A RESOLUTION APPROVING THE ASSIGNMENT AND ASSUMPTION OF
DEVELOPER'S AGREEMENT FOR PRAIRIE VILLAGE — PART TWO
Whereas, Iowa Development Group, Inc. had requested and was approved a
Preliminary Plat called Prairie Village -- Part Two, and a Developer's Agreement was
entered into; and,
Whereas, Iowa Development Group, Inc. has officially executed a purchase agreement
with The Boulders, LLC and has recently closed on the purchase of a portion of the real
estate; and
Whereas, Iowa Development Group, Inc. and The Boulders, LLC have requested the
City execute a consent to the attached Assignment and Assumption of Developer's
Agreement for Prairie Village - Part Two,
Now, therefore be it resolved by the City Council of Tiffin, Iowa, that:
1, The Mayor and City Clerk are hereby authorized to execute a consent to the
attached Assignment arid Assumption of Developer's Agreement for Prairie
Village- Part Two , which provides that The Boulders, LI C, as Owner of the
property agrees to assume the responsibilities of ffie Developer. under. the
Developer's Agreement for Prairie Village -- Part Two and Iowa Development
GrOUP,, Inc. consents to the transfer of said development rights and obligations,
2. In all other, respects riot inconsistent with the ternis of this Amendment, the
terms of the Developer's Agreement for Prairie Village Part Two shall remain
in full force and effect.
On the 17th day of September 2019, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Havens introduced RESOLUTION NO. 2019-107, A
RESOLUTION APPROVING THE ASSIGNMENT AND ASSUMPTION OF THE
DEVELOPER'S AGREEMENT FOR PRAIRIE VILLAGE — PART TWO and made a
motion for approval. The motion was seconded by Councilperson Bartels.
Ayes: Havens, Upton, Schnedler, Bartels
Nays: one
Absent: Ryan
Whereupon four Council members were present and voted approval and Mayor Berner
declared that RESOLUTION NO. 2019-107, A RESOLUTION APPROVING THE
ASSIGNMENT AND ASSUMPTION OF THE DEVELOPER'S AGREEMENT FOR
PRAIRIE VILLAGE — PART TWO to be adopted and signified his approval of the same
by affixing his signature thereto.
Passed by the City Council on the 17th day of September, 2019.
