The Site Plan was approved as presented and recommended by the Architectural Review and Planning Board with the following conditions: 1. The Construction Traffic Management Plan submitted with application shall be followed during the construction. 2. Exterior colors shall comply with the provisions of the Design Manual. 3. The owner must comply all National Flood Insurance Program requirements applicable to the addition. 4. The property owner is requested to bury electrical, cable and phone service lines underground, if possible. 5. The cupola shall be eliminated or redesigned to be more in scale with other cupolas in the area. The Special Exception was approved with the condition that prior to the issuance of a Certificate of Occupancy, the owner shall record a deed restriction requiring that 273 square feet of the front porch and balcony area shall forever remain unenclosed as long as the structure exists. These approvals shall expire on April 6, 2002, if a Building Permit Application, including the aforementioned improvements, has not been applied for. A motion to approve a Level III Architectural Site Plan Review, based on a finding that the proposed plans are consistent with applicable review standards, based on the following conditions. 1. Basis for Recommendation: Special Exception for Roof Projections The proposed floor area exceeds Gulf Stream's FAR limitations by 95 square feet. The owner has requested that this be approved using Section 70- 72(b), "Special Exception Floor Area for Roof Projections." Staff recommends approval of the special exception for the following reasons: 1) The design meets the review standards, including compatibility with the architectural style, being less than 300 square feet over the FAR cap, and not resulting in a more massive appearance. 2) The special exception enables a more attractive design, by mitigating the bulk of the second stof garage addition. 3) Removing \the unenclosed balcony area would result in a less attractive desigi), Minimum Flood Revation The existing home 's below the 7' elevation required by the F od Insurance Rate Map (FIRM) for this area . s such, the home may not be improved ' excess of 50% of the existing home's value. Up to 2,500 square feet of floor area may be permitted on any legally established lot of record of 7,576 square feet or less, subject to the following: (1) Maximum floor area. The maximum floor area is 2,500 square feet. (2) Specific standards for review. Site and structural design elements including, but not limited to: a. Height of the structure relative to neighboring structures; b. The location, number and size of windows, doors, porches, balconies and outdoor lights; C. The location of patios and walkways; and d. The location, size and types of hedges, walls and fences shall provide a level of privacy to occupants of both neighboring properties and the proposed structure equal to or greater than that provided if the proposed structure size conformed with the applicable floor area ratio. (b) Roof projections. Up to 300 square feet of roof projections (covered, unenclosed floor areas) may exceed the maximum permissible FAR. subject to the following: (1) Maximum floor area. The maximum floor area in excess of FAR is 300 square feet. One or more roof projections may be approved under this special exception provided the total floor area of all projections does not exceed the maximum permitted FAR by more than 300 square feet. (2) Specific standards for review. a. The roof projection(s) shall be compatible and complementary to the architecture of the structure and shall add appropriate architectural detail and relief to a facade. b. The roof projection(s) shall not make the structure look more massive. C. The total floor area of the roof projections shall not exceed the maximum permissible FAR by more than 300 square feet. d. For each one square foot of roof projection over the maximum permissible FAR, two additional square feet of roof projection must be provided that are within the maximum permissible FAR, and all shall remain forever unenclosed. e. Prior to the issuance of a certificate of occupancy or certificate of completion, the owner of the property shall prepare and record a deed restriction which, at a minimum, shall provide that all roof projection areas required to remain unenclosed as per approval of this special exception shall remain so for as long as the structure is in existence or exceeds the maximum permissible FAR. Thresher: Since our discussion relative to retaining the first one inch o� rainfall on the referenced property by utilizing a Swale Ilaround the perimeter, I respectfully submit the follow.�ng information: 1. 2. M This Company has reviewed the situation and I have had another Engineering Company give me their opinion and basically arrived at the same conclusion. Retaining the first inch of rainfall on the property utilizing a Swale is not feasible since the only available area is in the rear. The sides have the Septic Area and Covered Slabs. IAn exfiltration system could be installed in the rear iof the property, however the design and installation possibly up to $ 10,000. with any type to relatively quite difficult. ;would be very expensive, Also, access to the rear heavy equipment would be 4. 'Drainage to the nearest Catch Basin is easily ,accomplished by moving by dirt. 5. ITh( question has arisen as to why the retention is !required since the total addition increases the lot ,coverage by less than 8t. Apparently storm water retainane was not necessary when the original ;construction was performed. 6. As an exception to the Town's Rlght -of -Way Policy, Town residents who own property in the vicinity of an active construction site will be permitted to Install white (or painted dark green) capped PVC pipes, 36" above grade along the front of their property, 2' from road's edge. These pipes should be approximately 9' apart. The maximum pipe size shall be 2" in diameter. The pipes snail be removed immediately following the issuance of Certificate of Occupancy for the construction site.
