Present: Council Members John Ferris, Ann Thies, Philip Zietlow and Mayor Anne Theis. Absent: Council Member James Johnson. Also Present: Police Chief Richard Rabenort, Public Works Director Jim Dillman, City Engineer Shawn Gustafson, City Attorney Ron Batty and Clerk -Treasurer Jeff Karlson. 1. ADDITIONS TO AGENDA Moved by Mayor Theis, seconded by Zietlow, to approve the addition of the following agenda items: 1. Petition for Improvements of Medina Road 2. Report on Trunk Highway 12 Policy Committee Meeting 3. Loretto Contract for Police Protection Motion carried unanimously. 2. CONSENT AGENDA Moved by Thies, seconded by Mayor Theis, to adopt the consent agenda as follows: 1. Resolution No. 93-82, "Resolution Granting a Permit to Minnegasco for the Installation of Buried Cable" 2. Resolution No. 93-83, "Resolution Granting a Permit to U.S. West for the Installation of Buried Cable" 3. Resolution No. 93-84, "Resolution Granting a Conditional Use Permit to Kelly's Wrecker Service at 760 Tower Drive" 4. Resolution No. 93-85, "Resolution Granting a Conditional Use Permit to Ginger Hallbeck and Michelle Hutton for a Home Occupation at 242 Medina Road" 5. Resolution No. 93-86, "Resolution Granting an Amended Conditional Use Permit to Adam's Pest Control, Inc." 6. Resolution No. 93-87, "Resolution Granting a Height Variance to Richard Burke for 3962 Tomahawk Trail" Motion carried unanimously. 3. MINUTES Moved by Zietlow, seconded by Ferris, to approve the minutes of the regular meeting of November 2, 1993, as amended, as follows: Page 5, paragraph 6, line 1, to read, "Batty said the ordinance had dealt with aesthetics in the past." Page 9, paragraph 5, delete police officer salaries and add the following notation: "Police officer salaries are subject to union negotiations." 192 Page 10, paragraph 2, line 1, to read, "...operating budgets increased at a much lower rate than Hamel's." Motion carried unanimously. 4. ORONO YOUTH BASEBALL ASSOCIATION Board Member Randy Bosma of the Orono Youth Baseball Association requested that the City of Medina contribute $5,000 toward the development of two new baseball fields on a 12-acre site at the corner of Old Crystal Bay Road and County Road No. 6. Bosma said the land was owned by the Orono School District and would be leased by the Youth Baseball Association. Bosma said the new fields were necessary because of the increasing number of boys and girls participating in the baseball and softball programs. He added that the Association would continue to use the field at Bederwood Park in Orono. Bosma said the entire project cost was estimated at $94,000, which included backstops, fences, a 40-space parking lot, roadway, excavation, and some playground equipment. The Association would be responsible for maintaining the fields and would carry $1,000,000 in liability coverage. Bosma said 57 Medina residents belonged to the Orono Youth Baseball Association. The Park Commission heard the Association's request for funds at their October 20, 1993 meeting and recommended that the Council approve a $5,000 contribution from the Park Fund in lieu of the City of Medina pursuing new fields in the south section of the city and contingent upon the following: (1) the Association will not come back to the city in the future and request funds for the maintenance of the fields; and (2) the city obtain a copy of the land agreement between the Orono Youth Baseball Association and the Orono School District. Council Member Zietlow said the only thing that disturbed him was the separation of the boys and girls' programs. He said he opposed the concept of boys and girls playing in separate sports and would like to see them playing the same sports. Moved by Ferris, seconded by Zietlow, to approve the Park Commission's recommendation --with two contingencies --that the City contribute $5,000 from the Park Fund to the Orono Youth Baseball Association for the development of two new baseball fields. Motion carried unanimously. 5. PARK COMMISSION RECOMMENDATIONS The Park Commission recommended that the council approve $1,000 in expenditures for tree plantings at Maple Park. Public Works Director Dillman said he would purchase bare root stock in the spring and plant the trees at Maple Park. Nyles Gentz, chairman of the Park Commission, said he would work with Dillman to develop a walking trail to Maple Park. 193 The Park Commission also had recommended that the City Council reimburse the Hamel Legion for the annual property taxes on the Hamel Legion Memorial Park beginning in 1994 until the City acquires the property. The property taxes amounted to 658.86 in 1993. City Attorney Ron Batty said he was uncomfortable with the idea of the city paying taxes on private property. The council rejected the Park Commission's recommendation of having the city reimburse Hamel Legion for its property taxes on the Hamel Legion Park. Nyles Gentz said the Hamel Uptown Business Association was concerned about the City's slow progress in acquiring land for the expansion of Hamel Memorial Park. He said several Hamel residents were wondering if the Hyberg property had been sold. Gentz said it was difficult to move the Hamel park project along without knowing what the status of the Hyberg property was. Council Member Thies said the problem was not that the Hyberg property was no longer available. She said the problem was the appraisals which were done on the Hyberg and Finazzo properties which were 50% higher than two years ago. Thies recommended that the council direct the Park Commission to look into other pieces of property that might be available. The council directed Nyles Gentz to have the Park Commission look for alternative sites for the park and to get some reaction from the Hamel area residents. The council asked Gentz to come back with the results of the park commission's findings to the December 7, 1993 meeting. 6. ADOPTION OF ASSESSMENT ROLLS FOR CO. RD. 116 SEWER AND WATER IMPROVEMENT Moved by Thies, seconded by Ferris, to adopt Resolution No. 93-88, "Resolution Adopting Assessment Roll for County Road 116 Trunk Sanitary Sewer Improvement." Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None. Resolution No. 93-88 adopted on a 4-aye and 0-nay vote. Moved by Thies, seconded by Ferris, to adopt Resolution No. 93-89, "Resolution Adopting Assessment Roll for County Road 116 Trunk Water Main Improvement." Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None. Resolution No. 93-89 adopted on a 4-aye and 0-nay vote. 7. ADOPTION OF RESOLUTION CERTIFYING DELINQUENT UTILITY BILLS Moved by Mayor Theis, seconded by Thies, to adopt Resolution No. 93-90, "Resolution Certifying Delinquent Water, Sewer and Recycling Charges to the Hennepin County Auditor for Collection." Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None. Resolution No. 93-90 adopted on a 4-aye and 0-nay vote. 194 8. STATUS REPORT OF FISCAL CONSULTANT Clerk -Treasurer Karlson said that Jeanne Vanda wished to meet with the council to talk about her new position with Public Financial Management, Inc. as a senior managing consultant. Vanda was working at Ehlers and Associates, Inc. where she acted as the city's fiscal consultant before resigning from the company in July, 1993. Moved by Mayor Theis, seconded by Thies, to direct Clerk -Treasurer Karlson to contact Jeanne Vanda and request that she appear at the December 7, 1993 council meeting at which time the council will consider the appointment of Vanda as the City's financial advisor. Motion carried unanimously. 9. REPORT ON T.H. 12 POLICY COMMITTEE MEETING Council Member Ann Thies gave a report on the Trunk Highway 12 Policy Committee meeting held October 20, 1993. Thies said the Minnesota Department of Transportation had identified an alternate connection for segment G of the T.H. 12 project that bypasses the Wayzata Country Club. Thies said Mn/DOT was providing detailed maps for each city which would be available at the November 19, 1993 meeting. Thies added that she would not be able to attend this meeting. Council Member Ferris agreed to attend the next meeting and pick up the maps. 10. PETITION FOR IMPROVEMENT OF MEDINA ROAD Council Member Zietlow said he received a petition from property owners requesting that a portion of Medina Road be paved west of Tamarack Drive. City Attorney Batty pointed out that this section was part of Phase III of the Medina Road Improvement Project which extended from Tamarack Drive to County Road 24. Batty said it would cost the city more to complete Phase III because the assessments that could be levied would be disproportionate to the number of residents assessed in Phase II of the project. Zietlow said the residents along the western section of Medina Road opposed the improvement project when it was proposed in 1992. Council Member Ferris said the council should get an update on what it would cost to pave the remainder of Medina Road from Brockton Lane to County Road 24. The council directed City Engineer Shawn Gustafson to obtain a cost estimate for paving the remainder of Medina Road from Brockton Lane to County Road 24. The council agreed that an assessment hearing could be held January 18, 1994. 195 Moved by Zietlow, seconded by Ferris, to adopt Resolution No. 93- 91, "Resolution Calling for Preparation of an Updated Feasibility Report and for a Public Hearing on the Assessment for the Improvement of Medina Road and Preparation of Proposed Assessment." Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None. Resolution No. 93-91 adopted a 4-aye and 0-nay vote. 11. LORETTO CONTRACT FOR POLICE PROTECTION City Attorney Batty pointed out two changes in the police contract with Loretto. Batty said he changed the language in Paragraph 7 to read "Consumer Price Index for the Twin Cities metropolitan area (CPI-W)" and in Paragraph 12 which states that either party must give 15-month written notice of its intention to terminate the contract. Moved by Ferris, seconded by Thies, to approve the "Contract for Police Protection" between the City of Medina and the City of Loretto with the changes in Paragraphs 7 and 12. Motion carried unanimously. 12. 1993 BUDGET Police Chief Rabenort pointed out that the November 2, 1993 minutes listed the salaries of the police officers as being approved. Rabenort said the police officers salaries should not be included in the motion approving the 1994 salaries for city employees since the officers were still negotiating on a new contract with the union. Moved by Ferris, seconded by Thies, to amend the minutes of November 2, 1993 by excluding the police officers from the list of approved salaries and adding a notation that the officers salaries are subject to union negotiations. Motion carried unanimously. PAYMENT OF BILLS Moved by Thies, seconded by Ferris, to approve payment of Order Check Numbers 12562-12626 for $238,553.50 and Payroll Check Numbers 13628-13647 for $15,685.65.
