CALL TO ORDER AND ROLL CALL At 2 p.m., Mayor Smith called the meeting to order in the Chambers. Councilmen VanKomen, Larson, Wallace and LeBrett answered the roll call. The Mayor declared a quorum present. II. JOHN AND ANN LLOYD EDWARDS, VARIANCE REQUEST: The Administrator reviewed the minutes of August 13 and August 27. The City Attorney inquired about the status of Councilman Wallace. Mr. Wallace declared a conflict of interest and removed himself from the table. The Attorney then inquired whether Mr. VanKomen qualified himself to participate in the hearing. The Councilman responded that he had visited the property and read the Council's minutes of the prior hearing. The Attorney then asked if Mr. Brown and Mr. Edwards accepted the qualifications of Councilmen VanKomen, LeBrett and Larson to act upon the matter and to waive any procedural defects. Both confirmed that they accepted the qualifications and asked that the matter proceed to resolution. The Mayor then reopened the floor to public comment. John Edwards presented a petition from neighbors in the vicinity endorsing the matter and read a statement. Warren Brown then appeared and spoke against the granting of the variance. The Council then discussed the finding of hardship and determined that no hardship had been demonstrated. After discussion, VanKomen moved to deny the Variance request. Larson seconded and the motion carried unanimously. II. REPORT ON IMPACT PLANNING AND ZONING COMMISSION STATUS: The Mayor reported that he has requested a special council meeting for Wednesday, September 9 at the SCS office in Donnelly to meet with the County Commission on these matters. The City Attorney then reviewed the history of the Commission, agreements between the City and County, and a meeting with the County Prosecutor, Commissioner Kerrick, the Mayor and himself to resolve further details of a jointly agreed ordinance respecting the Commission. The currently agreed draft document matches the prior agreement as to makeup and distribution, terms of office and other details in the prior status of the Commission. The Mayor asked if anything else should be added to the draft. VanKomen asked that a statement of disclaimer that denied that the Commission was constituted improperly at its origin should be added. The Mayor determined that a consensus for including this language in the ordinance existed and ordered the Attorney to include such in the next draft. He reiterated that the County Commission may have changes to add to the draft as well and that those would be discussed in detail on September 9. III. ADJOURNMENT At 3:40 p.m., without further business, Wallace moved to adjourn. VanKomen seconded and the motion carried unanimously. Clerk
