at 7:40 P.M.
Members present: Wayne Neddermeyer, Mayor; Robert Franklin, Donald DesLauriers, Arthur Theis,
William Reiser, Councilmen; Donna Roehl, Clerk; Richard Schieffer, Attorney
Motion by Robert Franklin, seconded by Arthur Theis to approve the minutes of November 5, 1975
as presented.
Motion carried unanimously
1. ANNE DORWEILER
Robert Anderson
Ms. Dorweiler presented a request from Robert Anderson for a setback variance for the North
portion of Lots 1 and 2, Block 26, Independence Beach (Parcel 7880.) He has been assessed
for one unit for Sewer and water installation but, as of yet, has not combined the lots.
The combined lots would be 73' by 118' and he is planning to build a 54' by 24' house on the
combined lots. At present there is a small cabin located on the property which would be re-
moved before construction on the house begins. Proposed site plans indicate an 18' to 20'
setback from Balsam St. and the 10' side yard requirement has also been met.
Motion by Robert Franklin, seconded by Donald DesLauriers to grant a variance to Robert And-
erson for building a permanent house on Lots 1 and 2, Block 26 for front yard setback of 20
feet and rear yard of not less than 9 feet from lot line; on the condition that the 2 lots are
combined and the existing structure removed before completion of new house. Variance granted
because of small lot size, existence of similar setbacks in the area, practical difficulty of
any other design and unnecessary hardship in that strict adherence to setback requirements
would deprive property of substantial part of its value.
Motion carried unanimously
House on Wayne Allen's Plat (Maple Crest)
Anne Dorweiler and Don DesLauriers explained that the drainfield and the newly constructed
house have been placed differently than the plans presented to the 2ity and that the building
inspector would not approve the septic system unless a pert test of thrsite being used or
1000 feet of drainfield be installed. Attorney stated that project could be stopped until
revised plans were presented or they could conform to building inspectors ruling. He stated
that he would contact the Building inspector and discuss the matter.
Motion by Donald DesLauriers, seconded by. Robert Franklin to ask the Zoning Admihistrator to
recommend to building inspector that he adhere to plot building plans as presented for the
original approval of plat.
Motion carried unanimously
2. JOE BIZZANO, DILLMAN FARM LAND DIVISION
Mr. Schieffer explained the agreement he had drawn up for approval by city and purchasers of
property. Discussion of whether or not a blacktopped street would be required on that protion
of roadway that was to be used by more than 2 owners.
Motion by Robert Franklin, to approve agreement with the last paragraph on Page 2 amended to
read: Requirement for blacktopping waived provided upgraded street serve no more than 5
dwelling units and no tract subdivided into less than 5 acres, subject to payment of attorney
fees and site location of driveway subject to approval of Zoning Administrator and approval
by Hennepin County as to entrance location from County Road.
Motion by Robert Franklin to amend motion by the addition of the word "upgraded" before"drive-
way", seconded by Arthur Theis.
Motion carried unanimously
3. WILLIS KOHNEN
Discussion of back payment by Medina of $1063.10 to bring PERA coverage of Willis Kohnen up
to date. Attorney explained that city could ask the association to conclude that Mr. Kohnen
has performed as an independent contractor and not as an employee. Mr. Kohnen, if he wished,
could present information regarding employee status, but in any case authorization must be
gotten from PERA as public monies are being spent when PERA benefits are paid by a municipality.
Motion by Arthur Theis, seconded by Donald DesLauriers to direct Attorney to submit facts to
PERA for determination as to whether or not Willis Kohnen is an independent contractor or a
City employee.

(fib HENNEPIN COUNTY TRANSPORTATION STUDY
Al Jubert and Wayne Neddermeyer gave report of Transportation Study meeting. Several Medina
residents were in attendence and letters had been received by the County regarding a north -
south route through Medina. They were again told that this is a study and any work is 10 or
more years in the future, but, that any such route is definitely needed to connect Co. Rd.
116 with Long Lake.
5. HENNEPIN COUNTY PARK TAX ABATEMENT
Report by Robert Franklin regarding request from County Park for tax abatement on house
located in Medina and being rented to a Park employee. Information presented will be taken
under advisement and there is a fair chance that Medina could receive 30%,of rent -paid in
lieu of taxes.
6. JAIL SERVICE
Discussion of County paying for entire cost of jail service and not individual municipalities
paying own expenses. Council felt that each should take care of own expenses or we could end
up paying a large protion of Minneapolis jail costs.
7. SUBURBAN NURSING SERVICE
Wayne Neddermeyer reported that the Northwest League had decided that communities should not
enter into agreement until each city was pro rated for the amount of services that are used by
each.
Motion by Robert Franklin, seconded by Donald DesLauriers to ask that Arthur Theis look into
alternatives avoilable to individuals and schools in Medina in lieu of Suburban Nursing Service.
Motion carried unanimously
8. BILLS
Motioh by Arthur Theis, seconded by Donald DesLauriers to pay bills, Payroll in the amount of
t 2008.24.
Motion carried unanimously
9. SNOWPLOWING
Clerk was instructed to,place an add in local paper for part time experienced snowplowing
help and all applicants to fill out an application form.
Motion by Donald DesLauriers, seconded by Wayne Neddermeyer that all city employees checks
be mailed to them unless they pick them up personally before noon the day following a meeting.
Motion carried unanimously
10. AUDIT FOR 1975
Discussion of up -coming audit. Members and attorney will contact auditors in the area and
decision as to whom to hire will be made at the December 2nd meeting.
11. LIBRARY SIGN
Clerk was instructed to discuss with the librarian the type of directional sign they wish to
have installed+
12. COMPREHENSIVE GUIDE PLAN
Discussion of removing and combination of several pages of plan after it has been sent to Metro
Council for approval. Following deletions were suggest4d: Page 1, then the following 3 maps,
Pge 2, the following 3 maps; Page 39 and the following 2 pages; the planning program page.
Don DesLauriers had list of several questions regarding information given in plan.
Page 27--small community centers haveing one common entrance.
Page 28--Item 7--one quadrant may remain residential if commercial establishment is across
street. Discussion of sign restrictions and screening requirements for various businesses.
Discussion of zoning in the Hamel area and how that area is expected to develop. Further
discussion tabled until December 2nd.
Motion by Robert Franklin, seconded by William Reiser to adjourn. Motion carried unanimously
