HomeMy Public PortalAboutResolution 93-32741 1 1 RESOLUTION NO. 93 -3274 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REVERSING THE PLANNING COMMISSION'S DECISION TO APPROVE CONDITIONAL USE PERMIT 93 -1186, A REQUEST BY GEORGE TOMASIAN TO ALLOW A BILLIARD PARLOR WITH 20 BILLIARD TABLES AND SNACK BAR WITHIN AN EXISTING COMMERCIAL UNIT, FORMERLY OCCUPIED BY MILLER'S OUTPOST, WITHIN THE K- MART /ALBERTSON'SBUILDERS EMPORIUM SHOPPING CENTER LOCATED AT 5573 ROSEMEAD BOULEVARD IN THE GENERAL COMMERCIAL (C -2) ZONE. (TOMASIAN) THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon testimony received at a noticed public hearing before the City Council and upon the facts contained in the staff report and testimony received at a noticed public hearing before the Planning Commission, the City Council denied the request based upon the following findings: 1. That the site for the proposed use is not adequate in size, shape, topography and circumstances in that the proposed location is situated within a retail commercial shopping center as opposed to an entertainment - oriented area. Consequently, the proposed use could result in business conflicts within the shopping center and insufficient parking at peak user times. 2. That the site has insufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the proposed billiard club could generate significant traffic so as to disproportionately contribute to the volume of traffic and parking in the immediate vicinity; for example, most shoppers within the shopping center would be termed "short - term" parkers while the patrons of the proposed billiard club could occupy available parking for an extended period of time. 3. That the proposed use will have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the billiard use will be located within an existing shopping center which contains other commercial businesses which could be negatively impacted. The proposed billiard club is likely to be incompatible with other commercial establishments within the shopping center; while it is possible to impose conditions which may lessen the probability of an adverse impact, approving a use with onerous conditions can contribute with the failure of that business establishment, which may not be fair to the applicant /investor and may not be fair to other businesses within the shopping center which would be hurt by the additional vacancy. SECTION 2. This project should not result in significant effects upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 3. Accordingly, Conditional Use Permit 93 -1186 is denied. Resolution No. 93 -3274 Page 2 SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED ON OCTOBER 19, 1993.
