AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN M-2 GENERAL
INDUSTRIAL DISTRICTS OF ORDINANCE 2325-1968 COMMONLY KNOWN
AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA
APPROVED JUNE'"3. 1968.
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as
follows:
SECTION 1. As provided in Article 35, Section .011 and Article 48 of Ordin-
ance of the City of Richmond, Indiana the following described real
estate is allowed as a Special Use to wit: Service Station to be
located at South West Corner North West 5th Street and Forrest
Drive, Richmond, Indiana:
(see attached Legal Description)
SECTION 2. As a condition -of the aforesaid Special Use and as an additional
restriction on said use, the following requirements shall here-
after and at all times be met by the owner, leasee or any other
- person, firm or corporation using such real estate.

SECTION 3. The Zoning Administrator of the City of Richmond is hereby auth-
orised and directed, upon enactment and publication of this ordin-
ance, to record and approve the issuance of a permit for the es-
tablishment of the use herein allowed.
SECTION 4. This ordinance shall be in full force and effect from and after its
passage, approval by the Mayor ,and publications as by law required.

of each month at 1:30 P.M. in the City Council
Chambers. The presence of the petitioner is
mandatory at both the preliminary and public
hearings. Four copies of this petition are
to bt filed with the Director of Planning.

and structures. A legal description is

State of Indiana, and more particularly described as follows:
TRACT I:
A part of the southwest quarter of Section
19, Township 14 North, Range 1 West in Wayne
Township, Wayne County, Indiana, and being
more particularly described as follows:
Beginning at a point 341.25 feet West of the
centerline of Indiana State Highway Number
38, said point being 610.32 feet East of a
stone, said stone being 98.44 rods West and
77.5 rods North of the Southeast Corner of
the Southwest Quarter of Section 19, and
running thence, from said beginning point,
East 341.25 feet to the centerline of State
Highway Number 38; thence Northwestwardly
along said centerline, 106.9 feet; thence
West 264.5 feet; thence South 75 feet to the
place of beginning.
Subject to all legal highways and rights of
way.
TRACT II:
A part of the Southwest Quarter of Section 19,
Township 14 North, Range 1 West in Wayne
Township, Wayne County, Indiana, being more
particularly described as follows;
Beginning at a point 610.32 feet East and 150
feet North of a stone, said stone being 98.44
rods West and 77.5 rods North of the Southeast
corner of the Southwest Quarter of Section 19,
and running thence South 75 feet; thence East
---1-.264.5 feet to the centerline of Indiana State
Highway Number 38; thence Northwestwardly, along
said centerline, 107.3 feet; thence West 187.9
feet to the place of beginning.
Except that part thereof conveyed to Carl E. Scott
and wife by deed dated December 16, 1955, and
recorded in Deed Record 270, Page 331 of the
records of Wayne County, Indiana.
Subject to all legal highways and rights of way.
Subject to taxes for the year 1968, due and
payable in 1969, and all subsequent taxes.
Subject to streets, highways, easements and
restrictions of record, if any.
The consideration being paid for this conveyance
is not such consideration as to be taxable for
federal and state tax purposes and is therefore
exempt therefrom.
It is the intention of Party of the First Part herein,
by this deed, to correct the description set out in that certain

C O R R E C T I O N D E E D
THIS DEED OF CORRECTION Made and entered into this
day of , 1969, by and between
NANC DEVEWPMENT CORPORATION, a corporation organized and
existing under the laws of the State of Indiana, Party of the
First Part, and SUN OIL COMPANY, a New Jersey Corporation,
Party of the Second Part;
W I T N E S S E T H•
WHEREAS, on the 24th day of January, 1969, a certain
deed of conveyance was made and entered into by and between
First Party and Second Party; and,
WHEREAS, said deed of January 24, 1969, was recorded,
in Book 344, Pages 404 and 405, office of the Recorder of
Wayne County; and,
WHEREAS, said deed of January 24, 1969, does not
contain an accurate description of the property which was
intended to be conveyed herein; and,
WHEREAS, both parties are desirous that this Deed of
Correction be made.
NOW, THEREFORE, for and in consideration of the
valuable considerations heretofore paid to Party of the First
Part, the receipt and sufficiency of all of which is hereby
acknowledged in full, the Party of the First Part has this day
bargained and sold, and does by this instrument hereby BARGAIN,
GRANT, ALIEN, SELL AND CONVEY unto Party of the Second Part, --its
successors and assigns forever, the following bounded and
described real estate, lying and being situated in Wayne County,
