ROLL CALL The f ollowing Councilmembers were present for roll-call: Present: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward, and Wiseman Absent: None ADOPTION OF THE AGENDA Councilmember Hensley motioned and Councilmember Ward seconded the motion to amend the agenda, moving the Informal Calendar to immediately follow the Consent Agenda. Bill 2022-052 on the Informal Calendar adopts the FY2023 City Budget. Bill 2022-071 under Bills Introduced (which is check-marked to suspend the rules) is a supplemental to the FY2023 City Budget and funds the City’s composting contract. The motion passed by roll call vote: Aye: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward, and Wiseman Nay: None Councilmember Hensley motioned to adopt the agenda as amended. Councilmember Ward seconded the motion. The motion passed unanimously by voice-vote. MISCELLANEOUS AGENDA ITEMS Mayor Tergin presented the “Do Not Disturb While Driving Day” and “Buckle Up Phone Down Day” proclamations. PUBLIC HEARINGS a. Rezoning .83 Acres Located in the 1200 Block of West Stadium Blvd. from C -O and C-2 to C-2 and RA-1 and Approving a Final Subdivision Plat of Ridgecrest Subdivision, Section 3 i. Associated Pending Bill 2022-066 A Staff presentation was made by Sonny Sanders, Director of Planning and Protective Services. Paul Sampson with Central Missouri Professional Services, spoke on behalf of the property owner. There being no one else to speak on the bill, Mayor Tergin declared the evidentiary portion of the public hearing concluded. 2022-067 sponsored by Councilmember Lester AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY LOCATED IN THE 900 BLOCK OF EMILY LANE CONTIGUOUS TO THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT. Bill 2022-067 was read third time by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16281. PRESENTATIONS FROM STAFF, CONSULTANTS & INVITED GUESTS Dave Weber and Mark Haymart with Allstate Consultants LLC, presented their Capitol Avenue Structural Assessments Report. There was considerable discussion between the consultants, Staff, and Councilmembers. ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF City Council committee announcements: • Committee on Administration – The next meeting is November 2nd, 7:30 A.M. in the Boone-Bancroft Room. • Finance Committee – The next meeting is this Friday, October 20th, 7:30 A.M. in the Boone-Bancroft Room. • Public Safety Committee – The next meeting is Tuesday, October 25th, 7:30 A.M. in the Police Training Room. • Public Works & Planning Committee –The next meeting is November 10th, 7:30 A.M. in Council Chambers. The Parking Garage Study will likely be discussed at the meeting. Fire Chief Matt Schofield presented a recap from Fire Prevention Week which was October 9th – 15th. The theme was “Fire Won’t W ait, Plan Your Escape”. Nicholas Tietsort, Cole County Emergency Management Director announced the Great American ShakeOut Earthquake Drill which is scheduled for October 20th at 10:20 A.M. Mayor Tergin announced City Hall will be participating in the drill. Mayor announcements: • The State of the City and County 2022 was held last Friday, October 14th. The event was hosted by the Jefferson City Chamber of Commerce. • The 9/11 Memorial Stair climb is October 22nd at the Jefferson Building. There is still time to register to participate in the fundraising event. • A Community Bike Ride was held Saturday, October 15th. 4 REGULAR COUNCIL MEETING, OCTOBER 17, 2022 • This season’s last show at the Capitol Region MU Amphitheatre is this Saturday, October 23rd featuring the movie, Napoleon Dynomite with a Q & A session with cast members after the movie. Councilmember Spencer congratulated the Lady Cavaliers Tennis Team on their District Championship. LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE Octavia Ailsworth announced several university events. The announcements are attached to the minutes. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS Bill Farr spoke in favor of bill 2022-071 which funds the City’s composting contract. Ryan Davis spoke in favor of bill 2022-071. DJ Drury, 208 Marshal St., spoke in favor of the City issuing a “Call for Interested Parties” in regards to the Capitol Avenue Properties, rather than voting to demolish at this time based on the structural assessments presentation earlier in the evening. Donna Deetz, 720 E. High St. is a member of the Historic City of Jefferson and Historic Preservation Commission. She also spoke in favor of a “Call for Interested Parties”. Jenny Smith and Jason Jett also spoke in favor of a “Call for Interested Parties”. Mr. Jett mentioned interest in the 415 Commercial Way property. Gary Dey, 1434 Inglenook Dr,. spoke on the declining condition of City streets. He recommended a three year plan to get the City’s streets in quality condition. He thanked City Council for their service to the community and said he realizes the FY2023 City Budget is near adoption. He would like to see the City Council address the streets in future budgets. Amanda Burke Williams, 103 Jackson spoke in favor of a “Call for Interested Parties”. Diane Toebben, City resident, spoke in favor of funding the City’s compositing contract, bill 2022-071. INFORMAL CALENDAR 2022-052 sponsored by Councilmember Hensley AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING A BUDGET AND PERSONNEL CLASSIFICATION PLAN FOR THE CITY FOR THE PERIOD OF NOVEMBER 1, 2022, TO OCTOBER 31, 2023, AND APPROPRIATING MONEY IN THE CITY TREASURY TO PAY THE COST OF OPERATING THE CITY GOVERNMENT DURING THAT PERIOD IN ACCORDANCE WITH THE BUDGET. Councilmember Hensley requested take bill 2022-052 off the informal calendar for discussion and a vote. There was no objection. Councilmember Hensley motioned to adopt Substitute bill 2022-052. Councilmember Schreiber seconded the motion. The motion passed unanimously by voice -vote. 5 REGULAR COUNCIL MEETING, OCTOBER 17, 2022 Substitute bill 2022-052 was read third time by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16282. Aye: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward, and Wiseman Nay: None Councilmember Hensley, Chair of the Finance and Budget Committees thanked the City Council and City Staff for their hard work on the FY2023 budget. Mayor Tergin also thanked City Councilmembers, City Staff, and specifically Councilmember Hensley for chairing the Budget Committee. BILLS INTRODUCED With the passing of the FY2023 City Budget bill, substitute bill 2022-052, the number of people in the audience interested in the City’s compositing contract, and the lengthiness of the meeting, Mayor Tergin requested to take up introduced bill 2022-071 at this time. There was no objection. 2022-071 sponsored by Councilmember Hensley, co-sponsored by Councilmember Spencer AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE FY2023 BUDGET OF THE CITY OF JEFFERSON, MISSOURI, BY SUPPLEMENTALLY APPROPRIATING ADDITIONAL FUNDS WITHIN THE SALES TAX G CAPITAL IMPROVEMENT TAX FUND AND DEFUNDING/FUNDING SPECIFIC ITEMS IN THE GENERAL FUND. Councilmember Hensley requested to suspend the rules and take up bill 2022-071 for third reading and passage. With no objection, bill 2022-071 was third read by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16283: Aye: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward, and Wiseman Nay: None RESOLUTIONS With the number of people in the audience interested in RS2022-32 related to the Scholastic Industrial Development Project and the length iness of the meeting, Mayor Tergin requested to take up RS2022-32 as this time. RS2022-32 sponsored by Councilmember Fitzwater A RESOLUTION OF OFFICIAL INTENT OF THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, FOR THE ISSUANCE OF THE CITY’S TAXABLE INDUSTRIAL DEVELOPMENT REVENUE BONDS IN A PRINCIPAL AMOUNT OF 6 REGULAR COUNCIL MEETING, OCTOBER 17, 2022 APPROXIMATELY $30,000,000 TO FINANCE A PROJECT FOR THE BENEFIT OF SCHOLASTIC INC. AND AUTHORIZING CERTAIN ACTIONS RELATING THERETO. Ryan Moehlman, City Attorney, and Luke Holtschneider, President and CEO of JCREP presented the resolution. Councilmember Schreiber motioned to adopt RS2022-32. Councilmember Fitzwater seconded the motion. The motion passed by the following roll-call vote: Aye: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward, and Wiseman Nay: None NEW BUSINESS With the number of people in the audience interested in Capitol Ave. properties presented for demolition, Mayor Tergin requested to take up the item at this time. There was no objection. Councilmember Fitzwater motioned to begin the “Call for Interested Parties” process immediately with anticipated dated of public release at the end of the month, and allowing interested parties 4 weeks to show interest from the time of the public release. Councilmember Hensley seconded the motion. The motion passed unanimously by voice vote. Councilmember Hensley motioned to include in the “Call for Interested Parties”, parties must agree to a cash bid of 15% of fair market value as set by the courts and deposit an escrow of $5,000 or 1% of Allstate’s estimated cost to make safe. Councilmember Fitzwater thanked City Staff for their hard work in obtaining the CDBG- Disaster Recover Funds Grant. Octavia Ailsworth Lincoln University Agenda City Council Meeting 10/17/2022 Project REACH • On Thursday, October 13th, the Project REACH Letter of articulation signing, and kick- off was held at Lincoln University. Project REACH is a feeder program created by Cyber.org to recruit a diverse body of K-12 students to pursue undergraduate cybersecurity degrees and bolster the U.S. cybersecurity workforce. Jefferson City High School and Capital City High School are Lincoln University’s Cyber.org Project Reach partners. Missouri State Museum Reception • Also, on October 13th a reception was held at the Missouri State Museum to recognize Lincoln University of Missouri students who redesigned Missouri Black History panels that are now on display at the museum inside the Missouri State Capitol Building. LU Army ROTC Hall of Fame Induction Ceremony • On Friday, October 14th the LU Army ROTC Hall of Fame Induction Ceremony was held at The Soldiers Memorial. Sweat Pink Fitness Challenge • In Honor of Breast Cancer Awareness Month, the Sweat Pink Fitness Challenge will be held from October 17-20 at The Linc. Participants are encouraged to wear pink-out attire and there will be pink smoothies and snacks! Binge Watching-LU-MRRL Lecture Series • The next LU Missouri River Regional lecture Series event “The Professional Development of Binge Watching- A Business Professor’s Perspective” will be held on October 25th at 6:30 pm at the Missouri River Regional Library’s Art Gallery. The speaker for this event is Dr. Troy Frank, Associate Professor of Business. Think Pink Game: • We would like to encourage everyone to attend for the Think Pink Football Game this Saturday October 22nd at 2:00pm in pink attire as the Blue Tigers play against Nebraska Kearney. Passion 4 Pink 5K Run • We would also like to encourage everyone to attend the Breast Cancer Awareness Passion 4 Pink 5k Run on Sunday October 23rd. Registration begins at 12:30 p.m. and the race will begin at 1:00pm at the lower level Linc Parking Lot. Everyone is encouraged to wear pink attire and there will also be giveaways as well as vendors at this event.
