CALL TO ORDER AND ROLL CALL: Mayor Martens called the meeting to order at 7 p.m. Councilmen Colton, Killen, and Eckhardt answered the roll call. The Mayor declared a quorum present. II. APPOINTMENT OF CITY MANAGER: The Council discussed the process of appointment of a permanent City Manager and determined to readvertise the position. The Council then discussed the appointment of an Interim City Manager. After discussion, Killen moved that the Council go into Executive Session pursuant to IC 67-2345 subsection (a) to discuss hiring an employee or officer of the City. Eckhardt seconded and on a roll call vote, Killen, Eckhardt, Colton and Martens voted Aye. The Council moved to executive session at 8:11 p.m. and reconvened in open session at 8:45 p.m. The Mayor advised that they had discussed working conditions, the Council's expectations, and other matters related to the hiring of an employee or officer of the city. Colton then moved to appoint an interim City Manager for 90 days, i.e. to the Council meeting to April 14, 1994. Eckhardt seconded. After discussion, Killen moved to amend the main motion to appoint Arthur J. "Bud" Schmidt, as the Interim City Manager at a salary of $41,161 per year effective January 15, 1994, who would continue to accrue benefits and who, if not selected for the permanent position, would secure the same rights at termination as would have occurred at the termination of the City Administrator position, in effect causing no penalty for accepting this interim position. Eckhardt seconded the motion to amend. The mbtion to amend carried unanimously. The Mayor then called for a vote on the main motion, which carried unanimously on a voice vote. Killen then moved that for the Interim all department heads would report to the Interim City Manager except for the City Attorney/Prosecutor. The Prosecutorial function is defined statutorily and legal advice to the city staff shall be at the request of and routed through the City Manager. Eckhardt seconded and the motion carried. The Council asked that this policy be communicated to the City staff. Killen then moved to instruct staff to revise the advertisement for City Manager as follows: 1. Salary to be $42,500 plus benefits; 2. Only the MPA credential be required, deleting the MBA; 3. Requiring 3-5 years of department head or senior management experience; 4. Public management experience preferred; 5. Advertising in the ICMA newsletter, and selected local and regional media; 6. A response date by February 28 or March 1, 1994; 7. Contact all applicants from the prior solicitation and determine their continued interest. 8. Permit staff to edit other elements to further describe the scope of the duties and clarify responsibilities; Eckhardt seconded the motion and the motion carried unanimously on a voice vote. III. DISCUSSION OF CITY ORGANIZATION: The Council reviewed several draft Organizational plans and discussed those. After discussion, the City Attorney was directed to present a minimum revision of the City Code to implement the Council Manager form on the next meeting agenda. III.
