McCall City Council
Special Meeting and Joint Public Hearing
with the Board of County Commissioners, Valley County, Idaho
May 8,1995
Call to Order and Roll Call
1. The meeting was called to order at 7:30 PM by Mayor Martens,
2. Mrs. Arp, Messrs. Colton, Martens, Killen and Eckhardt answered the roll call. Additionally,
Commissioners Wallace, Olson, and Gestrin answered a roll call by Chairman Olson.
Public Hearing on Proposed Ordinance 670 amending Title III of the McCall City Code
3. The mayor noted that it was time and place of the public hearing.
4. Mr. Shimun gave a report on the development of the ordinance.
5. Mr. Burton reviewed the amendments in detail.
6. Mayor Martens then called for public testimony. The following were heard:
Bill Hardin related that he and his group had attended many meetings and the proposed
ordinance represented a number of compromises that resulted in an ordinance that was
satisfactory.
Duane Smith noted the proposed east -side connector and noted that Elo Road and Samson Trail
could be a part of that connector. He further described the need for industrially zoned property
and that poor planning had resulted in a number of subdivisions with substandard lot sizes and
urged the council and the board to look ahead in developing these policies.
7. Since no one else wished to be heard, the mayor closed the hearing to public comment.
8. Robert Williams, Deputy County Procescuting Attorney presented some concerns of the county
with respect to application of the ordinance in the Area of City Impact.
a. Public Roads. Mr. Williams read the comments of the County Engineer requesting
additional clarification of the ordinance which currently requires paving only where the county
would require paving.
b. References to areas ripe for annexation per the Comprehensive Plan, when the
Comprehensive Plan is not current.
c. Noted that references to sureties provided to the city should also include the county for
development in the Area of City Impact.
d. Noted a problem with jurisdiction in that the council can sit in the quasi-judicial role
with respect to zoning in the Area of City Impact, it had no legislative authority.
9. Mr. Killen related a number of his concerns:

a. Noted that the ordinance prohibited changes to sediments, pollutants, etc to Payette
River Basin. He suggested that improvements to these should be encouraged and permitted.
b. Noted that the ordinance broadened the Conditional Use Permit provisions in the
Industrial Zone. His concern was broadening the provisions might lead to industrially zoned
land being used for other purposes.
c. Suggested that the word "immoral" be removed from the sign ordinance since this term
relates to a personal value system, not a legal one and that the terms remaining were adequate.
10. Mr. Colton suggested the preparation of an informational brochure.
11. Mr. Martens suggested the preparation of a photo book with good and bad examples of signs.
12. Mr. Eckhardt stated that banners and pennants should be defined.
13. Staff was instructed to coordinate with Mr. Williams and to resolve these concerns. Mr. Echardt
then moved to suspend the rules requiring reading Ordinance 670 in full. Mr. Killen seconded.
At a roll call vote Messrs. Eckhardt, Killen, Martens, Colton and Mrs. Arp voted "aye." Mr.
Burton read the ordinance by title.
Adjournment
14. There being no further business, Mr. Colton moved to adjourn. Mr. Martens seconded and the
motion carried unanimously.
