We have been working through conflicts that we encountered with multiple organizations/agencies which resulted in a pause of construction activities over the past few months. We were able to get these conflicts resolved recently so work at this intersection is planned to resume starting this month, weather permitting. The right lane in the northbound direction will be reopened at the completion of concrete work which will take place after the new traffic signal equipment is activated. This is to ensure the work site is kept safe during the duration of construction since the portions of the existing sidewalk were removed for the new traffic signal poles. We’re anticipating the remaining work at the El Camino intersection to take a couple of months to complete. If you would like to stay informed of when work at the El Camino intersection resumes, the best way to stay updated is to sign up to receive our project newsletters through our website. Dear Members of the City Council of Palo Alto, My name is Andrew, a 16 year old, and I use my bicycle as my primary form oftransportation. I am writing to express my support for the proposal to make University Avenue car-free in the downtown area of our city. I believe that this would have numerous benefits forour community, and I hope that you will seriously consider this proposal. First and foremost, making University Avenue car-free would significantly improve the safety of our community. As you are aware, pedestrian and bicycle accidents are a serious issue inour city, and reducing the number of cars on the road would go a long way towards preventing these kinds of accidents. Additionally, removing cars from University Avenue would make thearea much more pleasant and enjoyable for pedestrians and cyclists, encouraging more people to walk and bike, which would further improve safety. Instead of making the road a promenade restricted from bicycle access, like on CaliforniaAvenue, University Avenue should be open to cyclists as a thoroughfare. Another benefit of making University Avenue car-free is that it would improve air quality in our downtown area. Cars are a major source of air pollution, and reducing the number of carson the road would significantly improve the air quality in our city. This would be especially beneficial for the health of children, who are particularly vulnerable to the negative effects ofair pollution. Furthermore, making University Avenue car-free would be good for businesses in the downtown area. By creating a more pedestrian- and cyclist-friendly environment, we wouldencourage more people to come to the downtown area and visit local businesses. This would be especially beneficial for small, locally-owned businesses, which often struggle to competewith large chain stores. On-street parking can be transformed into outdoor dining for restaurants. In conclusion, I strongly believe that making University Avenue car-free in the downtown areaof our city would be a positive step for our community. It would improve safety, air quality, and the local economy, and I urge you to give serious consideration to this proposal. We (family of 4) bike along that corridor weekly and really appreciate the additional safety the bike lanes have provided. It is especially exciting to see the improvements at the Charleston/El Camino intersection lately. I’ve always felt like I was playing a live game of Frogger as I biked across that intersection. Some may have noticed that the USGS flow curves I have been sending out for San Francisquito Creek reduced the flowvalues shown by about 1050 cfs just before noon yesterday. The reason is that they recalibrated what is called the "ratingcurve" for the creek gauge. The "rating curve" relates the height of the water at the gauge structure to the flow rate throughthe gauge. This has to be recalibrated from time to time to account for changes in the channel near the gauge, such asvegetation or other things affecting the channel cross section (see this link). For us, an adjustment of -1050 cfs is a big deal in that the reported flow at ~9:00 AM yesterday dropped from 7400 cfs to6350 cfs after the recalibration, i.e., from a level above the 1998 flow of record to a flow more in line with the amount ofoverflow we experienced during the day. The USGS does not indicate in any obvious way in the chart when they makesuch an adjustment, which means we have to be very careful in judging the absolute values given for the flow rates overtime in terms of when overflow at a downstream location such as the P-C bridge. On the other hand, the USGS applies thecalibration changes retroactively so that the relative flow rates over time in the graphs have meaning. We know that more rain events are forecast for the coming week. To help you think about what might happen, the plotbelow is the current best estimate (as on noon today) the NOAA river modelers have for the magnitude of the comingevents relative to what we have just gone through. The bumps for Mon/Tue and Wed/Thu are expected to be significantlysmaller. However, the ground is now saturated and weather forecasting is an approximate science despite marveloussatellite observers. Dear City Council members, This morning at about 2:30 AM on January 1, I was awakened by allowedsecurity alarm going off at Toyota of Palo Alto. I Called Palo Alto Police Dispatch. He sent out police officers. I called back at about 4 AM asking what the status was, since the alarm was still ringing. The dispatcher said the police officers had indeed found that the Toyota of PaloAlto alarm was the offending alarm. When I asked what was happening to get the alarm turned off, The dispatcher said that they tried to contact the name listed for Toyota… but that the number wasdisconnected. When I ask what that meant, the dispatcher said that there was nothing they can do. Since it’s January 1, I asked if we had to listen to this alarm ringing for over24 hours, until Toy Auto employees return to the dealership? The dispatcher said yes. Surely there’s got to be somewhere the city can get Toyota to turn this off. Toyota has been presenting alarm problems for years. Well the last year or so has been decent, it’s hard to comprehend that the PA PD can do nothing to turn thealarm off. That’s all we can do is wait until Toyota decides to turn it off. What sort of help or guidance can you give those of us affected by this alarm ringing? Help! My call was answered promptly and professionally both times. A few minutes after my am call, a patrol car drove down our street. PAPD Officer Yolanda Franco-Clausen was driving the car, and she was professional, informative, and courteous. She helped use the vehicle’s loudspeaker to inform neighbors about the rising waters, and she briefed us neighbors outside on the status of the local area. I appreciate the public service of our Palo Alto sworn officers and staff, especially on New Year’s Eve in the middle of a storm with creeks overflowing. I fell twice today -- slipped on the silt into the muddy flood waters while I spent over 3.5 hours out in the rain trying to keep the storm water drain clear of endless bits oftanbark. 10 a.m. to 1:30 p.m. The City of Palo Alto folks who stopped by (police and others) did absolutely nothing, other than block off the street an hour plus too late. Nice. Today, only my garage was flooded, and my driveway is contaminated with slippery silt. Can we please agree that governmental processes and environmental processes arethe slow-moving, bureaucratic menace which they are -- for example, the San Francisquito creek flood abatement project, the Anderson Dam project etc etc etc.? What we have here is 25 years of collective, governmental incompetence. Without infringing on Apple's trademarks can we please append "I" to the governmentagencies involved -- with "I" being for Inept more than Incompetent, but I'll let you choose as between the two well-earned epithets. So now, may I please refer to you as the I City Council of Palo Alto, and Valley Wateras I Valley Water? You will be hearing more from me on this -- and I write today in my personal capacity. You may also hear more from me in my capacity as the current President ofthe Santa Clara County Farm Bureau because of my farming experience in the South part of the County for the past 23 years and my election to that position only a month ago. The hills around 280 and Stanford and Arastradero are bald. No vegetation, no trees, no orchards, no vineyards, no farming, and only three golf courses to help absorb the excessive, fast-falling rain. The City of Palo Alto actually has a ban on planting sequoias. And restrictions on sod, natural grass in favor of the damn tanbarkthat clogs storm drains. How brain-dead is that? Over the past 60-70 years, the City of Palo Alto has replaced apple orchards, plum orchards and other trees with homes, cement and asphalt. The carbon foot print of Palo Alto and degradation of the environment is at the highest level - and has been a gradual debauched and dissolute conversion of the Valley of Hearts Delight into the Silicon Valley of HP, Mark Zuckerberg, Kleiner Perkins and other such folks. Silicon Valley and the City of Palo Alto are to be faulted for their promiscuous money-making and brain-dead purportedly pro-environment policies. For example, the City of Palo Alto is awash in groundwater. But it gets 100% of its water from Hetch Hetchy!!! For the past 60 years, the City of Palo Alto has stoppedfarming and stopped almost entirely groundwater pumping which is a grotesque over- reaction. My pleas to the City of Palo Alto on this for the past decade have fallen on deaf ears. Palo Alto's policies are contrary to our California history -- namely, pump wells during droughts and let them replenish during wet years. Now there is injection well technology. Now farmers are slowly being appreciated for carbon sequestration, groundwater replenishment AND FLOOD CONTROL. Please get with the program and recognize the menace of GOVERNMENTALISM and FAKE ENVIRONMENTALISM: 1. Allow and encourage planting of trees and farming -- sequoias, orchards, vineyards, soccer fields with natural grass, golf courses. . . and in fact outlaw tanbark and fake grass that heat the soil, radiate heat and twist ankles and knees of football and soccer players and fail to biofilter dog shit and bird shit etc. 2. Complete the flood control project concerning San Francisquito Creek. 3. Encourage the planting of all trees, including Sequoias 4. Make some, judicious use of Palo Alto's abundant groundwater especially for irrigation including farming, soccer fields, golf courses and home lawns. As of 5:00 PMit registers 5730 cfs which is right about at the capacity of the P-C bridge. The bridge gauge, assuming it is now working again, registers 23 ft out ofthe 24 foot overflow level. At this stage I think almost all the rain falling in the watershed is going to be coming down the creek. Remember that aflow value at the USGS gauge will hit P-C about 45 minutes later. Nature is playing with us by sitting right on the overflow brink. It is best that youprepare for some additional overflow tonight. Sandbag entrances if you can. Move any valuable assets from low spots in your house and yard tohigher areas. Make sure you have a survival kit and transportation ready to go if evacuation is called. A note on the brighter side is that the NOAAriver modeling group still predicts an end to the rain and a peak flow this evening below the new record level this morning (see second plot below). The upgrade of the creek must take place prudently and sequentially, starting from downstream in the Hwy 101 to the bay reach (to protect East Palo Alto and its residents) and then proceeding to the upstream reaches (Hwy 101 to Pope-Chaucer and Middlefield, and then in the creek origins involving Searsville Dam and other detention options). I think not enough notice and commendation has been given to the great progress already made to actually finish the Hwy 101 to bay reach several years ago so that we can focus on the upstream parts. And finally, 25 years is a long time and during this period there has been turn-over of key personnel that introduced further delays in getting new staff on board and up to date. This event, while causing unfortunate anxiety and upset to those whose homes were threatened by the muddy SFC waters, is probably a prescient message from nature that says "I'm here as potent as ever and am not swayed by droughts or climate change or foibles of human decision-making or red tape -- you better pay attention!". For my part, I have been at this since ~2000 and will keep pressing for what I think is an outstanding plan for containing the flood threat from the creek while maintaining its natural ambience. Schiavone Document Type Article Abstract In the past several years, the city of Pittsburgh, Pennsylvania has seen two canine police dogs (K-9s) killed in the line of duty, Rocco in January 2014, and Aren in January of 2016. Both were killed by stab wounds while attempting to apprehend suspects. The man who killed Rocco received significant jail time for stabbing and killing the dog, while the man who killed Aren was fatally shot as a direct result of his actions toward the canine. While Rocco was vocally celebrated in the community, and sympathy primarily focused on the canine, the deaths of Aren and the suspect who killed him, Brian Kelley, Jr., led to a very PLUMX METRICS different response. In the aftermath of the 2016 incident, there was significant vocal outcry from a variety of advocates (for both humans and animals) concerning the injustice of using K-9 officers to apprehend suspects and calling for a ban on such practices. Certainly, Pittsburgh’s experiences are not unique, although they present a vivid backdrop for the discussion of whether K-9s should be used for apprehension of suspects and under what circumstances. This Article explores the legal and ethical questions surrounding the use of police dogs, specifically in the realm of apprehending suspects where a violent interaction between human and canine is inevitable. The Fourth Amendment allows the use of canine force against persons if “reasonable” under the totality of the circumstances, based on the officer’s observations. However, that totality of circumstances does not take into account the very real and very reasonable fear response induced in humans by an animal attack, that in some cases compels the suspect to defend themselves and thus places the suspect at risk for further violence, and the police dog at risk for injury or death. Further, while any suspect may be compelled to resist or defend itself against a police dog, the historical use of police dogs against African Americans, coupled with the deployment of police dogs more frequently in minority communities, may tend to put African Americans at greater risk in this “K-9 catch-22.” Ultimately, this Article considers the question of whether, in light of human behavioral fear response to animal attacks coupled with examples of implicit racial bias, using police dogs in apprehension is ever truly “reasonable.” Repository Citation Schiavone, A. However, local, targeted programs can make a difference to those who are housing insecure. Who are the people experiencing homelessness in our community? They are often familiar faces—the grocery cashier, a child whose parents are fighting to stay in the school district, the person sitting next to you in your place of worship. The 2022 Point in Time (PIT) Count and 2022 San Mateo County One Day Homeless Count and Survey recorded 274 individuals in Palo Alto, 169 individuals in East Palo Alto, and 56 individuals in Menlo Park who are facing homelessness. When we put numbers to the problem, solutions seem more plausible. PACF invests in local housing solutions Thanks to the generosity of our donors, in 2021 and 2022 Palo Alto Community Fund (PACF) proudly awarded grants totalling $560,000 to 14 local nonprofits working tirelessly everyday to help those who need shelter. Affordable Housing Factory in East Palo Alto United Hope Builders (UHB) is a new social enterprise aimed at addressing all three barriers to affordable housing in Northern California: cost of construction, availability of land, and political will. UHB was founded by Pastor Paul and Cheryl Bains and is a majority BIPOC managed entity. The Bains’ also co- founded WeHOPE, a leading provider of shelter and services to unhoused individuals in the Bay Area, and headquartered in East Palo Alto. UHB has received two larger Dave Mitchell Impact Grants from PACF, one in 2021 for $50,000 and another in 2022 for $75,000. Our grants helped fund a new East Palo Alto modular housing factory, which broke ground this past July, paving the way to create 100 high-quality, local jobs with profit sharing and produce 400 modular housing units a year. One of UHB’s most innovative and mission-critical strategies involves working with nontraditional landowners to address the challenge of securing workable, affordable locations for these modular single and multi-family homes. “I believe that none of us is as strong as all of us, and I truly believe that we’re better together than we are a part. I am so glad that we have this relationship with Palo Alto Community Fund because without them I think we would be further back than where we are.” - Pastor Paul Bains Homekey Palo Alto In August of 2022, LifeMoves, in partnership with the City of Palo Alto, was awarded $26.6 million in State funding to expand services for the unhoused in Palo Alto through an innovative transitional housing facility which includes wraparound services. PACF is honored to be a part of this journey with LifeMoves through a $100,000 Dave Mitchell Impact Grant. We committed this grant in December of 2021, pending State project approval, in support of the Homekey Palo Alto application for State Homekey funding. Located at 1237 San Antonio Road in Palo Alto near the Palo Alto Baylands, Homekey Palo Alto will provide a dignified transitional step for unhoused residents on the path to stable housing. LifeMoves will develop this interim housing shelter with 64 individual units and 24 family units—supported by comprehensive on- site services.
