MINUTES, SPECIAL MEETING
MAY 18, 1994
I. CALL TO ORDER AND ROLL CALL:
The Mayor called the meeting to order at 12 noon. The
purposes of the meeting were to receive a staff report on the
Park Concessionaire proposal and to discuss the proposed
employment agreement with a City Manager.
Martens, Killen, Colton, and Arp answered the roll call.
Eckhardt arrived following the roll call at 12:06 p.m..
II. PARK MAINTENANCE CONTRACT:
Staff requested that this item be placed on the agenda to
permit possible commencement of work on Monday, May 23, if the
contract attachments could be completed by then. The Council
agreed to take up the matter and reviewed the proposed contract
with Valley County Landscape Co.
Colton moved to approve the contract, authorize the Mayor
to sign and to hold execution until all insurance certificates
and other appendices of the contract were available. Killen
seconded and the motion carried unanimously.
III. PARK CONCESSION REPORT:
A written staff report was submitted and reviewed. Staff
recommended against award of a contract to the proposer, David
McBride on the basis that the payment was insufficient and that
the ten year commitment was excessive. The Council discussed the
proposal and the staff report in detail. After a lengthy
discussion, Killen moved to reject the proposal and invite Mr.
McBride to negotiate with the staff on a less capital intensive
service and for a period of 1 year only. Eckhardt seconded and
the motion carried.
IV. CITY MANAGER EMPLOYMENT AGREEMENT:
Martens moved that the Council go into session as a
committee of the whole to discuss this issue. Killen seconded and
the motion carried. The Committee then reviewed and
discussed provisions of the model ICMA employment agreement.
They directed the City Attorney to
1) Reference the City Ordinance on job duties;
2) Make the term for 2 years with 2 year renewal periods with
120 notice periods;,
3) Define just cause;
4) Clarify that a majority of the full Council would act on
suspensions and terminations;
5) Discussed the issue of "cause" for suspensions;
6) Provided for 6 months severance pay under certain
conditions;
7) Limited severance pay to the balance of the term of the
contract, whichever was less;
8) Set the salary at $42,500;
9) Removed moving expenses as a contract item but indicated
willingness to negotiate these costs;
10) Discussed advancing 80 hours of vacation time and thence
accruals at the schedule which other employees accrue
such benefits;
11) Provided for sick leave and holidays the same as are
provided to all other employees;
12) Addressed dues and memberships as budget items;
13) Required provisions of consent to police records and
credit records checks as part of the contract agreement;
14) Removed items 16-20 from the contract which will be
addressed in each years annual budget;
15) Asked that a draft of the agreement be presented on the
May 26 regular agenda;
V. ADJOURNMENT:
At 1:50 p.m. Eckhardt moved to adjourn. Arp seconded and the
motion carried.
