II !I I II [I )1 I I I' II I L____ \VHEREAS, the Ne\V Jersey Department of Environmental Protection, Green Acres Program ("State"), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and \VHEREAS, the Borough of Carteret desires to further the public interest by obtaining a loan of $258,000.00 and/or a grant of $258,000.00 from the State to fund the following projects(s): Carteret Park Development. NO'V, THEREFORE, the Governing Body of the Borough of Carteret resolves that Daniel J. Reiman or the successor of the office of Mayor is hereby authorized to: (a) make application for such a Joan and/or such a grant. (b) provide additional appJication inf01111ation and furnish such documents as may be required. (c) act as the authorized correspondent of the above named application, and WHEREAS, the State shall detennine ¡fthe application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and \VIIEREAS, the applicant is wi !ling to use the State's funds in accordance with such rules, regulations and applicable statutes, and is wilting to enter into an agreement with the State for the above named project; NOW, THEREFORE, BE IT RESOLVED BY THE BOROUGH COUNCIL OF THE BOROUGH OF CARTERET as follows: 1. That the Mayor of the above named body or board is hereby authorized to execute an agreement and any amendment thereto with the State know as Carteret Park Development; and 2. That the applicant has its matching share of the project, if a match is required, in the amount of $258,000.00. 3. That in the event the State's funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project; and 4. The applicant agrees to comply \\rith all applicable federal, state, and local laws, rules, and regulations in its perfonnance o[the project. 5. That this resolution shall take effect immediately. DuPont, Director Borough of Carteret Department of Municipal Engineering 61 Cooke Avenue Carteret, NJ 07008 Re: Project # 1201-02-071 Project Name: Carteret Park Development Carteret Borough, Middlesex County .::JPI> gcRJtN ~ Mc- Dear Mr. DuPont: ~ This letter will acknowledge receipt of two executed Green Acres Project Agreements; an Enabling - Resolution; completed Certification of Debt Reporting, Development Compliance Checklist, and Pre- Construction Engineering Certification forms; and signed and sealed construction plans and specifications for the Carteret Park Development project. We have reviewed the construction drawings and confirmed that they are consistent with the approved project scope. The signed Pre-Construction Engineering Certification indicates that a qualified engineer has approved the plans and specifications as per federal, state, and local laws, codes, and ordinances. Please note that the following items are still outstanding: I. Carteret Borough must adopt an Enabling Resolution using the exact language of the enclosed sample, and return it with the agreements. The Enabling Resolution submitted with the signed Project Agreements (Resolution #05-338) did not contain the required information. For your reference, I have filled in the blank spaces on the sample resolution. 2. Enclosed please find a copy of the previously forwarded Green Acres Account Information form, which must be completed and submitted. 3. The enclosed Dredging Compliance Checklist, which was previously forwarded, must also be completed and submitted. New Jersey is an Equal Opportunity Employer Recycled Paper 4. A Preliminary Assessment Report (PAR) for Carteret Park was submitted for Green Acres project #1201-01-084. Plea8e find enclosed the Green Acres Preliminary Assessment Certification form. This form should be completed for the Carteret Park property for project #1201-01-084 (Carteret Park Improvements) and submitted to my attention. Since the Carteret Park Preliminary A8sessment Report was completed recently, the Certification will also satisfy the PAR requirement for this project (#1201-02-071, Carteret Park Development). 5. All applicable permits ûï letters ûfwâÎver must be submitted. 6. Upon receipt, please forward the Borough Tax Assessor's response to Donald Norbut's request to provide a history of ownership dating back to 1975 for Copperworks Field, Cornell Park, Dolan Homes Playground and Liebig Field. 7. The enclosed Local Public Coutracts Law Memorandum mU8t be executed by the Borough's attorney as it relates to the retention of professional services and construction contracts pursuant to N.J.S.A. 40A:II-l et seq.
