Present: Mayor, Thomas Anderson; Councilmembers, lilliam Reiser, Sarah Lutz, Wilfred Scherer Thomas Crosby; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Police Chief, Charles Hoover; Engineer, Paul Pearson; Attorney, Richard Schieffer 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following additional items: Loren Leuer bill in connection with Hamel sidewalk project Storm windows on city hall EPA Grant time extension for Medina Morningside sewer project Burlington Northern agreement for Medina Morningside project 2. MINUTES OF NOVEMBER 3, 1981 Motion by Reiser, seconded by Crosby to accept minutes of November 3, 1981, as presented. Motion declared carried 3. M DINA MORNINGSIDE SEWER PROJECT Change Order # 1 Paul Pearson presented the following recommended changes to the Medina Morningside project: (1) Use of Class 5 Gravel in lieu of Class 4 Gravel as subbase with a deduction of lin in depth of material, cost is Grant eligible but should not change from original estimate. (2) Restoration of drainage ditch on Willegalla property ( Lot 1, Block 4). Cost not Grant eligible, estimated to be $3269. (3) Addition of two flared end sections to storm sewer pipes, cost not Grant eligible, estimated to be $1160. Total cost of change orders to be $4429. Motion by Scherer, seconded by Crosby to approve Change Order #1 as recommended by Engineer. Motion declared carried Burlington Northern Agreement Paul Pearson reported that agreement prepared by Burlington Northern Railroad includes access to railroad right-of-way and easement for Long Lake by-pass. Fee proposed to be charges is $750. per year, on a continuing basis, subject to cancellation on 30 days notice. The fee would cover use of right-of-way and damage oharges for one-half mile. Richard Schieffer stated that under the terms of the Orono -Long Lakej'ledina agreement Orono would pay 63.6% and Medina 36.4% of the fee. Richard Schieffer stated that he would review and investigate the agreement and report his findings at the December 1st meeting. Thomas Crosby stated that the City of Orono should become involved in the agreement. EPA Grant Paul rearson presented Amendment # 1 to the EPA Grant which would allow extension of the budget period until August, 1982, as that date would coincide with the sewer project contract. Motion by Crosby, seconded by Lutz to request approval of Amendment # 1 of EPA Grant, extend- ing budget period for Step 3 work of the Medina Morningside sewer project to August, 1982. Motion declared carried 4. PLANNING AND ZONING DEPARTMENT Steve Muth Paul Pearson reviewed his letter regarding investigation by McCombs -Knutson of the struct- ural conditions of Mr. Muth's road that had been built off of Arrohead Dr. to the east. He stated that the road was constructed in 1979 and gravel depths and width of road at 100 ft. intervals were inspected. He reported that the rook depths varied from 4 to 8 inches and that the oul de sac is approximately 80 ft. in diameter and that the road does not meet city specifications for minimum road width. He also noted that the ditch on the north side of the road needs restoration. Richard Schieffer stated that the city would need to consider the road under 1979 specifications. Steve Muth stated that he had Lyle Swanson of McCombs -Knutson inspect the road before the contractor had been paid. Thomas Crosby asked what it would cost to bring the road to city specifications. Paul Pearson ciculated material and labor at approximately $3000. Sarah Lutz asked about the need for a larger cul de sac. Wilfred Scherer stated that Ron Duran, Public Works Director, had recommended a 100 ft. cul de sac, as currently required, due to difficulty encountered in snow plowing. Steve Muth stated that he did not believe he would need to enlarge the cul de sac if the 1979-80 requirement was 80 ft. and road width was 24 ft. He stated that the contractor would have to return and apply additional rock to the roadway if it did not meet the 1979 requirements as he had asked Mr. Swanson, at a City Council meeting,if the road was acceptable, and apparently it is not recorded in the minutes. Mr. Sehieffer stated that a road is not considered a city road until the Council accepts on the recommendation of the city engineer and the minutes would have recorded such action. Motion by Scherer, seconded by Lutz to table the request of Steve Muth to accept his road as a city street pending Mr. Muthts discussion with his contractor regarding bringing the road to 1979 city specifications. Motion declared carried Meadowwoods Farm, Entrance Monument Jim Johnston, representing Meadowwoods Farm, appeared to request a site triangle variance to enable the placement of an entrance monument on either side of Meadowwoods Tr. He stated that the structure would be 6 ft. high, at the tallest point and landscaping with trees and shrubbery would complete the project. JaEllen Harr reported that she, the engineer and public works director had agreed that the smaller size monument located at a slightly different angle would be acceptable. Motion by ,.Reiser, seconded by Scherer to grant a clear view site triangle variance to allow the placement of an entrance monument to Meadowwoods Tr. according to revised plans. Hardship being the slope of the property behind the proposed trees and with the condition that maintenance of the areas are the responsibility of owners of Lot 1, Block 1 and Lot 1, Block 2. -Motion declared carried Meadowwoods Farm, Bond Jim Johnston requested release of a portion of the bond that had been posted for street construction within the Meadowwoods Farm plat. Paul Pearson presented a letter recommending that the city retain a bond in the amount of $20,000 to cover remaining work on Meadowwoods Tr. Motion by Crosby, seconded by Lutz to release the $10,000 bond that had been posted for work on Cherokee Rd. and $140,000 of the $160,000 bond that had been posted for work on Meadowwoods Tr. Motion declared carried Meadowwoods Farm, Street Lights Jim Johnston asked if the 6ouncil would give consideration to not requiring street lights at the intersection of Co. Rd. 24 and Meadowwoods Tr. and on Cherokee as other areas of Medina do not seem to have street lights. Chief Hoover stated that he would inspect both locations and make reoommendations to the Council. 5. INFILTRATION -INFLOW ANALYSIS Paul Pearson requested that the Council grant a time extension until August, 1982 for com- pletion of their contract for the Infiltration -Inflow Analysis. Be stated that because of the dry Spring of 1981 flow records could not be developed to complete the Analysis. Motion by Crosby, seconded by Lutz to grant an amendment to the contract with McCombs -Knutson Go extend the project until August, 1982. Motion declared carried 6. NORTHWEST SUBURBAN CHAMBER OF COMMERCE Members discussed the following requests made by the Chamber of Commerce: Hamel Sidewalk Shoveling Richard Schleifer stated that he would ieview the ordinance as he believed there is an exist- ing provision requiring property owners to shovel sidewalks immediately after a snowfall. s 7 Rubbish and Junk Accumulation William Reiser stated that he would contact one property owner and attempt to have the yard put in order. Chief Hoover reported that one property has been partially cleaned and that he would invest- igate another situation. Lumber Piled at 3365 Mill Dr. Fire Marshall, Loren Kohnen, will be asked to contact the owner of the lumber and instruct that it be stored properly. 7. BILLS Council asked that Paul Pearson find out from his office the events regarding the work that Loren Leuer did on the Lutz property on Hamel Rd. Motion by Scherer, seconded by Crosby to pay the bills including the bill of Loren Leuer in the amount of $ 397.50; Order Checks # 9801-9803 in the amount of $12,163.65 and Payroll Checks # 6451-6460 in the amount of $5,010.07. Motion declared carried 8. CITY HALL STORM WINDOWS Thomas Anderson reoommended that storm windows be purchased according to quote received from Scherer Bros. Lumber Co, as fire rated shades cannot be found. Sarah Lutz asked for a determination as to the amount of savings that would be realized if the strom windows were installed. Matter was tabled pending calculation by Mayor Anderson. 9. ARROWHEAD DR. Steve Muth and Ralph Eekes asked if Council would consider making improvements to ArroW- head Dr. as it is very bad in the spring of the year. Wilfred Scherer stated that he and Ron Duran would inspect the road. Richard Schieffer stated that he would review the facts regarding the easements .that had been sought several years ago.
