Presents the following Ordinance Seconded by Councilman
ORDINANCE AMENDING CHAPTER 160 ENTITLED LAND DEVELOPMENT
OF THE CODE OF THE BOROUGH OF CARTERET
WHEREAS, the Carteret Planning Board (the "Planning Board') has recommended
certain modifications to Chapter 160 of the Code of the Borough of Carteret, the Land
Development Ordinance (the "Ordinance"); and
WHEREAS, the Mayor and Council of the Borough of Carteret have reviewed the
proposed modifications and determined them to be substantially appropriate.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough
of Carteret that Chapter 160 Entitled Land Development of the Code of the Borough of
Carteret be amended as follows:
Section 1. § 160-129 entitled R-25 residential zone regulations is hereby amended
and supplemented as follows
1. Subsection 160-129A(2) "Two-family dwellings" is hereby deleted.
2. Subsection 169-129C is hereby amended and supplemented to add the
following new paragraph:
(2) Two- family dwellings:
(a) Two-family dwellings must have a minimum lot area of
6,500 sq.ft.
(b) Two-family dwellings must have a minimum lot width of
65 feet.
(c) All legally eXlstmg two- family dwellings, and the
expansion or enlargement of the same, provided said
dwellings, as expanded or enlarged, strictly comply with
all of the then existing bulk regulations set forth in
Subsection D.
Section 2 The Bulk Schedule of the development ordinance is hereby amended
and supplemented as follows:
1. The minimum front yard set back for the GB District is
hereby amended to delete any reference to the number
"3" set forth therein.
2. The text for footnote one (I) is hereby deleted in its
entirety and replaced with the following: "Two-family
dwellings conditional use see Section 160-129C"
3. Any reference to footnote five (5) with reference to the
maximum height in the R-50 and R-25 Districts is
hereby deleted in its entirety, including the text of said
footnote.
4. All of the footnotes set forth in the bulk schedule shall
be renumbered accordingly.

Section 3. All Ordinances and/or provisions thereof-inconsistent wit the
provisions of this Ordinance shall be and are hereby repealed as to extent of any
such inconsistencies.
Section 4. If any section, subsection, part, clause, or phrase of this Ordinance
shall be declared invalid by judgment of any Court of competent jurisdiction, the
section, subsection part, clause, or phrase shall be deemed to be severable from
the remainder of this Ordinance.
Section 5. This Ordinance shall take effect upon passage and publication '
according to applicable law.
