CALL TO ORDER AND ROLL CALL
Mayor Muller called the regular meeting of the McCall City Council to order at 5:00
pm. Ms. Arp, Mr. Muller and Mr. Colton answered roll call. A quorum was present. City
staff members present were City Manager Robert Strope and Deputy City Clerk
Consuelo Blake.
BUSINESS
AB 01-44 J-Ditch Resolution 01-05
Mr. Robert Strope presented resolution 01-05 for Council approval. Employers
Insurance of Wausau, the surety, has chosen option 4.2 of the Performance Bond and
has requested that the Council adopt a resolution reaffirming that the City of McCall will
pay for completion of the project under the J-Ditch contract. Mr. Strope clarified that
payments would be made to the surety as required by the bond and that the surety
would then pay the subcontractors. Mr. Strope also covered the issues of liquidated
damages to cover additional engineering and legal fees, the contention of start dates
between the City of McCall and St. Clair contractors, and assured Council that the
process for all pay applications would remain unchanged.
Marilyn Arp moved adopt Resolution 01-05, to enter into an agreement to pay in
accordance with the terms of the contract with Employers Insurance of Wausau
and to authorize the Mayor to sign. Ralph Colton seconded the motion. At a roll
call vote, Ms. Arp voted aye, Mr. Colton voted aye, and Mr. Muller voted aye. The
motion passed.
ADJOURNMENT
Without further business, Mr. Eimers moved to adjourn. Ms. Arp seconded the motion.
All Council Members voted aye. The motion carried. The Council adjourned at
5:30pm.
