MINUTES
SPECIAL MEETING, SEPTEMBER 16, 1991
I. CALL TO ORDER AND ROLL CALL
The meeting, called for 12 noon, was called to order at
12:25 p.m. by Mayor Allen. Councilmen McCarty was absent
for the roll call. Councilmen VanKomen, Wallace, and
Larson answered to roll call. Mr. McCarty arrived at 12:28
p.m.
II. CITY-MANCHESTER LAND TRADE:
Attorney Millemann, representing Manchester, advised that
in the environmental evaluation conducted on the Mill Park
fill, one test hole had evidenced a presence of a petroleum
product. His client had asked, and he had prepared and
presented copies to the council of a Third Addendum to the
Land Trade agreement. The council reviewed and discussed
the document in detail. After discussion, VanKomen moved
to approve The Third Addendum to Agreement for Exchange of
Property" with the following corrections and additions:
1. On page 2 of said document, adding a new item 5, to
read: "Without conceding that the city has any liability
pursuant to this agreement, it is agreed that under no
circumstances will the city be liable for the cost of
excavating of property which was planned to be excavated as
part of Manchester's or his successor's development of the
upland property."
2. On page 1, in the fourth paragraph, after the words
"...has been conducted." delete the period and add the
following: "...a copy of which report by Envirosearch
International, dated September 13, 1991, is on file in the
office of the City Clerk."
3. On page 2, in the first paragraph and first sentence,
delete the following words: "...currently in effect or
subsequently amended or adopted."
The motion also authorized the Mayor to sign the agreement
subject to approval by the City Attorney. Wallace seconded
the motion. On a roll call vote, VanKomen, Wallace McCarty
and Larson voted Aye. The Mayor declared the motion
carried and that he would sign the document.
III. OTHER BUSINESS
Mr. Wallace asked that the Council formally request that
the US Forest Service convey interest in the parcel of land
West of Mission Street, part of the ownership of the new
jumper base site for recreational uses and so moved.
VanKomen seconded. The motion carried unanimously.
IV. ADJOURNMENT
Without further business, Wallace moved to adjourn.
VanKomen seconded and the motion carried.
