HomeMy Public PortalAboutORD-CC-1979-02Ordinance No. 2-79 An Ordinance acknowleging the legality of the subdivision of the lot owned by Jim Huizingh, and permitting the issuance of a building permit with respect thereto. Be it Ordained by the City Council of the City of Moab County of Grand, State of Utah, in council session Tuesday, September 18, 1979, that: Whereas, the petitioner Jim Huizingh has by deed of conveyance succeeded to the title of the property described on exhibit "A", and Whereas, the petitioner has diligently worked with the City Council for a period in excess of one year to remove certain questions as to the legality of the subdivsion of his lot aforesaid, and has been unable to fully meet the criteria therefor, and Whereas, the City Council acknowledges the good faith efforts of the petitioner and does not wish to subject him to undue hardship, but is agreeable to authorizing a building permit respecitng the aforesaid property 'subject of certain understandings, Be it Therefore ordained that the lot described on exhibit "A" shall be accepted by the City of Moab as a lawfully subdivided lot, subject to these conditions precedent: (1) The City shall have no responsibility to provide culinary water, or sanitary sewer service to the lot set forth on Exhibit "A". (2) The City shall have no responsibility to maitain access from any public thoroughfare to the aforesaid property. (3) The City shall have no responsibility for insuring that municipal services, such as police, fire, ambulance, or any other service shall have access to said property Be it further directed that a copy of this ordinance and the attached exhibit be recorded in the office of the Recorder of Grand County. Done this 18th day of September, 1979. Exibit "A" attached hereto and incorporated herein as a part hereof. EXHIBIT "A" TO ORDINANCE NO. 2-79 Description of a Tract of Land in Section 1, T26S, R21E, SLBOI. Beginning at a corner which bears North 1974.0 feet and East 861.2 feet from the SW Corner, Section 1, T26S, R21E, SLB$M, GRAND COUNTY, UTAH, and proceeding thence North 200.0 feet with the East line of the Robinson tract to a corner, thence East 224.7 feet to a corner (not set) at a fence line on the West line of the George Simons (Sam Taylor) tract, thence S1°14'W with said fence 202.6 feet to the North side of a lane, thence along said lane N89°21'W 220.4 feet to the point of beginning and contain- ing 1.03 acres, more or less. Bearings arc based on the West line of Section 1 (NO°02'W). This tract is subject to a 10 feet wide ditch easement .along the entire East, West and South boundaries. A 20 feet wide access easement is provided which lies South of and adjacent to the South line and extends West with an existing lane approximately 650 feet from the SE corner to an existing lane.
