Mayor Tyrell called the regular meeting of the City Council to order at 7:35 p.m. on Tuesday, May 1, 1973, in the Council Chambers of the City Hall. 2. The invocation was given by the Reverend Mortimer C. Dean, Pastor, First United Methodist Church, 5957 N. Golden West, Temple City. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Councilmen - Briggs, Dennis, Gilbertson, Merritt, Tyrell Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Planning Director Dragicevich, 5. APPROVAL OF MINUTES: Councilman Gilbertson moved to approve the minutes of the regular meeting of the City Council held on Tuesday, April 17, 1973, as written, seconded by Councilman Briggs and unanimously carried. Girl Scout Troop No. 442, Santa Anita Council, was given recognition by Mayor Tyrell who presented a special certificate to the group. Pam Young, President of the Troop, introduced the members present and told of the activities in which they are involved. With guitar accompaniment by Pam Young, the girls sang a song for the Council and the audience present. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. Re. Bicycle Licensing ORDINANCE No. 73 -371, 2nd read. City Manager Koski reported that proper notice had been made for public hearing to adopt County Ordinance No. 3027, as amended, by reference, and that Ordinance No. 73 -371 had received first reading at a previous meeting of the Council. Mayor Tyrell declared the Public Hearing open and invited those present who wished to speak for or against the matter to come for- ward. No one came forward. Councilman Dennis moved to close the public hearing, seconded by Councilman Merritt and unanimously carried. City :Attorney Martin presented Ordinance No. 73 -371 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADOPTING BY REFERENCE COUNTY OF LOS ANGELES ORDINANCE NO. 3027, for second reading by title only. Councilman Briggs moved to waive further reading and adopt, seconded by Councilman Gilbertson and unanimously carried. 7. ORDINANCE No. 73 -370: 2nd read. Re. Proposed Amendment to Municipal Code Relating to Off- Street Parking in R -3 and R -4 Zones (Res. 73- 485PC) City Manager Koski advised that Council had held first reading of Ordinance No. 73 -370 which modified the Planning Commission recommendation as set forth in Resolution No. 73- 485PC, at their regular meeting of April 17, 1973, and that the Planning Commission had subsequently concurred in the modification, as set forth in memorandum dated April 25, 1973. City Attorney Martin presented Ordinance No. 73 -370 entitled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9291 AND 9363 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO OFF- STREET PARKING REQUIREMENTS for second reading by title only. Councilman Briggs moved to waive further reading, seconded by Councilman Merritt and unanimously carried. Councilman Briggs moved to adopt, seconded by Councilman Merritt and carried by the following roll call vote: AYES: Councilmen - Briggs, Merritt, Tyrell NOES: Councilmen - Dennis, Gilbertson Council Minutes, May 1, 1973 - Page 2 NEW BUSINESS: 8. TRACT No. 27410: APPROVAL OF WATER SYSTEM - RELEASE OF FAITHFUL PERFORMANCE BOND AND SUBDIVISION WATER SYSTEM AGREEMENT (John Marshall) - Oak and Olema City Manager Koski advised that the City Engineer had submitted a recommendation dated April 13, 1973, to: a) approve work that had been completed as required by Subdivision Water System Agreement, Form A- 3C,for Tract No. 27410, and b) to release the Subdivision Water System Agreement between the City and the subdivider and release the faithful performance bond. Councilman Merritt moved to approve, seconded by Councilman Gilbertson and unanimously carried. 9. PARKS & RECREATION COMMISSION RECOMMENDATION - Meeting of April 18„1973.. WADING POOL RULES - LIVE OAK PARK City Manager Koski advised that rules for use of wading pool at Live Oak Park had been reviewed by the Parks and Recreation Commission at their regular meeting held on April 18, 1973, at which time the Commission recommended approval, as set forth in memorandum dated April 19, 1973. He advised that the Junior Womans' Club of Temple City would prepare a'.sign containing the rules to be posted in a conspicuous location, as well as a sign stating "No life guard on duty. Use pool at own risk." In addition, instructions to supervisors and safety precautions had been formulated and recommended for approval, also set forth in memorandum dated April 19, 1973. Councilman Briggs moved to approve the rules to govern the supervision of the wading pool, and the sign as recommended, seconded by Councilman Merritt and unanimously carried. Councilman Gilbertson moved to approve the instruction to supervisors, seconded by Councilman Briggs and unanimously carried. In reviewing the safety precautions, Item 3 on page 1, which stated that the wading pool is to be swept thoroughly each morning was revised to read that the pool was to be thoroughly cleaned each morning in order to provide for necessary hosing when sweeping may provide insufficient cleaning. Councilman Briggs moved to approve the safety precautions as revised, seconded by Councilman Gilbertson and unanimously carried. 10. RESOLUTION No. 73 -1281: Employment of Personnel Councilman Gilbertson moved to adopt Resolution No. 73 -1281 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by Councilman Dennis and unanimously carried. 11. RESOLUTION No. 73 -1282: WARRANTS &DEMANDS, Demand Nos. 7728 thru 7845 in the Amount of $124,242.16. Councilman Gilbertson moved to adopt Resolution No. 73 -1282 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $124,242.16, DEMAND NOS. 7728 THRU 7845, seconded by Councilman Dennis and unanimously carried. 12. COMMUNICATIONS: A. Knights of Columbus, Council 3073 of Arcadia and Temple City, Requesting Conditional Use Permit for Property Located at 9677 Las Tunas Drive. City Manager Koski presented a communication from the Knights of Columbus Council 3073 of Arcadia and Temple City, requesting a Conditional Use Permit on property located at 9677 E. Las Tunas Drive. Councilman Briggs moved to refer to the Planning Commission for investigation and response, seconded by Councilman Merritt and unanimously carried. Council Minutes, May 1, 1973 - Page 3 B. William Schmidt, Principal, Oak Avenue School - Re. Student and Law Program. City Manager Koski presented a request from William Schmidt, Principal, Oak Avenue Intermediate School, for the City to again participate in providing for Student and Law Program for 7th grade students at Oak Avenue, in the amount of $5,000. Mayor Tyrell directed that the communication be received and referred to the budget sessions. C. Robert L. Saddoris, 5570 Ryland Avenue - re. Permission to Extend Block Wall at Live Oak Park, to be Donated to City. City Manager Koski presented a communication from Robert L. Saddoris, 5570 Ryland, dated:April 18, 1973, in which Mr. Saddoris proposed to build an extension of a block wall on Live Oak Park property which would also provide an attractive fencing to his property adjacent to the park; the portion to be constructed to be donated to the City and all City'requ:irements: regarding the construction would be adhered to. City :Attorney Martin advised there was no legal objection. Councilman Briggs moved to approve the construction of the extension of block wall on Live Oak Park property as set forth in letter of April 18, 1973, from Mr. Saddoris, at no cost to the City, subject to City requirements regarding construction, and the donation to the City of the completed wall,. seconded by Councilman Dennis and unanimously carried. D. Los Angeles County Fire Department - re. Amendment to County Building Code to require newly constructed buildings over three stories be provided with automatic sprinkler systems. City Manager Koski presented a communication from the County of Los Angeles Fire Department requesting support of a new fire safety requirement for which public hearings were held on April 30, 1973, to consider enactment of an ordinance. The new ordinance would require all newly constructed buildings over three stories in height be provided with automatic sprinkler systems. Councilman Briggs moved to refer the communication to the Planning Commission, seconded by Councilman Merritt and unanimously carried. E. Mrs. A. K. Van Oorschot, 5100 N. Ardenel Ave. and Boyce F. O'Bannon, 10316 E. Olive Street, re. excessive air traffic to El Monte Airport. City Manager Koski advised that communications had been received from Mrs. A. K. Van ,Oorschot, 5100 N. Ardenel Avenue,and from Boyce F. O'Bannon, 10316 E. Olive, complaining of annoying air traffic over their homes to the El Monte Airport. He advised that because the City of Arcadia and the City of El Monte are also reviewing the problems of air traffic, that data had been gathered for Council consideration, which included rules and regulations for the El Monte Airport, Airport Layout Plan, City of Arcadia proposed resolution, and correspondence from members and president of the San Gabriel Valley Airport Association. Mayor Tyrell declared a recess at 7:58 p.m. in order for the Council to review the data concerning airport traffic. Mayor Tyrell reconvened the meeting at 8:10 p.m., and invited those present in the audience who wished to discuss the matter to come forward. Boyce E. O'Bannon, 10316 E. Olive, addressed the Council urging consideration of the Arcadia City resolution proposed by Mr. Helms particularly in regard to proposed left hand turn pattern in order to bring the aircraft along the San Gabriel River and 605 Freeway, and urged that an environmental impact report be made in regard to the airport. He expressed fear of the airport becoming more heavily used and of jets being permitted to take off and land there. Council Minutes, May 1, 1973 - Page 4 William A. Harker, 9956 Broadway, past president and member of the San Gabriel Valley Airport Association, stated that he hoped the discussion regarding the problem would not become emotional as it had in the City of Arcadia, and that while his home is in the path of air traffic, he also owned an airplane so was concerned from both sides of the issue. He advised that he knew of only two instances of jets landing at the facility, one of which was because of mechanical problem. He stated that jet fuel would be needed at the facility for turbine powered helicopters and turbo prop,plenes'such as-Golden.,West might use; also that the 605 Freeway was too far away from the tower and is outside the ability for the tower to keep track of planes. Mrs. Harry Sheibel, 10317 E. Olive, stated that she was not against airplanes since she had flown since 1936, however that the traffic over her home is excessive, sometimes as close as 5 seconds apart. She also described the repetition of the same plane going over home repeating as often as four times in ten minutes. She stated that in her viewpoint the following steps should be taken: 1) No more taxpayer money be put into the airport until an environmental study was made, 2) controls be put on future growth and noise, particularly- on flying schools, 3) the plane numbers be placed on the underside rather than on the fuselage, 4) that hours for instructional school at airport be held to Monday thru Friday, 7 a.m. to 7 p.m., and 5) if possible, move flying schools out where there isn't so much population. Ray Carter, 2508 Fairgreen, Monrovia, opposed the view that controls be placed on flying schools in that it interfered with free enter- prise. He also felt there was a need for more airports. Mrs. Clements, 5330 Arden Drive, inquired if it is possible to enforce the 1300' minimum ceiling, and if so and there were no jets to land there, she felt there was no problem. Monica Godley, suggested that the pattern be widened to distribute the noise so that it isn't always coming over the same homes. Tom Walker, President of the San Gabriel Valley Airport Association answered inquiries of Mayor Tyrell as follows: 1) That there is no measurement or device in the tower to accurately judge the heighth at which a plane is flying, and that detection..of.,altitude violation by viewing would probably not be sufficient to support a citation, and 2) That to his knowledge there would be a record of violations issued to pilots, however there would probably be no way of segregating them, that it would be the F.A.A. who would have to be contacted.. Mr. Walker stated that with regard to the 1300° minimum ceiling now in effect, this was recently increased and. places the aircraft at approximately 900' above ground. He stated that many planes ..have radio. altimeters. He discussed the traffic patterns as they are now in effect and the improbability of changing the pattern to left hand turn because of lack of visibility from the tower when the traffic was heavy. He reported that Flood Control Channels provide safety valves and this area is well suited for the pattern as it is now, and discussed the need for uniformity of approach for pilots. Harry Sheibel, 10317 E. Olive, suggested that pilots be required to go farther out to make the approach, or that some planes approach from the different pattern to distribute the noise. Don Miller, 1775 Orangewood Lane, Arcadia, Vice President of the San Gabriel Valley Airport Association, elaborated on pattern of approach, the need for visibility from the tower, and the use of jet fuel for helicopters and other planes such as turbo - props, stat- ing that there are regulations against pure jet operations. He stated the pilot must maintain 1300' until he turns on final. Following the testimony and discussion, Councilman Briggs moved to refer the matter to staff for study in order to determine if the Council can make some controls, seconded by Councilman Merritt and unanimously carried. 9 Council Minutes, May 1, 1973 - Page 5. 13. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: A. B. J. Thompson, 8918 E. Live Oak, addressed the Council to the effect he felt there was a lack of progress in the Community Redevelopment Project for Rosemead Boulevard. He was advised that the disposition and development agreement was currently being reviewed and that there would be a meeting on May 8, 1973, after: which progress could commence. B. Mrs. Robert Cheney, 10305 Olive Street, inquired if the street light scheduled to be placed in front of her home could be dispensed with since they did not wish so much light to be directed into their home at night. She was advised that her communication on the same matter had been received, and that it had been discussed with the Edison Company who advised that a shield could be placed on the street light which would eliminate 90% or more of the illumination on her property. Mrs. Cheney advised that this was agreeable to her, and that if there are problems from too much light she will again contact the City staff to determine if some other solution is necessary. COUNCIL RECESSED 'AT9':27;p.m. TO MEET AS THE COMMUNITY REDEVELOPMENT AGENCY. All members being present, the Community Redevelopment Agency approved the minutes of the regular meeting of March 6, 1973, adopted hearing procedures in accordance with Government Code Section 65804, and received a status report on the Rosemead Boulevard Redevelopment Project dated May 1, 1973, and adjourned to May 8, 1973, at 7:30 p.m. The minutes of the CRA are set forth in full in the records of that Agency. COUNCIL RECONVENED AT 9:30 p.m. 14. MATTERS FROM CITY OFFICIALS: A. City Manager Koski advised there was a series of publications available regarding the burglary prevention program in order to acquaint the public. B. City Manager Koski advised that the Parks and Recreation Depart- ment was being decentralized from the City Hall, and would be relocated at the Pentland Yard facility on Friday, May 4, 1973. C. City Manager Koski presented a request to purchase two desks and two chairs needed in the security center which is a part of the City -wide burglary prevention program. Councilman Briggs moved to authorize the purchase of desks and chairs as outlined and to amend the adopted budget accordingly, seconded by Council- man Merritt and unanimously carried. D. Councilman Merritt called attention to the need for maintenance of the alley north of Las Tunas, between Cloverly and Primrose which was referred to staff. 15. ADJOURNMENT: Councilman Briggs moved to adjourn to a study session with the Parks and Recreation Commission at 9:35 p.m., seconded by Mayor Tyrell and unanimously carried.
