This is a Post -construction Subterranean Termite Repair and Retreatment Service Contract ( "Contract") between Killingsworth Pest Control, ("Pest Control
Company") and Department of Public Services, Wayne Steele ("Customer"). This Contract only covers the structure(s)specifically listed and identified above
(Structure(s)). This Contract does not cover detached garages, out buildings, fences, decks or other buildings, construction or improvements to the property located at
the service address of Structure(s),'unless specified in writing on this Contract. This Contract is void and of no legal effect unless approved by the management of Pest
Control Company.
For a fee of $ 1230.00, plus all applicable taxes, and subject to the general terms, limitations, exclusions, disclaimers and conditions provided within this
Contract, Pest Control Company will protect Structure(s) from and repair new damage caused by Native Subterranean Termites (Reticulitermes) and Formosan
Subterranean Termites (Coptotermes Formosanus) collectively ("Subterranean Termites"), aerial infestations excluded, for a period of one (1) year. The payment of
this fee shall be made as follows: Will pay in full, $1280.00, upon receipt of invoice.
Protection will be provided by applying a liquid termiticide treatment below and/or around the first floor level of the Structure(s). Retreatments with a liquid termiticide
may be necessary during the period of this Contract and will be provided at no additional cost to the Customer. Should an infestation of Subterranean Tertnitee occur
in, on or under the Structure(s) while this Contract is in effect, a liquid treatment shall be applied to the soil in the area of infestation. Customer is responsible for
notifying Pest Control Company of signs of termite activity or anything unusual between reinspection periods or during the course of the Contract so action may be
taken to prevent reinfestation or damage to Structure(s).
The treatment provided under this Contract was originally intended to:
® Prevent an infestation of Subterranean Termites.
❑ Correct an existing infestation of Subterranean Termites.
Pest Control Company will perform a visual inspection of the Structure(s) on an annual basis. The inspection will be of readily accessible areas only. The inspection
will not cover areas that are enclosed, inaccessible or concealed by wall coverings, floor coverings, furniture, equipment, stored articles, nor any portion of the
Structure(s) in which the inspection would necessitate removing or defacing any part of Structure(s), such as areas with insulation. Pest Control Company will not open
any walls, remove any floor coverings or move any fumiture, equipment or other obstructions during the inspection to access or inspect any portion of the Structure(s).
Customer acknowledges and accepts that this visual inspection of the readily accessible areas of the Structure(s) is a reasonable inspection for the purposes of this
Contract. Customer understands and agrees that any inspection of Structure(s) undertaken by Pest Control Company and any representations, statements or reports
made by the inspector or Pest Control Company about the inspection or Structure(s) should not be construed as an opinion, guaranty, warranty or promise regarding the
structural integrity or soundness of the Structure(s) nor as an opinion, guaranty warranty or promise of the presence or absence of subterranean termites or other wood
destroying organisms or damage to any portion of the Structure(s)
Customer may renew this Contract for an additional four (4) years by paying an annual renewal fee of $ 350.00, on or before each anniversary date of this Contract.
For purposes of this Contract, the parties agree that "anniversary date" is defined as that day that falls exactly one year from the date of treatment set forth above.
Customer's failure to pay the renewal fee in accordance with this Contract render this Contract void, but shall not relieve Customer from the obligation and requirement
to provide payment for all amounts due and owing pursuant to this Contract. Pest Control Company reserves the right to adjust the renewal fee upon written notice
given to Customer within thirty (30) days prior to the anniversary date of this Contract. Customer has the right to terminate this Contract upon receipt of Pest Control
Company's written notice of an increase in the annual renewal fee. Such notice of termination must be made in writing and provided to Pest Control Company no later
than ten (10) days before the anniversary date of this Contract. Upon conclusion of this contract, termite treatment is required for post construction contract.
By signing this Contract, Customer certifies that Customer has read and fully understands all disclaimers, limitations, conditions and exclusions contained on
the front and back of this Contract that affect Pest Control Company's obligation to repair or re -treat the structure(s). Customer specifically understands
that Pest Control Company and Customer are bound only by the terms of this Contract and not by any other representation(s) oral, written or otherwise.
GENERAL TERMS AND CONDITIONS
PEST CONTROL COMPANY AND CUSTOMER AGREE TO THE FOLLOWING TERMS AND CONDITIONS:
1. SPECIFIC EXCLUSIONS
Customer agrees that this Contract does not cover and Pest Control Company shall not be responsible or liable for any of the following:
a. Damage resulting from any form of insect, pest, or wood -destroying organism other than Subterranean Termites.
b. Damage resulting from drywood termites or an aerial infestation of Subterranean Termites.
c. Damage or bodily injury resulting from moisture conditions, including but not limited to wood -decaying fungi, fungus or mold, whether visible or not.
d. Damage resulting from wood in direct contact with the soil that provides Subterranean Termites with hidden or protected access to the Structure(s), whether
visible or not.
e. Damage resulting from construction defects, structural defects, design defects, masonry failures or grade alterations that disrupt or reduce the effectiveness
of the termiticide treatment or that provide Subterranean Termites with hidden or protected access to the Structure(s), whether visible or not.
Damage and/or remedial treatments resulting from infested wood and/or furniture introduced into Structure(s) after initial treatment.
Personal expenses, such as lodging, meals, transportation, etc., or reimbursement for loss of quiet enjoyment, loss of use or diminution in value of the
Structure(s) that arose as a result of any treatment, retreatment and/or damage repair.
