RESOLUTION NO. 94 -3310
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPROVING ZONE VARIANCE 93 -1190, A REQUEST BY VINCE
MAICHROWICZ TO PERMIT THE CONSTRUCTION OF A SECOND -
STORY ADDITION WHICH WOULD INCREASE THE TOTAL LIVING
AREA TO 2,779 SQUARE FEET (INSTEAD OF THE MAXIMUM
PERMITTED SQUARE FOOTAGE OF 2,500 SQUARE FEET) AND
WOULD ALLOW THE APPLICANT TO MAINTAIN A TWO CAR
GARAGE (INSTEAD OF THE REQUIRED THREE CAR GARAGE FOR
A FIVE BEDROOM DWELLING) IN THE SINGLE FAMILY (R -1)
ZONE.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon public input received at a noticed public hearing before the Planning
Commission and based upon additional information provided in the Staff Report, and based upon testimony
received before the City Council at a noticed continuation of public hearing on March 1, 1994, the City
Council hereby approves Zone Variance 93 -1190 based upon the following findings:
1. That there are exceptional and extraordinary circumstances or conditions applicable to the
property involved or to the intended use of such property which do not generally apply to other
properties in the same zone in that the subject property is situated on a corner location, abutting
a major thoroughfare; the existing development, including the location of the garage, precludes
complying with the Code; and
2. That such variance is necessary for the preservation and enjoyment of a substantial property right
possessed by other properties similarly situated but which is denied to the property in question
in that the subject property is less than the minimum lot size of 7,200 square feet and existing
improvements on the lot make it quite difficult to add additional square footage or provide
additional garage parking, and
3. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to adjacent or neighboring properties in that the proposed addition to the house is
designed in such a way as to minimize visual impact from the streets. Furthermore, other two
story structures exist in the vicinity and it is likely that existing single story dwellings will be
improved within the vicinity as time goes on; and
4. That there are special circumstances as provided in Section 65906 of the California Government
Code in that the subject property is situated on a corner and is developed with a ninety -eight foot
long driveway which can accommodate several cars parked in tandem, but precludes the possibility
of providing additional garage parking.
SECTION 2. This project is not inconsistent with the General Plan, and is categorically exempt
from CEQA.
SECTION 3. Accordingly, Zone Variance 93 -1190 is approved, subject to the review and approval
of the construction plans.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution and enter
it into the book of original resolutions.
