F.S.S. 286.0105 MINUTES OF THE SPECIAL MEETING HELD BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM ON TUESDAY, JULY 21, 2009 AT 9:00 A.M., IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Mayor Koch called the meeting to order at 9:00 A.M. II. Pledge of Allegiance. The Pledge of Allegiance was led by the May:,r. . III. Roll Call. Present and William F. Koch, Jr. Mayor Participating: Joan K. Orthwein Vice -Mayor Fred B. Devitt III Commissioner Muriel J. Anderson Commissioner Also present and William H. Thrasher Town Manager Participating: Rita L. Taylor Town Clerk Garrett Ward Police Chief Absent: Chris D. Wheeler Commissioner IV. Interlocal Service Agreement for Fire and Emeroencv Medical Services with City of Delray Beach. Mayor Koch announced that the Special Meeting is held with regard to the Interlocal Service Agreement for Fire and Emergency Medical Services with the City of Delray Beach. He thought it would be of interest to note some relevant budget item statistics from previous years. The Mayor said that in the year 1939, the Town paid the City of Delray Beach an amount of $12.00 for fire and emergency services and the Town Clerk was paid $50.00. In the year 1947, the Town paid the City of Delray Beach an amount of $500.00 for fire and emergency services, the Town Clerk was paid $600.00 and a policeman's year- around salary was $2,400 plus one -half of the fines collected. Mayor Koch asked if there were any questions concerning the proposed agreement. Commissioner Anderson had a question concerning Section 8 on Page 3 of the agreement which pertains to complaints. She stated that this was her first time reviewing a new Fire Contract and wanted to know if there was a history of complaints made by the Town to the Delray Beach Fire Department while under such agreement. Town Manager Thrasher responded and said that there were none to his knowledge. Commissioner Devitt asked if the Town Attorney had reviewed the agreement for legal sufficiency. Town Clerk Taylor said that Attorney Randolph reviewed the Agreement and sent a letter with his comments, which Clerk Taylor read aloud, as follows: I have reviewed the Interlocal Service Agreement between the City of Delray Beach and the Town of Gulf Stream and hereby approve same as to legal form and sufficiency. There are only two issues worth commenting on which I do not believe the Town will want Special Meeting Town Commission - July 21, 2009 Page 2 to make an issue of in light of the fact that Delray has already approved this Agreement. At paragraph 1C at the top of page 2, it indicates that the City shall provide emergency medical transport services as long as the City possesses a Certificate of Public Convenience and Necessity and allows the City to cease to provide those services to the Town in the event it no longer possesses such Certificate. There is no reduction in the cost to the Town in the event those services can no longer be provided. It seems to me, however, that this provision is of little moment as I cannot imagine that the City will lose its Certificate of Public Convenience and Necessity. The only other issue is that there is no opt -out provision for the Town other than for breach of the Agreement or for good cause shown. The Town, therefore, will be bound to the Agreement for the ten - year term. Please do not hesitate to contact me if you have any comments or questions. Mayor Koch asked if there was a motion. Commissioner Anderson moved and Vice -Mayor Orthwein seconded to approve the Interlocal Agreement for Fire and Emergency Medical Services with City of Delray Beach. All voted AYE. V. Adjournment. Mayor Koch asked for a motion to adjourn the meeting. Commissioner Anderson moved and Commissioner Devitt second to adjourn the meeting. All voted AYE.
