ORDINANCE NO. 1177
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE
AMENDING SECTION 10.60.020 (SPEED LIMITS DESIGNATED) OF CHAPTER
10.60 (SPEED REGULATION) OF TITLE 10 (VEHICLES AND TRAFFIC) OF THE
RANCHO MIRAGE MUNICIPAL CODE
WHEREAS, the California Vehicle Code provides for local jurisdictions to
establish speed zones on public streets within the boundaries of the loca l jurisd iction ;
and
WHEREAS, pursuant to California Vehicle Code Section 40802, for enforcement
authorities of the local jurisdiction to be able to use radar or other electron ic
enforcement an Eng ineering and Traffic Survey must be prepared every five (5), seven
7), or ten (10) years or when significant changes in the roadway or traffic cond ition s
have occurred, including , but not limited to, changes in adjoining property land use ,
roadway width or traffic volume; and
WHEREAS, the City Council desires to protect the health, safety, and welfare of
its citizens by reestablishing the speed zones on the public streets identified in Municipal
Code Section 10.60.020 in conformance with California Vehicle Code Section 40802 for
the orderly movement of traffic and for enforcement purposes thereon; and
WHEREAS, pursuant to California Vehicle Code Section 22357(a), the City
prepared an Engineering and Traffic Survey in April of 2017 which the City Counci l
approved on June 15, 2017; and
WHEREAS, the City of Palm Desert recently comm issioned a citywide
Engineering and Traffic Survey for Palm Desert which included analysis of roadways
that span the boundary between Rancho Mirage and Palm Desert, including Dinah
Shore Drive , between Miriam Way and Monterey Avenue; and
WHEREAS, the Palm Desert Traffic Survey concluded that "the critica l speed [for
Dinah Shore Drive from Miriam Way to Monterey Avenue] is 45 mph , which is 5 mph
below the posted speed limit" and recommended "that the speed limit be lowered to 45
mph ... to maintain a consistent speed limit with adjacent segments to the east"; and
WHEREAS, the City may amend or otherwise modify or replace section s of the
Rancho Mirage Municipal Code in a manner that furthers the interests of the City in
protecting the health, safety and welfare of its citizens and individuals within its
boundaries; and
WHEREAS, the City Council has found and determined that amendment of
Municipal Code Section 10.060.020 is exempt from the California Environmental
Quality Act ("CEQA") pursuant to Title 14 of the California Code of Regulations
Sections 15061(b)(3) and 15378 .

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
MIRAGE, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. RECITALS
That the recitals set forth above are true and correct.
Section 2. PURPOSE AND INTENT
That the purpose and intent of this Ordinance is to protect the health , safety, and
welfare of the citizens of the City of Rancho Mirage and of the individuals within its
boundaries, by reestablishing the speed zones on the public streets identified in
Municipal Code Section 10.60.020 pursuant to the Palm Desert Engineering and Traffic
Survey, dated November 23, 2021, for the orderly movement of traffic and for
enforcement purposes thereon.
Section 3. AMENDMENT TO SECTION 10.60.020 (SPEED LIMITS
DESIGNATED) OF CHAPTER 10.60 (SPEED REGULATION)
OF TITLE 10 (VEHICLES AND TRAFFIC) OF THE RANCHO
MIRAGE MUNICIPAL CODE
That Section 10 .60.020 (Speed Limits Designated) of Chapter 10.60 (Speed
Regulation) of Title 10 (Vehicles and Traffic) of the Rancho Mirage Municipal Code is
hereby amended as follows :
10.60.020 Speed limits designated.
Pursuant to Vehicle Code Section 22357, the city has prepared eng ineering and
traffic surveys for speed limits dated May 1, 2008 , November 6, 2012 , February 21, 2013,
and April 22, 2017, and has relied upon the Palm Desert engineering and traffic survey
dated November 23, 2020, and estab lishes the following speed limits:

Section 4. CITY ATTORNEY REVIEW
That the City Attorney prepared and framed this ordinance pursuant to Section
1.04.010 of the Municipal Code and finds that the City Council has the authority to adopt
this ordinance, that the ordinance is constitutionally valid, and that the ordinance is
consistent with the general powers and purposes of the City as set forth in Section
1.04.031 of the Municipal Code.
Section 5. SEVERABILITY
That the City Council declares that, should any provision, section, paragraph,
sentence, or word of this ordinance be rendered or declared invalid by any final court
action in a court of competent jurisdiction or by reason of any preemptive legislation, the
remaining provisions, sections , paragraphs , sentences or words of this ordinance as
hereby adopted shall remain in full force and effect.
Section 6. REPEAL OF CONFLICTING PROVISIONS
That all the provisions of the Rancho Mirage Municipal Code as heretofore
adopted by the City of Rancho Mirage that conflict with the provisions of this ordinance
are hereby repealed.
Section 7 . CEQA
This ordinance is exempt from environmental review under the general rule in
California Environmental Quality Act (CEQA) Guidelines Section 15061 (b )(3) that CEQA
only applies to projects that have the potential for causing a significant effect on the
environment.
As a very small reduction in speed limit on a single stretch of roadway, it can be
seen with certainty that there is no possibility that the ordinance will have a significant
effect on the environment.
Section 8. EFFECTIVE DATE
That this ordinance shall take effect thirty (30) days after its second reading by
the City Council.

Section 9. CERTIFICATION
That the City Clerk sha ll certify to the passage of this ordinance and shall cause
the same to be published according to law.
