COUNCIL MINUTES
APRIL 17, 1973
INITIATION:
1. Mayor Briggs called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, April 17, 1973, in the Council
Chambers of the City Hall.
2. The invocation was given by Elder Blaine Bender, Pastor,
Reorganized Church of Jesus Christ of Latter Day Saints,
9458 Broadway, Temple City.
3. The Pledge of Allegiance to the Flag was led by Mayor Briggs.
4. ROLL CALL:
Present: Councilmen- Dennis, Gilbertson, Merritt, Tyrell, Briggs
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin,
Planning Director Dragicevich, Parks and Recreation
Director Kobett, Traffic Engineer Envall
5. APPROVAL OF MINUTES:
Councilman Merritt moved to approve the minutes of the regular
meeting of the City Council held on Tuesday, April 3, 1973,
seconded by Councilman Gilbertson and unanimously carried.
The 29th Annual Camellia Festival Committee, Ray Gudie, General
Chairman, was given recognition by Mayor Briggs who presented a
special certificate to the group. Mr. Gudie discussed the involvement
of the entire community in the Camellia Festival activities and
introduced the chairmen present, as well as Margie Calamia, Secretary
for the past 12 years, and incoming general chairman for the 30th
Annual Camellia Festival.
Mayor Briggs welcomed the St.: Luke s:7th.grade California History
class who were present in the audience.
6. REORGANIZATION OF COUNCIL:
Prior to the reorganization of the Council, Mayor Briggs
expressed appreciation for the support given him this past
year by the Council, Commissions, staff and community, stating
that it had been a real pleasure and privilege to serve the
community as Mayor.
At this time the City Clerk assumed the Chair and opened
nominations for the office of Mayor for the coming year.
Councilman Briggs nominated Jack Tyrell for the office of Mayor
and moved that a unanimous:ballot be cast for Councilman Tyrell.
The motion was seconded by Councilman Merritt and unanimously
carried.
Mayor Tyrell assumed the chair and expressed appreciation to former
Mayor Briggs for the work done this past year. He presented
a plaque to Councilman Briggs in recognition of the community
leadership and service he had given in the interest of community
progress during his term as Mayor.
Mayor Tyrell called for nominations for the Office of Mayor Pro
Tem. Councilman Gilbertson nominated William Dennis for the
office of Mayor Pro Tem and moved that a unanimous: ballot be
cast for Councilman Dennis. The motion was seconded by Council-
man Briggs and unanimously carried.

City Attorney Martin advised that certain appointments must be
confirmed by resolution, and presented Resolution No. 73 -1279
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPOINTING ALTERNATE DIRECTOR OF COUNTY SANITATION DISTRICT
No.15, and Resolution No. 73 -1280 entitled A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPOINTING
A MEMBER OF SAID COUNCIL OF SAID CITY TO THE R.T.D. CTTY SELECTION
COMMITTEE PURSUANT TO PART 3 OF DIVISION 10 OF THE PUBLIC"UTI "LITIES
CODE for adoption. Councilman Gilbertson moved to adopt
Resolution No. 73-1279 confirming appointment to L9s Angeles County
Sanitation District, and Resolution No. 73 -1280 confirming
appointment of member for R.T.D. City Selection Committee, seconded
by Councilman Briggs and unanimously carried.
UNFINISHED BUSINESS:
7. ORDINANCE No. 73 -369: 2nd read. Re. Proposed Amendment to Temple
City Municipal Code re. Operation of Fireworks Stands.
City Attorney Martin presented Ordinance No. 73 -369 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 3118 OF THE
TEMPLE CITY MUNICIPAL CODE RELATING TO THE SALE OF FIREWORKS.
Councilman Merritt moved to waive further reading and adopt,
seconded by Councilman Gilbertson and unanimously carried.

8. ORDINANCE No. 73 -370: 1st read. Re. Proposed Amendment to Temple
City Municipal Code Relating to Off - Street Parking in R -3 and R -4
Zones (Res. 73- 485PC)
City Manager Koski advised that public hearing had been held on the
matter of proposed amendment to Temple City Municipal Code relating
to off - street parking in R -3 and. R.L. zones, as set forth in Planning
Commission Resolution No. 73 -485PC on April 3, 1973, following which
the Council :instructed the City Attorney to prepare appropriate
ordinance with a modification to include one open parking space for
each three units instead of for each four units, and referred to
the Planning Commission for concurrence. Planning Commission
recommendation or concurrence however had been deferred pending
further study.
City Attorney Martin presented Ordinance No. 73 -370 entitled AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING
SECTIONS 9291 AND 9363 OF THE TEMPLE CITY MUNICIPAL CODE RELATING
TO OFF- STREET PARKING REQUIREMENTS for first reading, by title only
Councilman Briggs cloned to waive further reading, seconded by Mayor
Tyr.el:l. and carried, Councilman Dennis reserving the right to vote
NO on second reading and adoption.
9.. LEASE AGREEMENT: City -owned Property, 5843 Temple City Boulevard.
City Manager Koski advised that lease had been prepared for 3 year
lease, beginning April 15, 1973, with option to renew for a period of
2 years, to be exercised prior to March 1976,. with Wolfe Fainblit of
Dayton Furniture Company, in the amount of $300 per month payable
in advance for City -owned property at 5843 Temple City Boulevard,
and that an additional responsibility of the City, that of maintaining
the roof, was now spelled out in the lease. Councilman Merritt moved
to approve the lease for the period of three years, with option to
renew for two -yaar term as set forth in memorandums of April 11 and
April 17, 1973, and to authorize the Mayor and City Manager to sign
the lease agreement, seconded by Councilman Briggs. The motion
carried on a roll call vote of four to one, Councilman Gilbertson
voting NO, stating that he did not wish to see the property tied up
for the five year period.
NEW BUSINESS:
10. LEASE AGREEMENT: City -owned Property, 5601 Gracewood,
City Manager Koski advised that transfer of ownership of property
at 5601 Gracewood, to the City of Temple City, was effected on
April 3, 1973, and that Mr. and Mrs. Heyde, former owners had made
an offer to lease the property for $250 per month, on a month -to-
month basis, and that rental agreement had been prepared. Councilman
Merritt moved to approve as set forth, and to authorize the City
Manager to sign on behalf of the City, seconded by Councilman Dennis
and unanimously carried.
11. PARKS & RECREATION COMMISSION RECOMMENDATION - Meeting of April 4, 1973.
OUTDOOR CONCERT - TEMPLE CITY PARK, Sunday, May 6, 1973
City Manager Koski advised that the Parks and Recreation Commission
had recommended granting request for outdoor concert in northwest
section of Temple City Park on Sunday, May 6- ,._1973, from 2 to 4 p.m.,
subject to "Conditions of Park Use" to be signed and adhered to by
applicant. He advised that subsequent to the recommendation, the
Temple City Jaycees have offered to sponsor the band concert, provide
the necessary insurance coverage and chaperone the event. Councilman
Gilbertson moved to approve the request for outdoor band concert
in Temple City Park, to be held Sunday, May 6, 1973 from 2 to 4 p.m.,
sponsored by the Temple City Jaycees, subject to necessary insurance
coverage, chaperones and signed application for use of park and
"Conditions of Park Use" by the sponsoring group, seconded by
Councilman Briggs and carried.

12. TRAFFIC COMMISSION RECOMMENDATIONS - Meeting of April 4, 1973:
A. BICYCLE LICENSING ORDINANCE:
City Manager Koski advised that the Traffic Commission recommended
adoption of County Ordinance No. 3027 as an interim ordinance
until June 1975, requiring the licensing of bicycles within the
City unt i 1 AR 22.13 providing for the licensing of bicycles by the
Department of Motor Vehicles becomes effective. He stated further
that County Ordinance No. 3027 had been amended on April 10, 1973,
effective May 11, 1973, providing for increase cost of license from
50 to 75, decreasing the licensing period to 3 years, and setting
expiration of license upon transfer: of ownership. He advised that
Ordinance No. 73 -371 had been prepared to adopt the County Ordinance
by reference, and that public hearing would need to be set for such
adoption.
City Attorney Martin presented Ordinance No. 73 -371 entitled AN
ORDINANCE OF THE CITY OF TEMPLE CITY ADOPTING BY REFERENCE COUNTY
OF LOS ANGELES ORDINANCE No. 3027, for first reading by title only
Councilman Merritt moved to waive further reading and to set for
Public Hearing on May 1, 1973, seconded by Councilman Briggs and
unanimously carried.
B. EXTENSION OF ON- STREET PARKING REGULATIONS - Lemon Avenue,
North Side, Easterly of Oak Avenue.
City Manager Koski advised the Traffic Commission recommended
that in view of existing restrictions presently posted on Lemon
Avenue in the vicinity of the high school and the availability of
parking facilities at the High School, that additional parking
restrictions on the north side of Lemon Avenue; easterly of Oak, would
benefit those property owners who have been inconvenienced by student
parking. Councilman Merritt moved to approve placement of "No Parking
7 a.m. to 5 p.m. School Days Only" restrictions on Lemon Avenue,
westerly from the school porperty to a point 137 feet east of the east
curb line of Oak Avenue, as set forth in memorandum of April 6, 1973,
seconded by Councilman Gilbertson and unanimously carried.
13. PLANNING COMMISSION RECOMMENDATION - Meeting of April 10, 1973:
CLARIFICATION OF AMBIGUITIES - Furniture Upholstery.
City Manager Koski advised that the Planning Commission had adopted
Resolution No. 73- 495PC, recommending clarification of ambiguities
in the Temple City Municipal Code concerning furniture upholstery
1) Retail sale of upholstery fabrics and supplies and retail sale
of rugs and carpets, except cleaning of carpets, shall be regarded
as permitted uses in the C -1 zone, and
2) Furniture repair and upholstery shall be regarded as permitted
use in the C -2 zone.
Councilman Gilbertson moved to confirm the clarification of the
ambiguity as set forth in Planning Commission Resolution No. 73 -495
by minute order, seconded by Councilman Dennis, and unanimously
carried.
14. RESOLUTION No. 73 -1277: Employment of Personnel.
Councilman Gilbertson moved to adopt Resolution No. 73 -1277
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING PERSONNEL, seconded by Councilman Briggs and unanimously
carried.
15. RESOLUTION No. 73- 1278: WARRANTS & DEMANDS, Demand Nos. 7649 thru
7727, in the Amount of $27,854.11.
Councilman Briggs moved to adopt Resolution No. 73 -1278 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING
CLAIMS AND DEMANDS IN THE SUM OF $27,854.11, DEMAND NOS. 7649 THRU
7727, seconded by Councilman Gilbertson and unanimously carried.

16. COMMUNICATIONS:
A. Michael E. Beardsley, 9077 Olive Street - Damage Claim
A communication dated April 5, 1973, from Michael E. Beardsley,
9077 Olive Street, Temple City, submitting claim for damage to
camper which struck limb of parkway tree on Monday, April 2, 1973.
Councilman Gilbertson moved to deny and to refer to the City's
insurance carrier, seconded by Councilman Merritt and unanimously
carried.
B. Howard Cassriel and William K. Graham, 9612 -14 Las Tunas Dr.,
- Request for Encroachment Permit.
An application for encroachment permit for properties located at
9612 -14 East Las Tunas Drive, on the south side between Camellia
Avenue and Temple City Boulevard, to permit a brick facia along
7 feet of frontage which would encroach upon the public right -of-
way approximately 4 inches was received. Councilman Merritt moved
to approve, subject to signing and recording of necessary covenant
regarding real property, seconded by Councilman Gilbertson and
unanimously carried.
17. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
Marianne Milch, Executive Secretary, Chamber of Commerce, expressed
appreciation to Mayor Briggs and the City Council for their support
over the past ten months, and her willingness to assist when the
need arises.
Penny Graham, Member of the Board of Directors, Temple City Chamber
of Commerce, expressed appreciation for the cooperation of the
past year, and the courtesies that had been extended by Mayor Briggs
during the busy year; and offering the services of the Chamber to
Mayor Tyrell in the coming months.
Margie Calamia, Incoming General Chairman for the Temple City
Camellia Festival, expressed appreciation for the help given her
the past 12 years while serving as Secretary to the Camellia Festival.
Billie Galardi, 9235 Sparklett, and 7th grade student, St. Luke's
School, expressed appreciation on behalf of the class to attend the
Council meeting to learn more about City government.
Michael E. Beardslee, 9077 Olive Street, inquired as to why his
damage claim was denied. He was advised that the matter of damage
claim was not settled at Council level, but that the City's
insurance carrier was now the agency to contact in regard to the claim.
18. MATTERS FROM CITY OFFICIALS:
A. Conference Attendance - 1973 Calchapter, American Institute
of Planners, Oakland, CA - May 9 -12, 1973.
City Manager Koski presented a request for attendance of George
Dragicevich, Planning Director, to attend 1973 Calchapter Conference
of American Institute of Planners, to be held in Oakland, California,
May 9 -12, 1973, with attendant expenses paid, as set forth in
memorandum dated April 10, 1973. Councilman Gilbertson moved to
approve, seconded by Councilman Merritt and unanimously carried.
B. Conference Attendance - Ontario Youth Conference, Concord, CA
May 11 -13, 1973.
City Manager Koski advised that the Youth Commission, at their
regular meeting held on April 11, 1973, recommended authorization
from the City Council for two commissioners to attend California
Youth Coalition meeting to be held in Concord,May 11 713, 1973, the
cost to include room for two, days, plus mewl and travel allowance.
Councilman Briggs moved to approve and authorize expenditure in an
amount not to exceed $266, and to amend the adopted budget accordingly,
seconded by Councilman Merritt and unanimously carried.

C. PREVENTIVE MAINTENANCE PROGRAM - RESURFACING
FY 1972 -73
A. GOLDEN WEST AVENUE
B. SULTANA AVENUE
C. GARIBALDI AVENUE
D. WORKMAN AVENUE
Council concurred in a program of preventive maintenance for
the above listed streets and the schedule for resurfacing as
set forth in memorandum dated April 17, 1973. Total estimated
cost for the work is $30,900.
D. SPHERE OF INFLUENCE
City Manager Koski advised that the City had been involved
since February 1972 in attempting to establish spheres of
influence for annexation to the City, pursuant to state law.
He advised that the Local Agency Commission had adopted a sphere
of influence for the City on April 11, 1973, which was further
described by map, and that annexation efforts could now be
initiated.
E. Councilmen Merritt, Gilbertson and Dennis expressed
appreciation to Councilman Briggs for his fine leadership and
help during the past year while serving as Mayor for the City.
F. Councilman Gilbertson reported on his attendance of a
graduation class of the Sheriff's Acadamy, stating that the
City's representation at these ceremonies lends support to the
crime prevention program we are presently undertaking with the
Sheriff's Department.
G. Councilman Dennis reported on the election for representative
for RTD City Selection Committee, at which election Adeline Gregory
of Baldwin Park was elected to serve on the Committee for
Corridor D.
H. City Manager Koski thanked Councilman Briggs for the
accomplishments of the past year, and pledged his support and
that of the staff to assist Mayor Tyrell in carrying out the
responsibilities of City government.
19. ADJOURNMENT:
On motion of Councilman Briggs, seconded by Councilman Gilbertson
and unanimously carried, the meeting ".adjourned.at'8:32 p.m. Next
regular meeting of the Council will be held Tuesday, May 1, 1973,
at 7:30 p.m. in the Council Chambers of the City Hall.
