HomeMy Public PortalAbout11/15/77 CCM18 � The Council of the City of Medina met in regular session on Tuesday, November 15, 1977 at 7:40 P.M. Members present: Mayor, Wayne Neddermeyer; Councilmembers, Nancy Laurent, William Reiser, Arthur Theis; Clerk, Donna Roehl; Planning and Zoning Adminstator, Jeanne Mabusth;,, Attorney, Richard Schieffer; Engineer Lyle Swanson. Absent: Councilmember, Thomas Crosby Motion by Arthur Theis, seconded by William Reiser to accept the minutes of November 1, 1977, as presented. Motion carried unanimously Mayor Neddermeyer requested a minute of silence in remembrance of Priscilla Arens, former Clerk, who had died on November 8th. 1. GRADER REPAIR Ron Duran presented itemized list of grader repair cost totalling $4900. These items were included in the original analysis. Motion by Nancy Laurent, seconded by Arthur Theis to contract with the Ziegler Co. to re- pair city grader, at their shop, as set forth in letter dated November 7, 1977, cost not to exceed $4900. Machine to be transported to Zieglers. Motion carried unanimously 2. DAVID GATES, MEDINA CREEKSIDE Lyle Swanson reported that the street into Medina Creekside Addition has not been completed satisfactorily and that he could not recommend approval of the street nor the sewer and water at this time. Be stated that he would meet with the contractor and Mr. Gates to explain the problems he has found with the project. Mr. Gates explained that he had put an additional 70 tons of blacktop on the street over the original estimation and that the contractor would be digging a trench on the drainage easement beacuse of a water problem in the street. Mr. Gates also requested Council's consideration of the bill incurred when he had to dig up Hamel Rd. to connect to the utilities. Old records indicate Mr. Gates favoring the original project in 1967 and petitioning for service to Lot 1 of the Medina Creekside Addition. Nancy Laurent stated that the matter will be discussed when all of the work has been approved. 3. MEDINA MORNINGSIDE TAX FORFEIT LOT Ron Duran reported as to the estimated cost of improving the lot adjacent to the Medina - Morninside park that is being acquired as an addition to the park. Donna Roehl explained that the environmental assessment would need to be rewritten as the original request for Community development funds had been for land acquisition only. She stated that Council could decide whether or not they wished to designate the entire $3000 that had been approved for land acquisition to site improvement or use only a portion of the $3000 and designate the remainder to any of the other projects approved for 1976. Motion by Arthur Theis, seconded by William Reiser to approve Resolution 77-44 requesting a change in the Year II Community Block Grant Funds from land acquistion at Medina Morning - side to the upgrading of the property for the entire amount of $3000. Motion carried unanimously 4. MEDINA MOTOR INN PUBLIC HEARING 8:05 P.M. Lyle Swanson stated that the purpose of the meeting is to inform residents of the area of the proposed project. Nancy Laurent stated that the properties inside the service area should be serviced fairly before anything additional is allowed. Emil Jubert inquired as to the capacity of the sewer pond and if there would be enough room if every property assessed were serviced. Wayne Neddermeyer stated that there would not be enough room in the sewer pond. Lyle Swanson stated that Metro Waste Control has said there would be no problem with allow- ing the proposed motel to connect to the sewer. They may say at some future date that Medina would have to stop issuing permits until a new trunk line is built. Julius Dorweiler stated that he had no objection to the motel and felt that the city 1 8 J should not hold back development because of future sewer capacity problems, that there would be a problem if anyone assessed were told they could not develop their property, and now would be the time to explore expansion possibilities with Plymouth and Metro. Wayne Neddermeyer stated that we have a Comprehensive Sewer Plan that has been submitted to Metro and a recent letter from Plymouth indicating possible extension to Medina. Motion by Arthur Theis, seconded by William Reiser to close the Public Hearing. Motion carried unanimously. Public Hearing closed at 8:25 P.M. 5. HUNTING REGULATIONS Police Chief Hoover reported on regulations in Maple Grove and Brooklyn Park. Maple Grove issues permits and hunters must have written permission from the property owner. Be suggested a meeting be held to find out what property owners would like. Richard Schieffer stated that a violation of an ordinance would be a misdemeanor and that signs would need to be erected stating permits are required. 6. POLICE SEMINAR Motion by Nancy Laurent, seconded by Arthur Theis to approve expenditure of $15.00 to allow Mike Rouillard to attend a Search and Seizure Seminar. Motion carried unanimously 7. MEDINA MOTOR INN Jeanne Mabusth read recommendations from Planning Commission meeting. Discussion of entrance from Hwy. 55. Joe Raskob stated that they have received approval from Minn. Transportation Dept. for a 36' wide entrance. Jeanne Mabusth stated a variance would be required because Medina's ordinance requires a 24' entrance. Discussion of turn lanes that will be required. Developer will put in such lanes and must be bonded. Jeanne Mabusth recommended the posting of a bond guaranteeing completion of work rather than completion of the building before granting a Certificate of Occupancy. She also reported on discussions with Hennepin Co. Soil Conservation Service regarding an erosion control project to control parking lot run-off into Elm Creek. Joe Raskob requested that they be allowed to go ahead with ther plans contingent upon com- plying with any of the conditions that will be required. Motion by Arthur Theis, seconded by William Reiser to approve the site and building plans of TRA Inc. for Medina Motor Inn according to plans submitted and dated 10/7/77 subject to the following: (a) Compliance with the entrance permit of the State Dept. of Transportation including a 300 ft. right turn lane to Medina Lanes and the Motel; entrance to be lighted and all costs to be borne by the applicant. (b) Submission to, and approval of a suitable drainage and erosion plan by the Elm Creek Watershed District, and construction in compliance with the plan. (c) No roof drains discharged to the sanitary sewer and provision to discharge the proposed pool to somewhere other than the sanitary sewer. (d) Sewer and water connection charges to be based on the number of SAC units assessed by the Metro Waste Control Commission (e) Drainage swale on the east edge of the property and the open areas south and north of the parking area should be seeded as soon as possible to prevent erosion. (f) Shrubbery, according to pan submitted, along southern and eastern borders of parking lot. (g) Developer to assume responsibility for payment of all engineering, legal and adminis- trative expenses. (h) Approval of the plan by the Hamel Fire Chief, including hydrant locations. (i) All site improvements, including parking lots, access streets, landscaping drainage control and other matters to be guaranteed by the posting of a performance bond in an amount set by the city engineer and signing of a Development Contract to be prepared by the City attorney with a completion date of August 30, 1978. Abstaining Nancy Laurent 1 9 0 8. TERRY ROEHL, LAKE INDEPENDENCE ACCESS Terry Roehl reported that the DNR will no longer service Lake Independence as there is no free access to the lake. In the past they have restocked the lake but will discontinue doing.so. He suggested removing the "No Parking" signs at the city park or perhaps ask the County park to allow free boat launching. Nancy Laurent stated that she would contact the DNR and the Co. park, if necessary. 9. DIVERSIFIED INSULATION Mr. Moriguchi explained their plans to build ing on Hwy. 55. He stated that they have an will be relocating their septic system. Motion by Nancy Laurent, seconded by Arthur to construct a 100' x 150' warehouse as per (a) (b) (c d e f) g (h a warehouse adjacent to their present build - engineer completing a percolation test as they Theis to approve Diversified Insulation addition plan dated 7/28/77 with the following conditions: Provide an additional 37 parking spaces making a total of 135 Blacktopped spaces. Bond amount to be $24,000 to guarantee completion of blacktopping and site work as indicated on plan. Additional landscaping to be completed Developer to sign a development contract as prepared by the City Attorney Project completion date to be July 15, 1978 A new entrance to be constructed as specified by the Minnesota Transportation Dept. New sewage disposal system to be approved by the City Engineer Developer to pay any legal, engineering, and administrative fees in connection with the project. 10. BYINGTON PLAT Mr. Byington explained his plans to plat 6 acres into a 2 acre parcel and a 4 acre parcel. He asked if the plan would be feasible before he incurs further expense. Jeanne Mabusth explained that the Hennepin Co. Watershed District has looked at the site and can see no problem with finding a suitable septic system site on the 2 acre parcel. Mr. Byington was advised to contact Hennepin Co. regarding an entrance to Parcel B. Motion by Arthur Theis, seconded by Nancy Laurent to give preliminary site approval to the Byington plat. Motion carried unanimously 11. EMBRETS PLAT Jeanne Mabusth presented Dale Embretson's plat of 3.04 acres on Co. Rd. 116. She explained that there will be a 6.31 acre landlocked parcel to the east of the plat but under Medina's ordinances that would be allowed. Richard Schieffer stated that he had been asked if it would be possible to sell the property before final platting. Motion by William Reiser, seconded by Arthur Theis to grant preliminary approval of the plat survey for Embrets Addition. Motion carried unanimously 12. D.M.E. PLAT (DON ERICKSON) Jeanne Mabusth read Planning Commission recommendations regarding Mr. Erickson's plat also that it will be necessary to remove the 5 ft. utility easements on the western and southern lot lines. Motion by Nancy Laurent, seconded by Arthur Theis to grant preliminary approval to the DM.E plat according to the Planning Commission recommendations and to waive charging of a park fee as the property has been previously platted. Motion carried unanimously Motion by Nancy Laurent, seconded by Arthur Theis to hold public hearings on November 29, 1977 at 8:00 P.M. to consider the plats of Mr;s Erickson, Byington and Embretson. Motion carried unanimously 13. LANCE BEAULIEU Motion by Nancy Laurent, seconded by Arthur Theis to table Mr. Beaulieu's request for a variance to construct a barn because applicant failed to appear and all ajacent property oters be notified when Mr. Beaulieu requests to be heard. lion carrieu unanimously 14. JOE AND PAUL DITTER Mr.s Paul and Joe bitter discussed with Council the feasibility of extending Brockton 191 Lane north from Co. Rd. 24 to serve their properties which are now landlocked. The only other means of service the properties with roads would be onto Holy Name Dr. and the property owner adjacent to Holy Name Dr. does not wish to sell road easements at this time. )iscussion of working with Plymouth for the extension of the road. lotion by Nancy Laurent, seconded by Arthur Theis to authorize the engineer to check the feasibility of extending Brockton Lane from Co. Rd. 24 to Medina Rd. Motion carried unanimously 15. GEORGE FAVORITE Nancy Laurent explained Mr. Favorite's request for an entrance to his property from Ever- green Rd. Donna Roehl explained that at the time Mr. Favorite had given the property for the road he did not want an entrance to his field but now he was requesting an entrance. Motion by Nancy Laurent, seconded by Arthur Theis to authorize the Public Works Dept. to install a culvert for Mr. Favorite, that he would purchase and that he will be charged $100, to the City for installation. Motion carried unanimously '16. PLANNER Richard Schieffer reported that he had read the planning contract and that there were some items that Council may wish to change: (a As Medina has a Comprehensive Sewer plan the contract price could be reduced. (b Subdivision regulation and zoning ordinances could perhaps be written by the city att- orney as they will be working with other municipalities and the cost would be less. (c Termination clause could be changed to allow termination by either party without cause. (d There is no mention of the cities Comprehensive Guide plan and how it will be used. He also suggested the planner conduct 2 seminars with the public to explain the cotpleted plan. He explained that he had discussed his suggestions with Tom Crosby and Tom had had no ob- jections. Motion byArthur Theis, seconded by William Reiser to authorize the City attorney to contact the planner and negotiate the changes suggested. Motion carried unanimously 17. INDEPENDENCE HEIGHTS SEWER PROBLEM Lyle Swanson explained the sewer odor problem at Ind. Heights is caused by not through the lines. A compressor costing approximately $500 could be installed air fresh. Motion by Nancy Laurent, seconded by Arthur Theis to authorize the engineer to aerator in the main lift station in the Independence Beach area. Motion carried unanimously enough flow to keep the install an 18. PLANNING COMMISSION Emil Jubert reported that the Planning Commission members would like to maintain a 9 member board. Wayne Neddermeyer stated that Joanne Haislet had contacted him about the current vacancy. Motion by Wayne Neddermeyer, seconded by William Reiser to appoint Joanne Haislet to the Planning Commission to unexpired term of Ron Roy, term to expire March 1, 1978. Motion carried unanimously 19. ELM CREEK CONSERVATION DISTRICT REPRESENTATIVES Motion by William Reiser, seconded by Arthur Theis to appoint Jeanne Mabusth as delegate and Tom Anderson as alternate delegate to the Elm Creek Conservation Commission. Motion carried unanimously 20. NURSING SERVICE Discussion of the joint powers agreement being considered to provide for nursing services. Donna Roehl reported that there had been a sufficient number of municipalities who had signed the agreement so they can now begin fromation of a program. 1 9 4) The only other alternatives available are to join with Suburban Public Health Nursing Service or for Hennepin County to directly administer a program. Also discussed was the possibility of North Memorial Hospital being able to provide the services. Motion by Arthur Theis, seconded by Nancy Laurent to enter into joint powers Suburban Health Nursing service agreement. Motion carried unanimously 21. SURPLUS i!i DERAL PROPERTY Donna Roehl explained that Federal Surplus propertyis now being made available at a very low cost to municipalities and non profit organizations. Some of the requirements are that the property must be put into use within one year or returned and if any properties are sold proceeds must be tuned over to the Federal Government. Motion by Nancy Laurent, seconded by Arthur Theis to make application for federal surplus property. Motion carried unanimously 22. AIRPORT Discussion of information received regarding a search for a secondary airport site in rural Hennepin Co., including Medina Motion by Wayne Neddermeyer, seconded by Arthur Theis to go on record in opposition to the location of any airport in Medina and that the clerk write a letter to Metro giving Medina's posistion. Motion carried unanimously 23. BILLS Motion by Nancy Laurent, seconded by Arthur Theis to pay the bills; Payroll # 4702-4709 in the amount of $2637.24 and Order Checks # 7069-7070 in the amount of $45.00. Motion carried unanimously 24. BUILDING INSPECTOR Jeanne Mabusth explained that Orono is working on a new contract for Minnetonka Beach and Long Lake and will include Medina. She presented their fee schedule and the fact that they would charge $25.00 per inspection including utility connections. She also asked that Paul Ogland be allowed to begin work with Orono to do Medina's inspecting. Motion by Nancy Laurent, seconded by Arthur Theis to authorize Paul Ogland to begin work with Orono to become familiar with inspections of sewer, water and septic connections. Motion carried unanimously 25.REVENUE SHARING FUNDS Motion by Nancy Laurent, seconded by Arthur Theis to transfer Revenue Sharing funds in the amount of $6000 to the General Fund to be used for the purchase of a new police car. Motion carried unanimously 26. LORETTO POLICE CONTRACT Chief of Police Hoover stated that Loretto's share of the police budget should be determined so that.he could present new contract to them. 27. FIRE DEPARTMENT BUDGET Wayne Neddermeyer asked that .the matter be tabled until Tom Crosby is in attendance. 28. PUBLIC WORKS SEMINARS Motion by William Reiser, seconded by Arthur Theis to authorize Paul Ogland to attend a 3-day seminar in St. Cloud. Motion carried unanimously Motion by Wayne Neddermeyer, seconded by Arthur Theis to authorize Ron Duran to attend a 2-day Public Works conference in Minneapolis. Motion carried unanimously 29. McDowell Motion by William Reiser seconded by Arthur Theis to allow a second home to be constructed on the McDowell property, 2 morgan Rd., existing home to be used as guest house. Motion carried unanimously 30. COLONIAL DRIVE IN 193 Motion by Arthur Theis, seconded by Wayne Neddermeyer to acknowledge receipt of letter from Father Ardolf, of St. Anne's Church, Hamel, regarding low level of entertainment at the Colonial Drive In theatre and to send a copy of said letter to the theatre owners.
