HomeMy Public PortalAbout2463-1970 - Authorizing an agreement amending a certain lease & license to Reid HospitalOx 1725 APR 30 in pal ORDINANCE NO. 2401970 AN ORDINANCE AUTHORIZING AN AGREEMENT AMENDING A CERTAIN LEASE AND LICENSE TO THE REID MEMORIAL HOSPITAL, INC. WHEREAS, on March 8, 1928, the City of Richmond, Indiana, through its Board of Public Works and Safety leased a tract of real estate to Reid Memorial Hospital, which provided that if improvements were to be located thereon, the consent of the City must be first obtained, and, WHEREAS, in order to provide better facilities, improvements shall be required to be erected thereon, and, WHEREAS, the Board of Public Works and Safety of the City of Richmond, Indiana, has executed the attached Agreement Amending Lease and License, and, NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SECTION 1. That the Agreement dated March 8, 1928, be and is hereby amended to permit Reid Memorial Hospital, Inc. to place improvements on real estate leased by the City to Reid Memorial Hospital, all in accordance with the attached Agreement, and in all other respects, the terms and conditions of said lease and license dated March 8, 1928 are hereby ratified and confirmed. SECTION 2. That the Board of Public Works and Safety of the City of Richmond, Indiana, is authorized and empowered to execute the attached Agreement Amending Lease and License. SECTION 3. This ordinance shall be in full force and effect from and after its passage and approval by the Mayor and is subject to the laws of the State of Indiana. C• Mayor ATTEST:_ City Clerk BOOK PQt;E AGREEMENT AMENDING LEASE AND LICENSE WHEREAS, on March 8th, 1928, the City of Richmond, Wayne County, Indiana, as owner, acting by its Board of Public Works leased to Reid Memorial Hospital (now Reid Memorial Hospital, Inc.) the perpetual right to use, for hospital purposes, the following described real estate, to -wit: Lot Number Four (4), in the division of the estate of William Bulla, containing five (5) acres, and being a part of the southwest quarter of Section Twenty-eight (28), Township Fourteen (14), Range One (1), West, ex- cepting therefrom, however, a strip of ground five (5) feet in width off the entire south side of said real estate, which strip of ground was heretofore deeded by Joseph P. Gift and Alice A. Gift, his wife, to Wayne County, Indiana, for road purposes. Being the same real estate as was deeded by Joseph P. Gift and Alice A. Gift, his wife, to the City of Rich- mond, which deed is recorded in Deed Record No. 147, pages 503 and 504 in the Recorder's Office of said Wayne County, Indiana, to which deed and record reference is here made. and WHEREAS, it was stipulated in said Lease and License that if said Hospital desires to erect any permanent buildings on said premises, that the consent of said City thereto should be secured, and WHEREAS, said Hospital in order to provide better facilities for the care and treatment of the citizens of Richmond and the area served by the Hospital is in the process of expanding its physical plant and incident thereto has erected part of its new heating plant on the east portion of the above described real estate, and WHEREAS, said City recognizes that its citizens will derive substantial benefit from an expanded, more modern Hospital. BODY 11 PAGE 124 - 2 - NOW THEREFORE, in consideration of One Dollar and other good and valuable considerations flowing from said Hospital to said City, said Agreement dated March 8, 1928, is hereby amended as follows: That the City of Richmond, Indiana hereby agrees and consents that Reid Memorial Hospital, Inc, shall have the right perpetually to place, erect, install, and maintain permanent buildings and im- provements, to be used as a part of the maintenance, operation and business of said Hospital on the following described real estate, to -wit: Being part of Lot Number Four (4), in the division of the estate of William Bulla, in the Southwest Quarter of Section Twenty-eight (28), Township Fourteen (14) North, Range One (1) West, and in the Town of Spring Grove, Wayne County, Indiana, more particularly described as follows: Beginning at a point on the south line of Lot Number Four (4), in the division of the estate of William Bulla, said point being eight hundred ninety-seven and sixty hundredths (897.60) feet north, and five hundred eighty-eight and thirty hundredths (588.30) feet east, of the southwest corner of the Southwest Quarter of Section Twenty-eight (28), and running thence, from said beginning point, north zero (0) degrees and thirty-four (34) minutes west, assuming the west line of said Southwest Quarter to run north and south, three hundred thirty and two hundredths (330.02) feet to a point on the north line of said Lot Four (4); thence east, along said north line, seventy-five (75) feet to the northeast corner of said Lot; thence south zero (0) degrees and thirty-four (34) minutes east, along the east line of said Lot Four (4), three hundred thirty and two hundredths (330.02) feet to the southeast corner of said Lot; thence west, along the south line of said Lot Four (4), seventy-five (75) feet to the place of beginning, contain- ing an area of five hundred sixty-nine thousandths (0.569) acres. EXCEPT THEREFROM: Five (5) feet off the entire south side of the above described tract, previously conveyed to the Town of Spring Grove, by Quit Claim Deed recorded in Book 137, page 342, on August 9, 1913, in the records of the Wayne County Indiana Recorder, and containing an area of nine thousandths (0.009) acres. SUBJECT TO: The right-of-way of all legal highways and any easements of record. - 3 - In all other respects, the terms and conditions of said Lease and License dated March 8, 1928 are hereby ratified and affirmed.
