A GENERAL ORDINANCE ADDING A NEW SECTION
95.42 TO THE CITY OF RICHMOND CODE
WHEREAS, Chapter 95 of Richmond Code regulates activities within City of Richmond parks; and
WHEREAS, the City of Richmond is in the process of completing construction of a Skate Park facility at Glen Miller Park in the City of Richmond; and
WHEREAS, Indiana Code 34-13-3-3(5) provides the City with protection from liability for certain losses that may occur at said Skate Park facility if rules governing the use of said facility
are adopted and posted; and
WHEREAS, it is desirable to allow the Parks and Recreation Board to adopt rules governing the Skate Park facility as well as to provide for the imposition of fines for violations of
certain rules.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that a new Section 95.42 is hereby added to Richmond Code to read as follows: follows:
95.42 SKATE PARK FACILITY
(a) The Parks and Recreation Board of the City of Richmond is hereby authorized to adopt rules governing the use of the Skate Park facility located in Glen Miller Park.
(b) All rules and regulations adopted by the Parks and Recreation Board pursuant to this Section shall be posted at all entrances to the Skate Park Facility.
(c) The Skate Park facility shall be open only to skateboards and inline skates. No bicycles or scooter shall be permitted.
(d) No graffiti or tagging shall be permitted within the Skate Park facility.
(e) Alcohol, tobacco, illegal drugs, and weapons are prohibited.
(f) Horseplay, roughhousing, fighting, violence, and profanity are prohibited.
(g) Violators of subsection (c), (d), (e), and/or (f) may be fined $50.00 for each violation, which fine may be issued by any member of the Richmond Police Department or any
employee of the City of Richmond so authorized by the Parks and Recreation Board.
Passed and adopted this 3rd day of December, 2001, by the Common Council of the City of Richmond, Indiana.
