HomeMy Public PortalAbout2008.03.03 Special Council MinutesMINUTES McCall City Council Special Meeting March 3, 2008 Agenda Call to Order and Roll Call Executive Session Regular Session Adjournment CALL TO ORDER AND ROLL CALL Mayor Kulesza called the special meeting of the McCall City Council to order at 3:00 pm. Council Member Bailey, Council Member Briem, Mayor Kulesza and Council Member Kraemer answered roll call. A quorum was present. Council Member Scott was absent. Also present were Lindley Kirkpatrick, City Manager and Walter Eisenstein, Deputy City Manager / Infrastructure & Community Development. City Attorneys Bill Nichols and Kim Trout were on the telephone. EXECUTIVE SESSION Council Member Bailey moved to go into Executive Session for litigation pursuant to Idaho Code §67-2345(1)f to consider and advise its legal representatives in pending litigation or where there is a general public awareness of probable litigation. The motion was seconded by Council Member Kraemer. In a roll call vote, all members voted in favor, and the motion carried. The Council discussed litigation pursuant to Idaho Code §67-2345(1)f. Council Member Scott joined the meeting via telephone at approximately 3:05 pm. REGULAR SESSION Council Member Bailey moved to go into regular session at 5:00 p.m. Council Member Scott seconded the motion and in a roll call vote, all members voted in favor and the motion passed. The Council took a brief recess, until approximately 5:05 pm. McCall City Council Special Meeting March 3, 2008 Page 1 of 2 Council Member Bailey moved to adopt Resolution 08-5. Council Member Kraemer seconded the motion. In a roll call vote all members voted in favor and the motion passed. Council Member Bailey moved to send a letter to the attorneys representing Wausau and St. Clair, explaining the Council's position. Council Member Kraemer seconded the motion. In a roll call vote all members voted in favor and the motion passed. Council Member Kraemer moved to authorize the City's attorneys to file an appeal of the dismissal of the Declaratory Judgment action. Council Member Bailey seconded the motion. In a roll call vote all members voted in favor and the motion passed.
