CALL TO ORDER AND ROLL CALL
Mayor Kulesza called the special meeting of the McCall City Council to order at 1:10 p.m.
Council Member Bailey, Council Member Briem, Mayor Kulesza and Council Member
Scott answered roll call. A quorum was present. Council Member Kraemer was absent.
Also present were Lindley Kirkpatrick, City Manager and Fred Quiel, Deputy City Manager /
Administrative Services. City Attorneys present were Kim Trout, Dick Kluckhohn and Bill
Nichols (via telephone).
Mayor Kulesza read the following statement: "Recent developments in the Wausau/St. Clair
lawsuit, including discussions with the plaintiffs' attorneys regarding possible settlement of the
same, together with the pending judicial confirmation proceeding scheduled to be heard next
week, make it imperative that the City Council discuss these matters with the City's attorneys.
Failure to explore settlement of this litigation could lead to immediate financial loss. These latest
developments occurred late last week such that there was insufficient time to schedule or notice
a meeting until last night. The news media was notified of the meeting as soon as it was
scheduled."
EXECUTIVE SESSION
Council Member Bailey moved to go into Executive Session for litigation pursuant to Idaho
Code §67-2345(1)f to consider and advise its legal representatives in pending litigation or
where there is a general public awareness of probable litigation. The motion was seconded
by Council Member Scott. In a roll call vote, all members voted aye, and the motion
carried.
The Council discussed litigation pursuant to Idaho Code §67-2345(1)f.
Council Member Kraemer joined the meeting at 1:15 p.m. Walt Eisenstein, Deputy City
Manger/Community Development & Infrastructure joined the meeting at 2:14 p.m.

City Attorney Bill Nichols and Council Member Kraemer left the meeting at 2:14 p.m.
Council Member Bailey moved to adjourn the meeting. Council Member Briem seconded
the motion and in a roll call vote, all members voted aye and the motion passed.
ADJOURNMENT
Without further business, the meeting was adjourned at 4:29 p.m.
