and stated he would meet with them on October 12, 1961. Roberts reported he had contacted Sterling Codifiers on the proposal of re-codifying the Village of McCall ordinances. Robertson V. Smith stated the Board would be contacted on the cost of recodification. The cost to other villages has been approximately =5300.00 initially and100.00 per year to maintain the service. Foga reported the Zoning Commission meetings had not been held yet although they would be resumed later in the fall. Fortin reported on several culverts to be put in yet this fall. Ackaret reported the sewer lift station at the Yacht Club would soon be completed as all the materials were now here. Regarding the Village water tank Ackaret stated a man from Seattle would be here to inspect the tank and would make recommendations on either repair or replacement. Some replacements had been made, although not completed. There followed a discussion on the possible bypass of the water tanks with the new type pumping systems which would maintain constant pumping as use was determined with no variation in pressure. A report was to be made to the Board on the water lank following inspection by the engineers. Fogg reported the lights on the airport were nov in operation and the solar switch would be installed in the near future which would operate the lights from dusk to midnight. The lights could, however, be turned on at any time manually. Regarding the operation of the Village Lump, Fortin reported that a cabin could be purchased to approximately "300.00 to 400.00 which could be moved to the dump for the operator and a well could be used for the water. The operation would be greatly improved by having a man living on the premises. Roberts briefly reported on the sewage treatment plant proposal and read a letter from the State of Idaho Department of Health. The Board of Health was requesting estimates on sewer treatment plants which should be made. Roberts stated he had contacted ,Wendell Smith and requested costs on a seconder sewage treatment system and also the open type treatment which could be installed near the sheep bridge. The Soard would receive the estimate before the winter months. It would be difficult to get approval from the state for the sewer hook-ups and connections without the submission of plans. Federal aid for any type sewage treatment plant was briefly discussed. No 81 RECORD OF PROCEEDINGS Fogg stated that bids were called from Rowland Bros. , and Lappin on the water extension on Floyd Street, the Golf Course, and Brown 's Subdivision, and Rowland Bros. , had been the low bidder. There followed a brief discussion on the budget, following which Fogg moved to exceed the budget in the water construction department by 11300.00. The motion was seconded by Blair and upon vote declared carried unanimously. Fogg briefly reviewed the method of reimbursement from the State of Idaho on the airport lighting project in the amount of twenty percent of the total cost. Regarding the dump operation, Fortin asked for any objection on the purchase of a building. An objection was made until such time as the county could participate in the operation that any building be purchased. It was also noted that two new tires would be necessary for the patrol . Regarding proposed ordinances by the Police Department, Blair stated he would hold any ordinances until a decision on the recodification of the Village Code was made. Blair stated he would attend the County Commissioners meeting to again request a Deputy be station in McCall to take care of county business, or propose they give us the sum of money of $4000.00 to take care of county emergency calls. There followed a discussion on people living adjacent to the Village limits and deriving Village benefits, following which Blair moved to have the attorney draw an ordinance taking in the forty acres adjacent to McCall between Reedy Lane and the golf course. NT0 83 RECORD OF PROCEEDINGS The minutes of the previous meeting were read and approved as read. The proposed plat of the River Subdivision, a re-subdivision of Block A of the Brundage Subdivision, was presented to the Board for acceptance. The subdivision was discussed in view of the possible installation of a secondary sewage treatment system adjacent to the proposed residential area. Also discussed was the possible difficulties in time and the relocation of Mather Road, and it was stated it would be possible to file an amended plat of the proposed subdivision following the vacation and relocation of Mather Road. Following discussion Fogg moved to accept the proposed River Subdivision, a resubdivision of Block A of the Brundage Subdivision as presented, which motion was seconded by Burnside and upon vote declared carried unanimously. Robertson N. Smith, who was present, explained the recodification of Village ordinances and the requirements for the ordinances to be brought up to date. The estimated cost from the Sterling Codifiers was `1360.00 to take the cede of 1949 and codify the ordinances passed since that time. He briefly explained the procedure and stated that the payment could be made from the next two budget years. No action was taken by the Board on the recodification proposal . Robertson Smith also reviewed the municipal fire defense insurance project and the aims of the organization and the method and necessity of financing the program from a local level . The benefits derived by towns and villages as a result of the program was reflected in the lower or reduced fire rates. The minimum dues were 125.00 a year. Following further discussion Burnside moved the Village of McCall join the Municipal Fire Defense Insurance project which motion was seconded by Blair and upon vote declared carried unanimously. Roberts reported on the secondary sewage treatment proposals and stated that Wendel Smith had been in McCall and an inspection of all suitable areas had been made. The lagoon type operation had been contemplated because of the reduced cost and although it was cheaper, it was decided to place a treatment plant adjacent to the fish hatchery ground and River Subdivision at an approximate cost of 164, 500.00, complete with extensions. If Federal Aid were available in the amount of thirty percent, the net cost to the Village would be .$115, 150.00, which plant would support a population of about 3000 people. Roberts stated a copy of the estimate would be submitted to the Board of Health. Regarding the previous discussion on the water tank, a 'ost estimate on the direct pumping system would be approximately $10, 410.00, which would utilize our present chlorinator but include new pumps and motors. It was also recommended that even with a direct pump some type or storage be available. No inspection has yet been made by any engineer on the present water tank. A letter from 'Yestcott Cil Company correcting the prior bid on gasoline to be supplied to the Village was read correcting the bid to . 1950 per gallon. Following; discussion Burnside moved to accept the apparent low bid of .Vestcott Oil Company in the amount of . 1950 per gallon, which motion was seconded by Blair and upon vote declared carried unanimously. Ackaret reported the culverts were all here but the ones on Lake Boulevard were not yet installed. Roberts reported that he could not make the County Commissioners meeting due to prior commitments and an attempt would be made to attend the next meeting of the Commissioners. It was reported that the water extensions were now complete. Roberts reported on the operation of the library and read a library report for the month of October, 1961 . I ° 84 RECORD OF PROCEEDINGS Fogg stated no zoning report would be made until after Christmas. Fogg introduced proposed ordinance `2.Z11, an ordinance annexing certain lands to the Village of Nc0all, Idaho, describing said lands and providing for the filing of a duly certified copy of this ordinance with the j'ecorder of Valley County, Idaho, and providing for the taxation of said lands. The Chairman stated the ordinance would be placed on the first reading and the ordinance was read at length. Burnside reported that Allen wanted to take some trees of the golf course around #8. Roberts stated the advisory committee and the Board should meet to determine what trees should be taken. A meeting was set up for the Board and the Advisory Committee in the near future. Burnside reported the request for the golf course to join the Northwest 7urf Association . No objection was had by the Board. Rhodes reported on the P. T.A. school safety committee with Bill Dorris as Chairman, and the request to gravel or sand the intersections on the school routes to protect the students, would be made. The request for a survey at the Yacht Club and the golf course from Bill Harris, engineer, was briefly discussed and the reasons for the survey not being received were reviewed. Regarding the airport lighting, Fogg reported the project cost approximately "3700. 00 and stated approximately 194.00 was to come from the State Department of Aeronautics. Lhe state participated twenty percent of the total cost and the net to the Village of McCall was approximately S600.00. Blair reported the Police Department was now operating with two men and reviewed the possibility of using three men during the summer months and two men during the winter months. hlso discussed was an adjustment of wages if the department was to operate under this plan. )he water extension request from the Sunset Subdivision residents was made to the Board. No objection to the installation, if the money could be collected and a credit set up on the water books if the right aways and etc. could be obtained. The clerk reported on the copy of ordinances received from the City of Coeur d'Alene regarding the regulations on Lake Coeur d'Alene. The request of Robert Chitwood to have the Villaoe Of l,'cCall purchase the sewer line constructed by him in return for water credit was made to the Board. Fortin reported on an accident in the intersection of Third and Lake Streets and the request that the intersection be sanded by the State Highway Department. Rhodes reported on a conversation with McKay of the Highway Department and an agreement had been reached whereby the state would sand the intersections and Main Street in return for the posting of No Parking signs from 3:00 to 7;00 A.M. . The adoption of a Village ordinance, the same as the state law on passing school busses while loading or unloading students was briefly discussed. No. 87 RECORD OF PROCEEDINGS Following a discussion on the golf course condemnation suit, Reaaklus stated the suit with Hamilton had been thrown out of court and dismissed. There followed a brief discussion on the possible alternatives. Regarding the right-of-way an the Mather Road property, Bob reported on a meeting with the Game Commission whereby the state would deed the road to the Village of McCall . Remaklus stated he would check with the Game Department on the deeding of the road. A Letter from the Federal Pipe and Tank Company stating prices as follows: A 100, 00 gallon tank with a 30 foot outside diameter by 20 feet high complete with cover, Chime joists, ladders, and target engage board installed on a flat concrete slab, $8496.00. A 25, 000 gallon tank complete could be installed on the existing tower for $3630.00. A new 100,000 gallon tank on a 30 foot tower complete with footings, inspection balcony, tank and cover approximately $22, 000.00 in place. Also reported was a polyetheline tank liner with tubing which could be supplies for approximately S150.00, which would remedy the tank and the build up of ice at the present time. Ackaret further explained the possibility of a flow matcher pumping system with some reservoir storage. Following discussion Ackaret was instructed to contact the company on an estimate on installing the polyetheline liner. The Chitwood , Sewer Line bill previously made to the Board was again discussed and Foca reported a conversation with Chitwood on the construction of the line and the possibility of reconsideration of purchase by the Village.
