HomeMy Public PortalAboutA2009-06-23-CC-URGENCY ORD.#1614REPORT ON MEASURES TAKEN TO ALLEVIATE THE CONDITIONS THAT LED TO THE ADOPTION OF URGENCY ORDINANCE NO. 1614 June 23, 2009 On May 19, 2009, the City Council adopted Urgency Ordinance No. 1614 establishing a moratorium on the approval of applications and permits to construct, modify, or place wireless communication facilities. The City Council further directed staff to develop comprehensive and appropriate revisions to the City's Zoning Ordinance including, but not limited to: (a) reviewing current developments in federal and state court decisions interpreting the Telecommunications Act of 1996 and California Public Utilities Code Section 7901 et seq. and the California Legislature's adoption of Senate Bill 1627 in 2007, adding Sections 65850.6 and 65964 to the Government Code, pertaining to collocation of wireless communication devices; (b) meeting with industry representatives, interested parties, and residents for input into amendments to the Lynwood Municipal Code pertaining to regulations on antennas and wireless communication facilities, and (c) drafting proposed amendments that are consistent with recent developments in federal and state laws pertaining to telecommunication and wireless communication facilities. Immediately upon the adoption of Urgency Ordinance No. 1614 and in order to address the existing conditions that led to the adoption of the Ordinance, City staff initiated the following efforts: • Initiated discussions with current wireless communication facilities applicants and industry representatives to address concerns and develop guidelines for regulation of wireless communication facilities within the City; and • Assigned the City Attorneys' office to research allowable regulations upon wireless communication facilities and draft proposed amendments to City's Zoning Ordinance; and • Held meetings with representatives of the City Attorneys' office, Public Works Department, and Planning Department to discuss such proposed regulations.
