HomeMy Public PortalAbout11/18/2014 City Council MinutesMEDINA CITY COUNCIL MEETING MINUTES OF NOVEMBER 18, 2014 The City Council of Medina, Minnesota met in regular session on November 18, 2014 at 7:00 p.m. in the City Hall Chambers. Mayor Weir presided. I. ROLL CALL Members present: Anderson, Martin, Martinson, and Weir. Members absent: Pederson. Also present: City Administrator Scott Johnson, City Attorney Ron Batty, City Engineer Tom Kellogg, City Planner Dusty Finke, Public Works Director Steve Scherer, Chief of Police Ed Belland, and Recording Secretary Amanda Staple. II. PLEDGE OF ALLEGIANCE (7:00 p.m.) III. ADDITIONS TO THE AGENDA (7:01 p.m.) The agenda was approved as presented. IV. APPROVAL OF MINUTES (7:01 p.m.) A. Approval of the November 5, 2014 Regular City Council Meeting Minutes It was noted on page four, line 42, it should state, "Maw Upon Martin's inquiry, staff confirmed... On page four, line 43, it should state, "She Staff also confirmed..." On page five, line 29, it should state, "...#e414:116 focus groups..." On page five, line 33, it should state, "...commended Weir for her leadership of in establishing. and leading the kW-14Ms focus groups." On page five, line 35, it should state, "...fer-ums focus groups..." Moved by Anderson, seconded by Martinson, to approve the November 5, 2014 regular City Council meeting minutes as amended. Motion passed unanimously. B. Approval of the November 10.2014 Special City Council Meeting Minutes Moved by Martinson, seconded by Martin, to approve the November 10, 2014 special City Council meeting minutes as presented. Motion passed unanimously. V. CONSENT AGENDA (7:05 p.m.) A. Approve Raffle Permit to North Memorial Health Care System Foundation on February 6, 2015 at 500 Highway 55 B. Approve Cooperative Agreement for Tower Drive Improvement Project with the Elm Creek Watershed Management Commission C. Resolution No. 2014-80 Accepting Donation from Stephen Pflaum on Behalf of the Citizens for Medina Committee D. Approve Job Description and Recruitment for Full-time Public Works Maintenance Worker Moved by Martin, seconded by Martinson, to approve the consent agenda. Motion passed unanimously. VI. COMMENTS (7:06 p.m.) Medina City Council Meeting Minutes 1 November 18, 2014 A. Comments from Citizens on Items not on the Agenda. There were none. B. Park Commission Scherer reported that the Park Commission will meet the following night to discuss the Preliminary Plat and park dedication for the Villas project. He stated that the Commission will also discuss signage for Lakeshore Park, the Friends of the Park program, and a possible Eagle Scout projects. C. Planning Commission Planning Commissioner Mitchell reported that the Commission met the previous week to discuss several items at length including the Villas project, which was unanimously denied; and a request from a memory care center. He stated that the Commission asked staff to determine if there is a better method for approval rather than rezoning and a Comprehensive Plan amendment. He advised that the Commission opened a public hearing regarding the Staging Plan but continued it because of the late time of the meeting. VII. NEW BUSINESS A. Ordinance No. 568 Regarding Brewing. Distilling, and Similar Uses as Accessory Uses; Amending Chapter 8 of the City Code (7:14 p.m.) Finke stated that Hamel Brewing previously spoke to the Council regarding their desires to open a brew pub within the City. He stated that staff previously made changes to the liquor licensing regulations, which were helpful for that type of business, but additional information regarding land use implications was necessary. He stated that previously the Code allowed for liquor establishments within the commercial districts and brewing within industrial districts but there was nothing that addressed the combination of those uses. He stated that this amendment would allow for the brew pub type of business to be allowed within the commercial or industrial zoning districts. He stated that the Planning Commission did recommend unanimous approval of the amendment. Anderson questioned if the Hamel Brewing group would be selling food. Finke stated that there is not an intention to serve food at the location but noted that would not be a land use issue. Moved by Martin, seconded by Martin, to adopt Ordinance No. 568 Amending Chapter 8 of the Code of Ordinances Regarding Brewing, Distilling, and Similar Uses as Accessory Uses. Motion passed unanimously. 1. Motion passed unanimously. B. Ordinance No. 569 Amending Section 625 of the Code of Ordinances Regarding Alcoholic Beverage Licenses (7:20 p.m.) Moved by Anderson, seconded by Martin, to adopt Ordinance No. 569 Amending Section 625 of the Code of Ordinances Regarding Alcoholic Beverage Licenses. Motion passed unanimously. Medina City Council Meeting Minutes 2 November 18, 2014 1. Resolution No. 2014-82 Authorizing Publication of the Ordinance by Title and Summary Moved by Anderson, seconded by Martin, to adopt Resolution No. 2014-82 Authorizing Publication of the Ordinance by Title and Summary. Motion passed unanimously. VIII. CITY ADMINISTRATOR REPORT (7:21 p.m.) A. STORMWATER AUDIT REPORT Scherer provided a summary of the audit results stating that there was not a bad word to be said about the City's stormwater management including monitoring and inspections. Weir congratulated the public works department and the Council for their support of stormwater issues. B. OTHER Johnson reported that the business tours will occur on November 21 st noting that the Council will visit three businesses. IX. MAYOR & CITY COUNCIL REPORTS (7:24 p.m.) Martin stated that she attended the previous Planning Commission meeting and found it to be a very thoughtful process. She stated that she also attended a seminar hosted by The League of Minnesota Cities regarding land use and found the information to be helpful. Weir stated that she and staff welcomed the 1-94 Chamber of Commerce back into Medina, noting that the organization has a new President. She commented that the event was well attended and had a very positive atmosphere. She noted that the Social Host Ordinance has been applied recently in an underage drinking situation. She questioned if the sewer system has functioning meters for the cities of Greenfield and Independence. Scherer stated that he has been visiting sites. He explained that the meters do work but the data collection system connected to the meters is not functioning correctly. He advised that there are some issues with sewer in those cities. He stated that he is going to work with those cities to assist with monitoring. X. APPROVAL TO PAY THE BILLS (7:30 p.m.) Moved by Anderson, seconded by Martinson, to approve the bills, EFT 002860E- 002874E for $10,906.82, order check numbers 042042-042130 for $361,545.83, and payroll EFT 506009-506041 for $49,938.65. Motion passed unanimously. Xl. CLOSED SESSION: ATTORNEY -CLIENT PRIVILEGED DISCUSSION ON ONGOING LITIGATION MATTER SPECIFICALLY STONEGATE FARM, INC. V. CITY OF MEDINA, PURSUANT TO MINN. STAT. SEC. 13D.05, SUBD.3(B) Moved by Martin, seconded by Anderson, to adjourn the meeting to closed session at 7:30 p.m. for an attorney -client privileged discussion on ongoing litigation matter, specifically Stonegate Farm, Inc.
